On March 31st, 2014 I met with the barn manager [redacted] who allowed me to tour the barn facility for potentially boarding my horse starting in May 2014. After further discussion, it was agreed upon that I would be back on April 1st, 2014 to sign any paper work along with provide a security deposit for any damages/non payment. On April 1st, I did meet with [redacted] and paid a $200.00 security deposit, signed a waiver form holding the barn liable incase I should get hurt, a barn rules policy, along with a month to month lease agreement to start May 1st, 2014. On this agreement, it shows I paid a $200.00 deposit and I would be responsible for a pro-rate as I had planned on arriving slightly before the 1st of May. Although I do not have a printed copy of any of these documents as they said they would be mailed, I did take photo pictures to have. Due to an unforeseen circumstance preventing me from being able to board at the barn after all, I contacted the facility via email contacting both the Farm Manager/Owner and Barn Manager [redacted] on 4/11/14 letting them know I could not board. I heard nothing back, finally sent [redacted] a text who said she understood and no problem and referred me to [redacted] in regards to my deposit. [redacted] emailed me on 4/14/14 saying he would not refund the deposit stating he turned others away. I emailed him stating no where does it say that my deposit was non refundable and asked him to reach out to me. I have called and left messages for him, however no return calls/email to discuss further. I have had a legal friend look at all the information I have and it is agreed upon that nothing stipulates my deposit would be held if I cancelled. In fact, there is nothing stating what would keep a deposit. I am looking for assistance in getting my deposit back.Desired SettlementWould appreciate my deposit to be refunded versus me looking into taking further legal action.More info received from the consumer 2014-05-01The owner [redacted] and I met this evening in regards to the holding of our deposit. We agreed to split the difference and he has refunded me via check. I appreciate your help in this matter and informed Mr. [redacted] I would reach out to the Revdex.com and let them know that the matter has been resolved to a satisfactory resolution between the both of us.
