Review: We signed a contract with this company in June when we were guaranteed to have our deck built and finished by the end of July, by the salesman. In the middle of July I contacted the owner, stating how I was upset that they had not started and told them I was going on two vacations and didn't want workers here while I was away. I was told by the owner, [redacted], that he would contact me and would get things started right away, stating we should never have been told end of July. I was never contacted again by [redacted] and we came back from our first vacation to our old deck being torn down and new one being started. After many discussions and arguments with the owner, who I had to contact many times, and who was very rude to me on the phone, our deck was finally finished in the middle of September. Parts of the deck that we were told were included in our price, was then stated that it was no longer included. Finally, we had to have the owner come to our house, after getting in an argument with the workers who demanded money that day, to work on the final price because we were not happy. He told us that day, he would be back out the following week to clean up the metal shards they left on our deck since we have a baby who is crawling and they left it a mess, and to replace pieces that were defective. They were also to replace pieces of our deck furniture that they broke while here. The appointment was scheduled for a Tuesday. Tuesday came and went and we have not seen or heard from anyone explaining why they did not show up. The workers were told specific times to show up for our appointments because my husband and I work from home. The day they finished the deck, they were to show up before 8:30 because I couldn't answer the door after this time. They finally showed up at 9:45 and did not have an excuse or reason as to why they were late. We were very dissatisfied with the lack of communication and customer service from this company, along with being lied to by the salesman in the first place.Desired Settlement: We want the pieces that we were told would be fixed to be fixed and replaced. This includes our deck furniture and pieces of the glass railings. We also want our deck to be cleaned off as promised.

Response:

We signed contract with Mr. & Mrs. [redacted] on 6/20/14, and within the contract it states clearly that the project would begin 6-8 weeks after contract signing, and take 7-12 days to complete. The contract also did not include Betterliving tearing out the customer’s existing deck. When we contacted the customer that we were going to be ready to start their project, [redacted] had stated he had not torn out the existing deck yet, and we agreed to tear out for him at no additional charge. [redacted] had made us aware he was going to be on vacation, and it was okay to work at their house. Our installer, [redacted], had also informed customer that he would be in vacation the week of August 9-16. He would be back to finish project when he returned. [redacted] returned to complete project upon return from vacation. The glass railing system they order for their deck is a custom design and we put up all the railings and informed them that we had ordered the custom made pieces of glass, and would return to install once glass manufacturer had finished. We received call on 8/29/14 that they were having party and needed to have deck finished today. We sent out a crew to custom design temporary wood railings for their deck and also put up fascia all around their deck at no charge, so they could use their new deck for their party. We contacted when glass railing was finished and went out and install. They used a leaf blower to clean off the deck, after installation. Upon trying to collect final payment, customer refused and wanted to talk to owner of company. [redacted] went to customers house went over a final walk through, and customer still refused to pay balance. While [redacted] was doing final walk through with customer they had a painter there painting the outside door of deck. Mr. [redacted] informed [redacted] that the painter was going to clean deck because he got paint on some decking planks. In an effort to work with customer we concurred with customer to accept only half the final balance due on their account. The [redacted]’s were to call and follow up with us when painter was done, and we never received that call. To summarize Betterliving did a free tear out of old decking, installed free fascia around whole deck, sent crew out to make custom temporary railings and install at no charge to customer, and we also took money off final payment. We are sorry after all our efforts that this customer is still dissatisfied with our company, and are willing to work with them about the issues they have listed on their complaint if they’d like to contact us to schedule

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Unfortunately information that they have given is untrue. Even though the contract does state the time frame, we were promised by the salesman it would be done by the date we mentioned, which was the only reason we signed the contract in the first place. Secondly, we were never contacted by the company of when they would be starting the job. They knew they had to contact us prior to starting so that we could remove the existing platform and steps first. It was not an existing deck. The crew showed up at our home unannounced. There was no contact discussing dates between the company and us prior to them showing up. The crew told us that since we had not been contacted about when they would be starting and we were caught off guard, they would go ahead and remove the structure for us, since it was their error. Third, they did not put up all of the railings when the crew returned from vacation. Only about 2/3 of the railing was put up and the rest was caution taped off. We were then told at this date that the glass would be in in 7-10 days, which was in plenty of time for our Labor Day party. After contacting the company several times to try to get an update on when the glass would arrive, which was well after the promised 7-10 days, they let us know that they were on backorder and they did not know when they would be getting the glass in. We discussed the fact that we had planned on having the deck finished and had a party coming up on the following Monday. We discussed this on Friday. They did send out a crew on Friday to make it "safe" to have people on, since the railings weren't even finished. It was not the same day as the party. When the crew came out, a leaf blower was never used to clean off the deck. There were metal shards everywhere. We did have the owner [redacted] come back for a final walk through and discussed what we were still unhappy with and to work on the final price. [redacted] had spoken to us way before the crew came and said he would work on the final price with us. The crew that put the glass in demanded full price and we let them know that [redacted] had promised to come to our house to discuss and we would not pay until we had our meeting. When [redacted] came to meet us, the following day, there was no painter at our house while [redacted] was here. I can get the exact date from [redacted] on when the painter was here to prove he was not present while [redacted] was. The painter had come in the previous days and we mentioned to [redacted] that we would have the painter clean up the paint spill, we NEVER told him we would call when he finished. [redacted] told us he would be at our house the next Tuesday to fix the glass and clean off our deck. They never called or showed up. Lastly, they did not include "free fascia." We were told by the salesman that the fascia was included in our price and then halfway through installation, they told us it was no longer included. We demanded that we receive the fascia since we were told it was included. It was not a free upgrade from the company. The only reason they sent a crew out to our house to make it safe for our party was because I threatened to sue them over the amount of time it was taking them to finish. As they state in their response, it was to take 7-12 days, per the contract, to complete and it took them over a month to complete! As a company, they have not done their part to ensure customer satisfaction.
