I contracted this job with [redacted] to do several different trades in his basement I installed insulation into the ceiling of the basement that was a substandard Insulation a R-19 insulation would have been the appropriate insulation, insulation we used had...

a lot of particles and fibers it was more an insulation for attics this is what was purchased. This is the reason I ended up getting Pneumonia,I took the appropriate precautions when handling insulation but the particles still got into my lungs and I got an infection in my lungs that turned into Pneumonia it took me 2 weeks and 2 Z-packs to remove the puss out of my lungs because of the substandard insulation that I had to use. I was delirious for 2 weeks, I tried to come back to work but still was feeling delirious so yes my hours were cut short, when I spoke with [redacted] I told him what happened and also told him that I was behind schedule because of being down for the two weeks, I was now behind schedule for all of my customers, all of my other customers were very understanding and concerned for my health and had no problem with me being behind schedule, [redacted] gave me an almost impossible schedule to keep because not only did I have to do the insulation he added on extra’s that ate up my time on the original invoice I had to install wiring for 3 base board heaters and lights over the bar and a light in the daughters bedroom, running wires thru walls that are already finished takes a lot of time, plus I had to now run insulation board on the ceilings to hide the noise in the basement, so we now have insulation installed and wires and gas lines that had to be moved or installed and now I had to install insulation/particle board over the entire ceiling, and we also framed up 3 columns that hid the steel beams that support the floor, I have photo’s of all the work that was performed .Vincent’s entire problem is over me splitting my days, like I said I was behind schedule with all of my jobs and when I finally got caught up I was told not to show up that he had someone else coming to finish the job, I pleaded with [redacted] to allow me to finish the work that I started, in most cases the contractor is allowed to finish his work especially when my name is riding on it we live in the same neighborhood, also I did work for [redacted] in the past and he knows how busy I am and he also knew that I have a reputation for always finishing what I start I have lists of customers that will verify and recommend me for any job, if I was a person without integrity I would not have a website, a [redacted] page twitter site/a porch.com site and business license for [redacted] and with the Attorney Generals office, if my goals are to be a crook to my customers, once again I asked to be able to complete my work,and [redacted] refused and considering that we had an agreement for me to do the deck and stairs and Gazebo and when I came back to work [redacted] had already hired another contractor to do the deck and gazebo that we had a verbal agreement on, and in my understanding of things he had put himselfin breech of contract by not talking to me if he could bring other contractors onto my job site if he is unhappy or not, plus all of the furnishings, pictures exercise equipment, pets barking all day all in our way most contractors would have walked right there, but I only wanted to finish what I started so I tried and worked a little longer and at midnight September 14".Sunday evening I got a text for me not to show up, I tried to remedy this with [redacted] on Monday morning but he had already made an agreement with another contractor, not allowing me no remedy, all he wants now is for me to completely pay back all money and pay him for the new contractor to come in and do the work that we had an agreement for me to do, I received a down payment of $1500.00 towards the job, he wants me to absorb that loss and not to pay myself or my subcontractor plus pay his replacement contractor, I asked [redacted] to give me until this Friday of the 19". Of September to complete his job and that we would work 8-10 hours a day to wrap things up and for us to work specifically for him to give him a high quality job a complete basement remodel job for $3000.00 there was no money being made on this an he knew this, normally I would get $7000.00 to do this but I wanted to use his basement for pictures and advertisements and I also explained this to Vincent, this is why I was doing the job so cheap now not only am I taking a loss on pay for this he is also expecting me to pay another crew to come in to finish because he wasn’t satisfied with the hours we were working. I have bills and trust me $1500.00 does not go very far, I would still be ready to finish the basement for [redacted] because that’s me.Sincerely, Bill W

