• Complaint o Roy B [redacted] from Best Lil Fence in Texas was hired to replace a fence between property lines, and during the job caused irreparable damage on my property in April o As of AugRoy still has not directly contacted me to take any responsibility for the damagesI have not contacted Roy per professional advice to wait and see how substantial the damages are (as per time needed to understand whether Roy’s workers’ damages to the mature native live oak caused oak wilt)Separate from oak wilt, the damages inflicted by Roy’s workers to the mature oak are significant in value as per arborist evaluation• Background o My neighbor and I agreed to replace the fence between our yards with the horizontal rails facing my yard and the flat side of the fencing facing my neighbor’s yardo Roy B [redacted] a from Best Lil Fence in Texas was hired to replace the fenceHis workers came to perform the work in April o I was home for a part of the day that the workers were working on the fenceDuring the day, I went in the backyard to look at the work when the workers were removing the vertical posts from the old fenceo After returning home that evening, I checked on the fence between my yard and my neighbor’s and discovered significant, irreparable damage to the mature oak tree located near the fence lineo When I left the home during the afternoon, the workers were not working near the tree, but towards the back of the yardo Workers had cut haphazardly through the tree to run the horizontal fence runner through the tree The workers not only cut through the tree, but also screwed the fence boards and pickets directly into the treeo The original fence which was being replaced was not touching the tree, and there was no permission given to Roy or his workers to cut through the tree or attach the new fence to the treeThe work request was to replace the fenceThe new fence should have replaced the old fence directly without any damage to the propertyo My neighbor immediately contacted Roy and sent pictures of the damage doneo Roy said that his workers were given permission to cut through the treeNo oral or written permission was provided by my neighbor or I, so I asked Roy who gave his workers permission to cut the treeRoy did not have an answero My neighbor and I then called Oak Wilt Specialists and were advised to seal the very large space of cuts immediately, which we did that eveningo Oak Wilt Specialists told my neighbor and I that they would immediately come survey the damage the following morning (based on the photos sent and the verbal understanding of the damage inflicted upon the tree)It is well documented and communicated in my neighborhood and by the City of Austin arborist that trees in the neighborhood should not be cut between Feb-Junas oak wilt could easily spread during that time)• The next day o During daylight, my neighbor and I worked on removing the fencing attached to the treeThe screws were very difficult to remove because the screws were stripped from drilling deeply into the treeo Oak Wilt Specialists came to survey the damage and provided their professional expertise to my neighbor and Io They noted that it would be unknown for quite some time whether the tree would contract oak wilt based on the damage inflicted by Roy’s workerso Oak Wilt Specialists also noted that it was a significant amount of damage caused by the fence workers and that it would take decades for the tree to fully recover (if the tree did not die from oak wilt)o The oak tree that was damaged by Roy’s workers is a mature native live oakIn a previous consultation when I hired a professional licensed arborist, he noted that this tree is a high value treeo In addition to the substantial oak tree damage, Roy’s workers also: 1) left the old removed fence panels in my front yard (the original fence quote showed the quote included “remove and haul off all old fence.” Roy and his workers did not return to do this work)2) left concrete from the fence job on the ground 3) damaged one of the solar landscape lights in my yard o That afternoon, several random people showed up in my front yard (without my prior knowledge) asking about the old fence panels o My neighbor and I asked these individuals how they obtained our addresses and from where? Each of these individuals provided my neighbor and I with their contact information and noted that 1) Roy provided them with the house address, 2) Roy had posted an ad on Craigslist showing that there were free fence panels for people to take and 3) Roy had given these individuals permission to come and take the items in the yard? One of the individuals who showed up was a tree trimmer He saw the damages inflicted by Roy’s workers and noted that it was a significant amount of damageHe provided his contact information and name to my neighbor and I if neededo Per professional advice, I am waiting to see if the oak tree becomes infected by oak wiltEven if the tree does not develop oak wilt, the damage already caused by Roy’s workers to the tree is significant, as noted by the specialists and arborist who have evaluated the tree

