I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ***.
I did come in to the club on 12/16/16, however the personal training manager was not thereI was told by the front desk associates that he is the only one who handles anything related to training, so they could not help me at allThey did write my name and number, along with a note saying I wanted to cancel my personal training, into a logbook they had at the front deskHowever, when I asked recently whether or not the note is still there, they told me the logbook had been discarded permanentlyIt is not my fault that the only person authorized to make changes was not there at the time that he said I could come in, or that the employees threw out the only written evidence of my efforts to cancel.

I did not check in because I did not intend to work out that day, I just wanted to cancel this membership and leaveSince I was told that nobody was around to help me, I asked the front desk associates to write my name and reason for my visit in the logbook, and I left a voicemail for the training manager promptly after leaving the gym that dayIt is not my fault that the associates have since thrown out that logbookIt is also not my fault that no training managers were present at the gym around 3:30pm on a Friday afternoonI made every reasonable effort to cancel this membership, and that effort was not reciprocated in any way

Hello,[redacted] sihned a 6 month agreement for personal training here at Best Fitness. He sihned the agreement stating he was fully aware of the commitment. We have the agreement on file and [redacted] can come pick it up for his records if he would like. His membership and personal training are both past due,...

this is why he has been recieving courtesy calls from us letting him know before it ends up being sent to collections. If [redacted] wishes to end his personal training and his membership before the agreement is up he can pay his past due balance and the early termination fees.  Thank you

Hi [redacted],I have looked into your account with us and see that you are still under agreement. Every member that enrolls into a membership with us here a best fitness signs an agreement which is explained section by section to them and signed off for each detail. This agreement states that if the...

member wishes to cancel there membership before the agreement term has expired there is a $100.00 early termination fee. If the member is moving 25 miles or further away from any Best Fitness they can cancel with ought the early termination fee if they can provide proper proof of move being a lease, mortgage statement, utility bill or a new ID with the address issued within the last 60 days. If the member is cancelling due to a medical condition they are also allowed to cancel with no termination fee if they provide a medical note. [redacted] was advised to freeze her gym membership for $5.00 a month until her new born is old enough to stay in our kids club. It seems that [redacted]'s membership is also past due two months right now and in order to cancel you must pay your past due amount. There is also a late fee along with these charges I will be more then happy to waive. I can also provide [redacted] with a copy of her agreement she signed when enrolling into Best Fitness.  Thank you

[redacted] enrolled in our gym on 5/28/15, he paid the $1.00 enrollment fee and his last month of his 24 month agreement up front which came to $20.99. [redacted] also received his first month free. Best Fitness has an annual enhancement fee for all new members of $49.00 that is billed...

ninety days after the member start date.  Any time a person signs up for a membership our staff fully reviews the agreement with the potential member.  Once the agreement has been explained the member signs off multiple times agreeing to all the terms, conditions and fees. I am more then happy to provide [redacted] with a copy of his agreement if he would like to come into the facility.

Per the member's agreement, there is a 30-day notice to cancel the membership. The member had paid the $100 buyout fee but did not pay the final payment within the 30 day period following the cancelation notice. The member will be removed from collections and will not need to pay the full...

collections balance once this final payment is made. The member may make payment to the club directly either in person or via certified mail.

Mr. [redacted], I have spoken with both managers at the Chelmsford location, our VP of Sales, and looked into your account regarding your issue. Best Fitness' policy around referrals requires members to be linked together through our referral system. I believe both managers explained this to...

you each time you've gone in to discuss your dues to be lowered to $9.99. Since your accounts were never linked, we cannot lower your dues to $9.99. To be sure, I had our VP of Sales look into this as well, and he agreed that we cannot lower your dues to $9.99 at this time. Thank you, [redacted]Best Fitness Corporate Office

I have reviewed the response submitted by the business and have determined that the response does satisfy my issues and/or concerns in reference to complaint #[redacted]. I understand that by choosing to accept the business response that my complaint will be closed as resolved. I have also been getting calls from “[redacted]”, a gentleman by the name [redacted] has told me my collections had been moved from [redacted] Financial to [redacted]. [redacted] had signed up for a 6 month personal training agreement on 12/13/2016 and was made aware of her 3-Day cancel option to cancel the 6 month agreement at no cost and was given a copy of the agreement. On 12/15/2016 the Fitness Director had reached out to [redacted] via phone and left her a message...

reminding her that if she wished to cancel, 12/16/2016 would be her final day to do so without any cancellation fees. As outlined in the agreement, [redacted] would either have to provide a written notice to Best Fitness or give notice in person to cancel out her personal training agreement. Best Fitness does not have any record of [redacted] coming into the club to cancel before 12/16/2016, nor any check-in record of [redacted] coming into or contacting the club during this time at all. If [redacted] has proof that she cancelled out of her personal training agreement in person or via written notice before or on 12/16/2016, Best Fitness will honor the 3-Day cancel and refund the amount paid. If [redacted] has any questions regarding the agreement she signed, Best Fitness would be more than happy to provide her with another copy.

All members coming into the club are required to check-in for every visit. Attached are the records of Ms. [redacted]'s check-ins to Best Fitness. On 12/13/2016 Ms. [redacted] checked in and did not return to the gym until 1/1/2017. Ms. [redacted] would have a record of her checking into Best Fitness on 12/16/2016. If Ms. [redacted] ca provide proof of her cancellation Best Fitness will honor it, however Best Fitness has no record of Ms. [redacted] checking into Best Fitness on this date.

I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted]. Good day,the statements from Best Fitness are categorically false. When I signed the electronic box we were at the front desk and nothing was in front of me at all, so that is completely false that a screen was up in front of me. I do thank Best Fitness for admitting that a copy of the contract was not provided to me which I have stated several times. The response they have provided contradicts what [redacted] the Fitness Director told me, he said I would be charged for 30 days after notifying them of cancelling (something [redacted] the Manager never stated on the day I cancelled) plus the $250 fee. I explained had I known any of that I would have never signed up, It was never disclosed, never mentioned and I was not provided a copy of the contract. IN reading other complaints this seems to be a normal practice. $326 was taken from my account after notifying Best Fitness I was cancelling. [redacted] the manager never stated that would happen. In writing this I just went on my account -and Best Fitness has taken ANOTHER $326.00 from my account on February 27th !!! Everything they do contradicts what they say. I cancelled before January 27th, they still took $326.00/ now they take another $326.00 on February 27th, in the response to the Revdex.com they state only a $250 buyout fee. The next step is an attorney since this is all documented. I suggest the following to resolve this. Reimburse the $326.00 taken on Feb 27, plus $226 of the amount taken on January 27. this leaves $100 for Best Fitness for cancelling, more than fair given the circumstances. I will be calling my attorney next. I don't understand why they are treating a long time member this way,

I have been in touch with the consumer and we have resolved the issue.

Mr. [redacted] had signed up for a six month personal training agreement on 12/26/2016. As per the terms of the agreement, he is responsible for six monthly payments of $326.00. As a courtesy per the terms of the agreement we also offer an option to buy out of the agreement for a $250 fee. These...

terms and conditions were explained to Mr. [redacted] upon signing the agreement. During the signing process, a copy of the agreement was on the screen in front of Mr. [redacted] as he used the electronic signature pad to sign off that he agreed to these terms and conditions as outlined in the agreement. Mr. [redacted] had not asked for a printed copy of this agreement, which is kept electronically in the member's account.  Mr. [redacted] must fulfill the agreement to the terms to which he had agreed to upon signing. He may either pay the buyout fee or fulfull the remainder of hs agreement.
