Hello Ms*** ,As per our conversation on 12-05-I am responding to the complaint you received from *** *** on 11-03-2017. This is the first time that I heard of this complaint I was not aware that Ms*** had made a complaint with Revdex.com. Yesterday, was the first
time that I was made aware of this complaint by you (Ms***). Ms*** was living at Bexar Creek Apartments as an occupant in apartment number 304, on March 1, she was added onto a new lease renewal that started on March 1st as a roommate with daughter as occupants, Ms*** *** had been here for about two years now. She had informed me that she was changing roommates due to her present roommate was moving out of state, she did not want to break her lease nor move, she explained that she needed help paying her rent , I reminded Ms*** that she needed to make sure that any new roommates would have to fill out a complete application , be verified to be accepted as a prospect for move in . After completing the application and verifications were completed Ms*** was accepted and approved to move in as an occupant (roommate). They both came in together to sign the new lease renewal Starting on March 1st 2017, they were both given a copy of the lease for their recordThey both read and understood the conditions of the lease. After a couple of months into the new lease I did notice a lot more activity then usual coming for that apartment I mentioned this to Ms*** she told that her roommate had a brother that was in town this is why there was people coming and going with my onsite courtesy patrol had recorded on his daily report. I reminded them that as per the lease only the persons on the lease are allow to live there. Anyone not listed on the lease cannot stay in the apartment for more than consecutive daysThis was corrected after I spoke to Ms*** . I’m required to do monthly unit inspection, a few unit inspections fail due to Housekeeping issues, unauthorized Pets, urine odor, Pet feces thru out the apartment , extreme damages to the carpet with stains, broken blinds, broken bedroom doors, etcthis was not happening until Ms*** move into the unauthorized cats were causing lots of damages. I received a phone call from Ms*** first part of October to inform me that Ms*** had moved out from the apartment that they were both living in and sharing the rent. She stated that she needed to ask if she could remain in the apartment after Ms*** had already move out and she also stated that *** had made her ware of the move, but needed to know if could bring in another roommate. I explained to her that they both needed to come into my office to talk about removing Ms *** from the lease if that was her intetions to move out and to release herself from the lease and any further obligationsMs*** was also told they both needed to address the issues with failed unit inspections and the unauthorized cats. That was on a Friday because the following Monday they were both supposed to come into my office to discuss the move and the current lease. Over the weekend I received several calls for tenants in the area of their apartment to include my onsite courtesy Patrol that Ms*** was outside yelling and screaming, cussing and cursing, that Ms*** mom had lock her out of the apartment and had stolen her car keys, she was also according to the courtesy patrol mentioning my name and cursing out of control , causing a huge scene outside in the complex, she called the police and reported the Ms*** mom had lock her out of the unit and had stolen her car keys. On Monday I contacted Ms*** and *** to find out if they were both coming into my to discuss the incident over the weekend, the lease and the move. Ms*** got very upset and aggressive on the phone because ask her about the incident on Saturday, she was upset and starting saying that Ms*** and her boyfriend were unfit parents to their unborn child and that Ms*** boyfriend had illegal substances in the apartment, that he sold illegal substances, she was going to call CPS on themI told her was not aware of that type of activity and if the was going she should said something about it a long time ago and reported to me and the proper authorities. I also told since neither one of them was coming into my office to speak to me I was going to give her or them a few days to get all the issues on the failed inspections corrected if not I was not going to continue to allow them to live there thru out the remaining months on the lease, but they were still responsible for the contract if they choose to move out prior to the end of the contract which end on 02-28-Every lease violation or notice was always addressed to Ms*** and all other occupants which included her. Ms*** decided to move out on her own she they both did without fulfilling the lease contractAnd abandoned the unit with lots of damages left behind, pest control issue (flea infestation). On 11-06-a notice was posted on their door( inside) for non-payment of and on 11-13-a notice of abandonment was posted on the inside of their door on responses from them, no keys were turned in all the furniture is gone and the apartment is trashed. The electric is still on under Ms*** or someone related to her which is subject to be turned off according to City Public service. No one was evicted and to my knowledge No one has called or inquired about Ms *** rental history at Bexar CreekAll landlord verification are done in writing never over the phone. If they were evicted there should be documentation of such evictionI can provide photos of the condition the apartment was left in. Ms*** or Ms*** are not related to me. I honestly believe this is another roommate situation gone wrong. I am rejecting this response because:
Hello Ms. [redacted],
I am writing regarding the response sent in by Bexar Creek Apartments. I will be responding in the order of which the statement was written.
