Dear Mr. [redacted],

The purpose of this letter is to state a complaint regarding refusal to honor my request for a refund of $841.47 in pre-payment of a reservation for lodging at your hotel may 14th through May 16, 2015, which we were forced to cancels based upon a medical emergency.

The factual basis surrounding the refund request is as follows:: On March 17th, 2015 I signed a contract for reservation of a king size bed room for the 5/14-5/16 period reciting a room rate of $239.99 plus tax of $24.00 (A copy of said contract is attached.)

On May 9, 2015 I notified you by telephone that my wife had a surgery set for May 7th rescheduled for May 12, 2015 because of a death in the immediate family of the surgeon. Obliviously it was medically impossible for my wife to travel to our grandson’s graduation for Cal State University Chico, scheduled 5/15/2015.

In our conversation on 5/9 you stated that you would try to re-book the room during the graduation weekend resulting in a full refund of my charges, less $50. Which I said would be reasonable solution of the matter.

By phone at 8:28AM on 5/15 I was informed by your hotel reservation operator that there was only one room in the hotel available- a twin queen size bed room- and that there were no king size bed rooms available.

I consulted your website for room availability on 5/15-5/17 with the result noted, “Hotel not available on selected dates.” And “Best Western heritage Inn-Chico is not available from 15 May 2015 to 17 may 2015” (Copies of these E-mail responses are attached.)

The phone responses from the Hotel Reservations Official together with the web site responses constitutes evidence that our reserved king bed room had been re-let by the Hotel for the graduation weekend.

Denials by the Hotel in the face of this evidence may be evidence of fraud.

During phone conversations, I made it known to the Manager that my wife is 75 years old (born 1939) and I am 83 years old (born 1931). All of the facts and circumstances of this case may constitute evidence of Elder Abuse on the part if Best Western Heritage Inn Management.

Your offer of a credit of $280.49 to settle this claim is an insult and in light of our upfront payment of $841.47. A reasonable reimbursement of $791.41 after deducting the $50. as a cancellation penalty would be agreeable, as provided for in the contract.
