1/11/1:59pm Mediator called CONS "He stopped communicating with me, he's not a expert and neither am I, I just don't understand why I have to seek out professionals to assess the issues (crawl space, engineer, etc), he basically researched things on the internet, wouldn't any reputable contractor address this issue himself by getting expert opinions? I had to put a dehumidifier in the crawl spaceBewley isn't an expert but he cut the concrete posts himself when working on the crawl space/foundation."1/11/3:29pm CONS send Mediator an email with pictures and message:"I am gathering data to send to you and will send shortly regarding professional opinions on both crawl space remediation and high humidity level readings I will also send engineer opinion when I receive it Regardless the house is not correct and a quality builder would want to build a quality home The time spent denying could’ve spent correcting the problem That’s all I want I also had a conversation with a previous home owner [redacted] who had similar issues getting resolution as well I believe there are several legal issues with him as well.I wanted to send you a few pictures to see what I am dealing with and why this could affect the value of my home Bewley has an obligation to fix this as it was reported before the year contracted build warranty and has not Bandaids and lip service will not satisfy.The following cracks are an example lots more! They are found on of the four corners of the Home My last home of years had how do you explain this?"2/CONS sent Mediator email:Hello,I’ve been waiting on this engineer report to come back.Unfortunately they are telling me it’s inconclusive without further involved testing and that’s going to cost me more money.At this point I would just like Bewley to fix the issues that he agreed to and some consideration to fix the unsafe humid/ water levels under the house[redacted] has stopped talking with us and is holding us hostage for any repairs until we sign some new document he’s created We only want what the original contracts stated and paid for without any new one sided agreement he's forcing us to sign.Can you help us move forward with repairs before things get worse? I was informed about a couple of cracks on the bay area and I called my mason and was told this was normalI also called the brick supply company and was told I needed to due a control joint and I informed the homeowner and for months I was told I had to pay for a structural engineerHowever, the cracks have nothing to do with the home's structureApplying mortar will correct itI have returned to your home times for repairs

the cracks have nothing to do with the home's structure. Applying mortar will correct it. I have returned to your home 8 times for repairs.

1/11/18 10:05am BUS called Mediator. "I've consulted with experts - other home builders, my mason, my brick supplier, his regional manager. The cracks are normal and they all support my plan for the crack(s). We are happy and willing to fully address this issue for the customer. In our estimation, the only way to fix this issue is to use a control joint to control the cracking and then tuckpoint the already existing cracks. Just tuckpointing the brick is putting a band-aid on the situation and removing the brick to "fix the foundation" and then putting it back on is unnecessary and will not stop the brick from cracking. Brick face is cosmetic, it is not structural. City and county inspectors only inspect structural and safety issues - not cosmetic ones. He wanted me to call out a structural engineer but he doesn't need a structural engineer, he needs to consult a mason. I have done hours of research, consulted with experts, I will not pay for a structural engineer to visit this person's home so he can educate the customer. But any reputable expert will give him the same information I gave him." 2/6/18 2:33pm Mediator called BUS. "We did not schedule for a mason. We did schedule a mason but that was contingent upon CONS signing a document I wrote up myself. The document explains what we were going to do, how we're going to address the brick issues, he said he wasn't going to sign the document because he doesn't want us address them with a control joint. I'm going to write up a detailed document with the timeline of when he contacted us, what we've done, what the [redacted] standards are, etc."