I had been given permission to live at Bexar Creek Apartments since January 2017, due to a falling out with a previous roommate, (whom was also a close friend of mine and [redacted]’s). [redacted] stated that [redacted] was made aware of this, due to [redacted] not able to supply the rent on her own. Our plans were made known by the end of November 2016; after [redacted] hosted a Thanksgiving get together. At this point of my visit, she already had the stains on the carpet, there was a crack on the ceiling, and a broken door in her bedroom. When I inquired about it after using her personal bathroom, she mentioned that her boyfriend that was living with her, but was not on the lease, had punched it in during the year 2016, due to her infidelity issue with him. There was also a cat on premises that was put away when the rest of the guests showed up to the house, (her family that lived on the complex was also aware of this pet).
She mentioned that the current roommate would be leaving, and she would be struggling financially due to the amount of the rent. To not break her lease, I asked if she would need help and that my own lease was ending at my previous apartment. She noted that the apartment was not in good shape at all, but that she would start to work on fixing it if I decided to move in. I agreed to go through the process and figured that maybe the previous problems had to do with the previous roommate alone.
I had already mentioned to [redacted] that I am very family oriented and would like to have my brothers, and cousins over, considering that my grandfather had recently passed away and they would no longer have someone to help since they were disabled. She was made aware of the vehicles that would be coming around the apartment and the people. There was never any misconduct during these visits, except once when a brother of mine rode his bicycle to the front, rather than walking it as the rules stated.
My brothers would visit often, since they came back from college and were working downtown, so a carpool meet was initiated. They would park at my family’s house or mine, and we would proceed to leave the premises until visiting hours were over. There were a few times they would be visiting late and we would play games or watch movies together, and they wouldn’t leave until 1 or 2am, but their vehicles would be in the designated visiting areas. Even though I made the manager aware of these visits, she still proceeded to remind me that they cannot spend the night, which they didn’t, but [redacted]’s boyfriend was allowed to consecutively stay without any issues nor towing at all. [redacted]’s boyfriend would consecutively park their car in the visitor spots without any issue, and it was documented daily; but she was not warned of the 3-day stay rule. At one point, my car was towed even though I was on the lease; but had to work during the hours that the parking passes were distributed. After laughing it off, since I had the money to easily pay the tow, this seemed to upset [redacted] by her not able to have an “upper hand” to my situation or stay.
[redacted] had randomly initiated an apartment check without my knowing. No one on the lease was there at the time of the appointment, except my boyfriend, with whom I work with and asked to retrieve important paperwork and materials for my shift that day. Upon [redacted] entry, she had asked as to why he had been given my personal keys and who he was, after she had previously been made aware of who he was. Her initial question was if he was supplying any income to me, which he wasn’t since he had his own household and bills to pay. This was also documented at a notary office with our separate leases and pay stubs.
After she was upset and noted the damage I mentioned that was done prior to my initial move in, she proceeded to blame the damage on me. She had not done an apartment check in almost 2 years due to her very close and personal relationship with [redacted], which [redacted] stated and joked about not being equal with other tenants on the property. Even after the neighbors had complained to [redacted] about the smell of smoke in the apartment, [redacted] threatened the neighbors with retaliation if they proceeded to call the cops on [redacted]. After viewing this conversation between [redacted] and [redacted] in the office, I was intimidated to report anything to both [redacted] and the authorities. I was also forced to take the fall for said damages. She stated that this was due to her not seeing the damage before my stay, (because she never initiated a check before), that it would be my issue to deal with.
