First, we have refunded Mr***'s deposit in full as he has requested.Second, Mr *** signed a contract with a cancellation clausMr *** cancelled his contract after we had begun delivery of his fenceWe had made many attempts to obtain building permits as contractedWe were unable to obtain
permits due to the lack of cooperation from the contracted parties (This job was a part of a neighbor project which included the HOA president and board members)We requested multiple times that the HOA submit changes to their CCR's that would allow vinyl fencing to be approved in that neighborhoodDespite multiple requests we never received the necessary information from the HOA which caused significant delays to the start of this projectThese delays resulted in the cancellation of the project by the homeowners. Per our contract we are due remedies for the work we startedSee highlighted portion of attached contract. Mr *** also signed our checklist stating that if permit aren't obtained the project can't startWe were up front in every way with Mr *** upon signing of the contract. We fulfilled our part of the contract 100%