I am rejecting this response because:
This is a response to the response made by Best Price Remodel’me (William W[redacted]). First, I’d like to address W[redacted]’s response relative to the materials that were used. I don’t know if I’d mentioned in my original complaint but W[redacted] did do some work in my basement several months ago. At that time, I did have some of the same issues that I am basing my complaint on this time. Being a good person, I was willing to give him a second chance to make things right, therefore, I hired him a second time to complete the work in my basement.
With that being said, when W[redacted] worked in my basement earlier this year, I purchased the materials that I was going to need in order to finish my basement. In particular, Sound Attenuating Fireproof insulation ([redacted]) and sound proofing fiberboard. When I purchased said items, I had an extensive conversation with W[redacted] relative to how said items were going to be installed and if he would be able to do it. W[redacted] told me that he was familiar with said products and knew of all the precautions that were needed in order to properly handle and install the materials. In particular, we discussed the use of a protective suit ([redacted] type), gloves, air mask, eyeglasses and hat. So, when the project began, W[redacted] had none of these items. Once he began the job and seeing this, I offered him a protective suit that I had purchased from [redacted] as he suggested I do several months ago. In short, W[redacted] knew the materials he was going to be working with and what precautions needed to be taken. If he had any issues he should have addressed them to me. As far as him getting sick as a result of these materials, I really don’t know what to say about that.
When W[redacted] claimed he got sick, he did not call me or send me an e-mail or communicate to me by text that he would not be showing up as a result of his “illness”. He just decided that he was not going to show up for several days without extending me the professional courtesy. In fact, I only found out of his illness when I called him after several days of him not showing up. He explained the situation to me and he told me that he would be back on the job the day after I spoke with him. I allowed several days and the weekend to pass but he, again, did not show up nor did he extend the professional courtesy of telling me that he was still ill or unable to show up.
In regards to cost of the project, W[redacted] came and gave me an estimate on July 15th, 2014. I did not ask for any special discounts or special favors. W[redacted] told me what the cost of project was and we agreed upon some modifications to that cost. The modification made was relative to some materials that I would be obtaining for myself since I could get them at a discounted rate. Whatever his purpose was for agreeing on the cost of the project is really none of my concern. He gave me a price and we both agreed on it. It really does not concern me that he was going to use my project so that he could take pictures and further his business as a result of the work he did in my basement. That was never discussed nor would I agree to something like that. That is asinine! What kind of businessman agrees to do work and not profit from it? If that was the case, I would have gone out of my ways to have friends help with the project instead since most friends are more reliable. Instead, I opted to hire someone I thought was a professional.
As far as my dogs barking in the basement, I would just like to add that they were in their kennels due to the high temperatures at that time of the summer. If the dogs were a problem, he should have said something and I would have considered moving them. Again, I had a discussion about the dogs with W[redacted] and he told me they were not a problem and that he was used to dogs barking at times during other projects.
I would like to now address W[redacted]’s argument about the breach of contract relative to work that was done in my backyard by other contractors. W[redacted] and I (prior to the beginning of this project) had discussed the fact that I would hire him to work on a pergola and stairs from my existing deck to the backyard. I specifically told him that I would have him do that work if, and only if, he completed the work in my basement in a timely manner. Once he began work in the basement, we again spoke about the pergola in particular the fact that I was considering going another route. This was due to the fact that I had found an equally economic option and that the current project was not moving along as we had discussed. After placing numerous phone calls to W[redacted] and determining that he was not committed to finishing the work in the basement in a timely manner, I hired another contractor to finish the work in my backyard. In contrast, these contractors promised to be done in 3 days. They showed up at 7AM as they had promised and they stayed until 4PM to complete the project. They were done with the work as they promised. Overall, the backyard project ended up costing me considerably more than what I had anticipated. I did not mind the cost of that project because there is no better feeling than to have something done right and in a timely manner. That, to me, was the most gratifying thing.
Ultimately, I specifically met with W[redacted] several weeks before the project was going to begin. The purpose of meeting with W[redacted] at the time was to go over how I was expecting the project to work. I specifically outlined numerous things about the project and mainly I wanted to ensure that W[redacted] did not pull the same actions (ie: not showing up as promised, coming and going from the work site as he pleased and, not completing the project in the given time). W[redacted] told me it would only take him several days to finish the project. I specifically asked him when he would be able to start. I then extended the finish date to be 2 weeks versus the several days he said he needed to complete the project. Furthermore, I told him I would be flexible with the finish date (a few days) as long as there was some progress being made. The reason I needed the finish date at the date we agreed was that I had plans for family and friends to come and be entertained at my house. Needless to say, I was able to go on vacation for a week, Labor Day weekend came and went and progress had not been made. The project was nowhere close to being done.I exhausted all my options in order to get W[redacted] to complete this project. How many e-mails does it take to get the point across? How many phone calls does it take? How many text messages? It had become physically and mentally exhausting. It should not be so difficult to get someone to comply with the terms of an agreed upon contract. I don’t want to hear that you have other customers or that you have fallen behind. I was very flexible but how long was I to leave my basement accessible and my home left unsecured for a contractor who was not going to show up nor extend me the professional courtesy to call and keep me informed of what was going on? W[redacted] did not have any urgency in completing this project. His only urgency became apparent when I decided to seek civil remedy. I did not seek civil remedy until I wrote W[redacted] several e-mails about what my intentions were if he did not complete the project. The truth is that I should have known better and not given W[redacted] a second chance. Now my only recourse is to seek civil remedy. I just want the public to be aware that W[redacted] is not trustworthy and should change his business practices. For now, I would let the court decide on this matter. Lastly, I would like to close by saying that money was never an issue with me but at the same time, I don’t want to be taken advantage off and neither does the rest of the public.
I have spoken with numerous contractors in the last several weeks. Not one has told me that they would have worked as W[redacted] did. Meaning that none thought it was a good idea to start a project and not finish it because they were busy doing other projects and trying to catch up on all. I knew this from the beginning but I was willing to be a little flexible. I was flexible until the point that I was forced to break.

Review: On 07/15/14 I entered into a written and verbal contract with William W[redacted] owner of Best Price Remodel'me for construction in my basement. As part of our agreement, W[redacted] was to begin the work on July 29th, 2014 and finish on August 11th, 2014. I made it clear to W[redacted] that I wanted to have the work done at or near this date but I was willing to work with him and be a little flexible with the time frame. As of August 11, 2014 W[redacted] stopped coming to work on the project at all. W[redacted] claimed he had contracted Pneumonia the week of August 11th. The following week (August 18th) W[redacted] again was a no show. I called him on the 21st to get some sort of action on his part. He showed up on August 22nd for approximately 2 hours and left the work site and did not return. On August 26th I, again, called W[redacted] and left a message for him asking him about his intentions on finishing the job. I received a text message from W[redacted] on August 27th at 9:11 AM in which he indicated that he would be at my house in 15 minutes. He did not show up until shortly after 11:00 AM and worked for 1 Hr. and left. W[redacted] returned and worked until 3:45 PM. As a result of his failure to finish this project in a timely manner, only 1/3 of all items detailed in the contract have been completed. W[redacted] was paid $1500 dollars upon signing of the contract and the beginning of the project. The remainder was due at the end of the project.Desired Settlement: I would like the work to be completed by September 5th, 2014.