[redacted] also mentioned unauthorized cats on the property, which I was caring for a day while my mother’s apartment was receiving maintenance and pets could not be on her premises. After meeting with [redacted] about the animals, I mentioned that I would be more than willing to pay the $400 pet deposit, but since these were not my pets, I would not be able to provide the correct information to own a pet on the property. She ended up dismissing my offer for said money at the time. These damages were previously made by the animal [redacted] had, during November 2016. I do not know what happened to this pet either.
As of October 2017, [redacted] informed me that she was gifted a house and would no longer need the apartment. She decided that her mother would continue the lease with me until February 2018. I had not spent much time with her mother, even when she came to stay for a few weeks after getting out of rehab for hard narcotics during the summer. [redacted] was made aware of the stay from [redacted], and never made a comment about the 3 day stay rule, considering this would be her best friend of many years staying on the premises.
On the second week of October, the mother begins to stay and [redacted] leaves, as I am afraid to leave and break the lease, and of the mother whom has had a tendency of falling back into drugs. From a conversation I overheard, she would not want to put her own name on the lease due to her own criminal background and the fact that she has many warrants under her name. My issue was if my belongings would start to go missing and if the mother’s boyfriend had any criminal background, since they had only been together for one month.
I had called [redacted] after [redacted] made this decision, to see if I could prevent the mother from staying and if I could have someone else apply on the lease to help me pay rent until the lease was finished. [redacted] replied that I was not allowed to stay on the property due to [redacted] being the “Lease Holder”, and that I would need [redacted]’s permission to finish the lease. Without her permission, I would have to break the lease with [redacted]’s leave. [redacted]’s ultimatum was to let her mother stay or she wouldn’t let me finish the lease.
That month, for multiple times I had been deadbolted out of the apartment, to the point where even my daughter had an accident on herself due to the inability to get in. I had decided to start leaving the window open to climb in through. When the patrol noticed this, and questioned if I lived there, I became upset with [redacted]’s mother and asked as to why am I getting locked out. She said she and her daughter pay the rent there, so she can lock the door if she feels up to it. She then stated that she will start locking all the windows as well.
I became upset with [redacted]’s mother’s statements, and decided to call the cops on her. She became upset and said that she will get [redacted] to kick me out because of this. She also was heard by the authorities on the phone that I was not allowed to give out her name, but the authorities urged me to do so since they had her on file for many warrants. I also mentioned on the phone that the manager WILL retaliate against me; they said my decision was between her retaliation or myself in trouble for not making the report.
While I was on the phone and putting my daughter in her room upstairs, [redacted]’s mother proceeded to steal my car keys and took off with them. The authorities showed up and I didn’t have a clue as to where she could have gone. They mentioned that I should call if she decides to come back.
I decided to go to my family’s house to calm down, but when I search for my keys, which I left by the window I climbed through, in the kitchen. They were nowhere to be found; I decided to look everywhere in the apartment, even in the room the mother was staying in. After searching the entire apartment, and even looking through things when I moved, it was easy to state that [redacted]’s mother stole my keys.
I proceeded to call AAA to open my car and double check to see if they were left behind, which they couldn’t be because I used them to attempt opening the front door that was deadbolted. AAA came out and popped open my door, but because the alarm was going off without the key recognition, courtesy patrol came over to see why I would be breaking into my car, which was my personal car with the Bexar Creek parking sticker. I became upset since he had already seen me “breaking into my own house”. I raised my voice, but did not behave in a “belligerent” manner. I stated that if “[redacted] didn’t let her best friend stay here, I would still have my car keys”, and “everyone at the complex is afraid of [redacted], so they work for her interests alone, and harass those that [redacted] doesn’t take a liking to”. I was seldom to using cuss words, because even though I was upset, I did not want to receive a charge for disturbance of the peace, since I am a federal employee as well. The people who back up [redacted] false claim are family members of [redacted], and close friends to [redacted]. Another tenant that backed up the false claim is an office helper of [redacted]’s, and a domestic abuser that [redacted] and the other tenants are publicly aware of, but did not report to the cops due to favoritism.