I am responding in regard to the complaint # [redacted] I will admit fault in being slow to return to the property to complete the 30" inches of wrought iron fence I was over at his property weeks ago getting measurements for the completion I was never told by the homeowner about broken water lines or missing screws in the fence, which are items that can be repaired and remedied very quickly, and definately do not cost $to fix I spoke with the homeowner last night via text and assured him I could go by his home today to fix the water (sprinkler line) and he refused to have me over, so I am not sure the homeowner really wants me to remedy the situation but rather just attack me with a bad review and also on my social media page those are the facts thanks [redacted] ###-###-####

Long story short, you get what you pay for And sometimes you pay him before he's done and don't get all that you payed for Went with this company because some other neighbors recommended him, and now I wish I used a company that can actually finish what they start Things seemed to be going well at first, and on day when the job was supposed to be complete, he was short a board and unable to finish a section My wife tried to tell him we would pay when he was done, and at that point he got rude and pushy with her and also with me on the phone He said we don't need to withhold payment for one board and threw a fit, said he'd come back the next day and finish the job So I said OK, nobody is trying to withhold payment and we cut him the check in good faith that he would come back the next day and finish the job And we even rounded up a couple of dollars to make it an even amount It was about 3pm on a weekday, not really sure why he couldn't just run down the street to Home Depot and finish the job Well, to my surprise, with advance payment for work not yet complete, he did not come out the next day, nor did he let us know he would be unable to make it A few days later, I texted asking if he was going to come by and finish and he said "Yes I will for sure" Didn't hear from him, or see him, so I reached out again about weeks later and he said he would finish it that week That didn't happen either One week later, again after not hearing from him, I reached out again and said we still needed this to be completed, and now he said he'd get to it this week As the week went on with an incomplete fence, Thursday night I said I would expect to see him tomorrow and would leave the gate unlocked, to which he just said "OK" Called him Friday morning to confirm, and he said they'd be by later that day At about 4:he asked for my address to send his guys over I'll let you guess if they came by An hour or so later, I reached out asking him to let me know when they were on their way He didn't reply An hour after that I called him He rolled me to voicemail, so I called right back and to nobody's surprise, he did not answer In a text he said they "ran into an issue or whatever" and weren't able to come But he would make "darn sure" it got done the next day and he has no reason to hide Needless to say, Saturday (the next day) came and went and nobody came by Called him again that evening, got rolled to voicemail He never got back to me, nor did he respond to a text asking him what "darn sure" meant I decided I've had enough with this guy and ended up finishing the job myself, since he is unable and unwilling to do so When I actually walked the fence, there are several pickets that only had screw in each rail and some where the screws weren't even driven into the boards, they stuck out a little over an inch How can I trust a year warranty when somebody can't even complete the work they were paid to do? Oh, and he'll give away your used fence and give random Craigslist people your address to come pick it up To sum it up, he may be one of the cheaper ones out there, but you definitely get what you pay for Good luck if you use him

on the day in question I offered to go out the following day and fix the water linesi was told noi was not going to go out to someones house if they do not wish for me to be there or give me an opportunity to make it right I was never told by Mr*** of any problems with water lines or trash or missing screws on the fencethe fact remains he never told me of these small issues. we did indeed break lines while in the process of the work because we were working close to sprinkler systems and we fixed those water lines for about $out of pocket on my end, which I gladly fixed. had I been told of broken water lines the issue surely would have been addressed. I am rejecting this response because: I have not heard from Mr*** until I filed this complaint and reached out through social mediaI have the responses where he has reached out since this complaint to fix the water pipes which have been fixed already by another companyHe was not aware of the broken likes because he has never returned my callsHe is aware the lines have been fixed he has not once offered since to finish the job with the fenceFor to pay for the fence to be completed,trash pick up, missing screws and broken water lines adds up to the amount I have requested to complete the initial job I was promised by this business.

We hired Roy B[redacted] in Novermber 2014 to remove an older fence and install a new wood picket fence. B[redacted] tore down my old fence, and put up a new fence but left the sections of the old fence, plus trash and pieces of lumber in my yard. He demanded full payment even though he had not finished and promised to return within a day or two to haul trash and finish. He has never returned, will not answer phone calls or respond in any way,
