Review: Failure to resolve issues from a product that is a lemon which is ongoing for 5 years now. No paper trail by business, does not return calls.

Purchased 8/29/08, model [redacted], serial [redacted], order # [redacted](these are the numbers on the unit in my house) I purchased a new central and air unit through best Air and financed through SMUD. My payment to SMUD is $90 per month. From the first winter with the heating unit there were problems. The second year Best Air charged me $100 for labor to replace the the stuck valve, stating the unit was still under warranty but the labor was not. I told them then, that the unit was a lemon. The 3rd year, the same problem. The tech (Zach) came out and ended up on the phone with 2 York reps, while in my home, regarding the same issue. York sent a new mother board for the unit, stating they would replace the unit if that did not work. It working for approximately 3 months. I called Best Air at that time and said it went out again (at that point I really did not need to use the heater). Last year when I called [redacted] the same problem and told him I was done, they needed to get this unit replaced, it was a lemon. [redacted] stated that he would come out and at least get it working until he could resolve the issue with York. When [redacted] called back, he stated that York had told him that they had come out with a kit to fix the issue with this model but they wanted $500 (not including labor) for those of us that were no longer in warranty. I informed [redacted] that I would not pay any money as it was an engineering issue and the unit was a lemon. If York had come out with a kit to fix these units it should be a recall from York not the consumer responsibilty to fix these units. [redacted] stated that he would contact York back and see what he could do. I did not hear back from him. This winter the unit has not worked even one day so I contacted Best Air, as [redacted] cell number no longer works) [redacted], at Best Air, stated that [redacted] no loner works for them ([redacted] is the son of the owner of Best Air) [redacted] did say that they have no paperwork stating that there was any problems with my unit and that [redacted] turned in no paperwork each year on my unit. She also stated that they have moved their office and there were boxes of files that she would have to go through to see if there was anything in there. [redacted] also stated that she had spoke with the owner (David) and he said that he would contact York to see what could be done. Not once has [redacted] called me back as she said she would do and each time I call her back she says David is busy but will try and find out what they can do. Not once have they offered to come over and at least get the unit working so we will have some heat. My daughter and I have NO heat in the house and we are in the middle of a freeze! [redacted] just keeps saying that [redacted] no longer works there, I asked her to confirm that [redacted] is David's son, she confirmed that. I then asked if David and [redacted] still communicate, she stated Yes, there are no problems between them. I then suggested that David call [redacted] to help resolve this. [redacted] has stated that he has the same unit as I do and has has the same issues as mine. [redacted] has told me twice that Best Air no longer does business with York because of the problems that my unit had. SMUD refuses to help in any way and I contacted York through their website asking that they replace my unit or send the kit to repair it, I have heard nothing back from them at all. This is ridiculous that we have to go through this over and over each year. I paid $9000 for this unit and I am stuck with a lemon.Desired Settlement: I want this lemon unit replaced with a new unit, the $100 for labor they charged me 3 years ago when the unit was still under warranty. The extra money I will have to pay SMUD this next month as we are borrowing electric heaters from different friends to try and keep the house above 60 degrees so we do not get mold from the wet cold we are experiencing. They should have to pay some sort of settlement for us having to live like this and fight every year, for the past 5 years, for something they should have taken care of. I am paying SMUD $90 per month for a heater that does not work. I am tired of freezing!