Come Monday, [redacted] calls about the statements that the courtesy patrol reported to her, and replied that [redacted]’s mother is able to stay since the rent was paid, but that I could not stay due to not having permission from [redacted] to stay and complete the lease. She mentioned that I will have to move out at the end of October because [redacted] didn’t want me on the property. I became upset, and had a sharp tone, but was not aggressive due to not wanting the police to intervene. She made this false claim to protect her best friend and place every issue of the lease problem on myself.
I proceeded to mention that I didn’t want to be associated with [redacted] and her live-in boyfriend, because if Child Protective Services visits their baby, I did not want to be caught up with their neglect of the child, and the substances [redacted] and the boyfriend would partake in. Although [redacted] was familiar with the smoking, she questioned as to why I didn’t tell her [redacted] would partake on selling as well. I mentioned that if she knew about the smoking and complaints from neighbors, why didn’t she ask it to stop or do an apartment check sooner? I also mentioned that I was afraid of retaliation, to which she said that it doesn’t matter now, since I am not allowed to finish the lease anyway.
[redacted] also mentioned that because [redacted] moved out and I do not have sufficient income to pay rent alone, that I will also have to leave as well. She said the lease would be broken as of Oct 2017.
At this time, she is claiming that I abandoned the property, which I did not want to leave, but was threatened with eviction. The issues of damages which were done in [redacted]’s room are blamed on myself as well. The carpet had a spot that I had been working on removing the stain since I moved in, although [redacted] stated she would help get the carpet clean prior to my lease term, she didn’t. [redacted], her mother, and previous roommates did not turn in their keys, but yet I am the only one listed as not turning in keys. The CPS bill was in [redacted]’s mother’s name for years, but is now listed under my boyfriend’s name who not only did NOT live there, but was also not on the lease. [redacted] and her boyfriend stole social security information and ID from my boyfriend’s wallet while the wallet was downstairs, and he and I were upstairs watching movies in my room.
I am also blamed for the pest issue, which was an apartment grass issue that [redacted]’s boyfriend pointed out. Every time someone walked through the grass to get to their car, the fleas would be attached to both legs and feet. They were seen being tracked into both cars and the apartment. [redacted] stated she wrote a complaint for pest control. [redacted]’s boyfriend had a temporary solution of leave bowls of soap on the floors and by the doors to catch the fleas that would hop off the legs upon entry of the apartment.
During early November, I turned in my application to a realtor company to rent at another property. During the application process, they contacted Bexar Creek Apartments, and were given a bad review of my stay. [redacted] falsely claimed that I was the person in hands with the illegal substances, and that I had been both using and selling. This claim is entirely false since I do have to pass regular drug tests at my workplace, and cannot have any scents lingering on me. She also denied that other neighbors had complained of the smoke prior to my stay; which she silenced through threats of retaliation.
She continues to claim that [redacted] keeps choosing bad roommates for the apartment, when really each roommate removed themselves due to fear of the landlord and the fact that [redacted] is the only person in said office that makes such actions or decisions. Her husband is the maintenance man as well. Their domain is this property, and with such bias views, plus the support of the family friends as tenants; (which [redacted] mentioned that they were all allowed to skip in front of the 2-year waiting list to move in).
I am not asking for anything other than a neutral review and for the broken lease to go under the lease holder’s name, which would be [redacted], since both [redacted]’s mother, and [redacted] did not want me to resume my stay at the property and complete the lease. As a last note, since saving money from my previous apartment complex, I did have the funds to pay the rest of the rent and the fee for the broken lease term. Neither were deemed acceptable to [redacted]; it’s as if she wanted this broken lease to follow me.
