Mary [redacted] was given ample time to make her appointment for her manicure.  She purchased it a year prior and was given six months to use it.  Beyond Beauty scheduled a month to a month in 1/2 in advance consistently.  A fact she states in her complaint.  "When trying to make an...

appointment, I was always told it would be more than a month out"  Which would mean based on this information, if she contacted us three weeks into January, it would be impossible to get a Feb. 1st appointment.  Her appointment was in fact scheduled for March 1.  At which time she would have been able to use her groupon for the $22 towards her nail service.  We are under contract with Groupon, and we do not have the authority to refund her $22.  Groupon would be who she would need to contact for that refund.  However, I have contacted them suggesting that they DO NOT refund this guest.    I have also spoken with Oak Lawn police department, and her statement regarding our "extra" services is false.  Please contact any detective at [redacted] for proof that this client is lying.  I also spoke with the one person who was next to us in the 4 years of business, and she stated this client was also lying.  She left because the landlord refused to fix their bathroom properly.  In four years we have called the police twice.  Once, because my wedding rings were stolen by a staff member, and once because we had a man in the office that acted inappropriately.    I would also note that the statistics on our male to female clients is 1 male for every 96 females.  Also, the day that you came into our spa, both technicians were seeing a client, which is why their was nobody available to see you.  The fact is, we are a small place, and have two technicians, and just because you didn't see anyone in the waiting room doesn't mean that they were not busy.   On a personal note, Mary, your lies and insinuation that we provide services that are not within our scope of licensing is not only hurtful, but disgusting.  I would also like you to be aware that you can be prosecuted for slander of myself and business and defamation of character.  My suggestion to you at this point would be to discontinue your lies, and face the fact that YOU made an error.  I have spent over 70,000 dollars in education, have a husband, and two children, and even the insinuation of performing such acts really aggravates me.   Please note I have no intention on aiding this customer in their efforts to recover any of their funds.   Had she been truthful or spoken with me directly; I may have been inclined to help her.  However, at this point all she has done is defame my character and business with her lies.   Please note I have also spoken with my attorney.   Jennifer [redacted]

To Whom It [redacted] Concern:
We received your letter regarding [redacted], and regret to inform you that we are unable...

to honor her request. What Ms. [redacted] neglected to mention in her letter, was that she purchased a Groupon for services for our office. We never took her $21.00, Groupon did. Therefore, if she is seeking a refund, she needs to contact them.
Ms. [redacted] had six months to use this Groupon, and made an appointment for the last day the Groupon was valid. She had an appointment scheduled for 30 min. and arrived, as she claims, 16 min. late. We were unable to see her as our technicians are booked back to back for appointments. This would have caused the technician to be late for all of her guests moving forward. We are unwilling to inconvenience other guest's based on her tardiness. We are also unwilling to compromise her services.
Ms. [redacted] is correct that this has happened to other guests when they haven't updated their GPS. We have contacted Google in regards to this issue, but unless you update your GPS, it will take you to a different address.
While Ms. [redacted] was in the office, Saleena offered to reschedule her appointment, and she declined to do so. As the owner, I offered for her to schedule an appointment, following Groupon's rules, for the service dollar amount; however, this was unacceptable to her.
My suggestion to Ms. [redacted] is to contact Groupon for a refund of her $21. In my experience with Groupon, they generally will not refund the money due to the fact that it's expired, but maybe they will make an exception. I would also like Ms. [redacted] to know that if they do not refund her $21, she is still more than welcome to use that dollar amount for services in our office.
Initial Consumer Rebuttal /* (3000, 10, 2014/09/03) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I do not accept the response from Beyond Beauty Salon and Spa and Ms. Ferrentino as the information that was provided is factually incorrect and continues to demonstrate poor business practice. Yes the amount was purchased from Groupon but the owner failed to mention that Groupon pays them that exact amount and the purpose of Groupon is to help the business attract new customers. According to Groupon the business receives the payment from customer in thirds: 33% after 7-10 days, 33% after the first month, and 34% after the second month.
Furthermore I did not wait until the very last minute to schedule the appointment as cited in Ms. [redacted] response. I made several attempts to schedule appointments throughout the year and the salon was always booked. My last attempt to schedule occurred almost 3 weeks before my groupon expired and I was able to be allotted the August 9th slot. On August 9th I was refused services that Beyond Beauty Salon had already been paid for. Perhaps they are also discriminating against Groupon customers as the business has already received the money for service from Groupon.
The main issue why I request money back or some form of retribution is for the fact that this business's apparent tardiness policy is not posted anywhere on their site nor was the customer informed of this policy prior to scheduling. You cannot refuse a service to a customer because of a policy that legally does not exist. This is poor business practice and reflects bad customer service. The owner seems to abide by groupon rules but does not indicate her "rules" to customers so that they are aware of them. This qualifies as dishonest since you cannot make up rules and apply them without customer's awareness. Finally the owner was accusatory and harassing by using threatening words such as "slander" when I emailed her to notify her of my complaint with the Revdex.com.
Final Business Response /* (4000, 14, 2014/09/22) */
As indicated in Ms. [redacted] initial letter, she was told she had to book weeks in advance, and she neglected to do so. She ended up scheduling on her last valid day for her Groupon. She was 16 min. late for a 30 min appointment. We are unable to perform a 30 min service in 14 min. Again, Ms. [redacted] is confused with how Groupon works. Groupon does NOT give us the full $21.00. They actually give us $10.50. They keep 10.50 as an advertising fee. They also do not finish paying us until the Groupons have expired, 6 months later. Nevertheless, Grouopn would be who she would contact for a refund, based on our contract with Groupon. We are contractually unable to refund any money to any guest. That is Groupon's responsiblity. However, after speaking with them, Ms. [redacted] is not eligible for a refund as her Groupon, which was valid for 6 months, is now expired. Ms. [redacted] should avoid statements regarding discrimination, unless she is able to prove such an allegation. Upon making an appointment, our guests are informed to come in prior to their appointment to fill out paperwork, and they are also informed that they are only scheduled for the amount of time the service takes, and the girls are scheduled back to back. Common sense should indicate that if you are late for your appointment, we will be unable to assist you. I understand that Ms. [redacted] is aggravated, and wants retribution, but she really needs to take responsibility for her actions in this matter. We are unable, and unwilling, to assist her in this matter, as we find it to be no fault of our own.

(The consumer indicated he/she DID NOT accept the response from the business.)
There is no way possible that I can get proof of the initial date of purchase for the fact my brother moved out of state. Also the fact that they put the expiration date a year from the date of purchase and since the expiration date is 12/21/2014 then the purchase date was 12/21/2013. That is when he gave it to me as a gift for Christmas. It is a shame that I have to go through this much turmoil to use my gift. I want my money refunded or services rendered without having to get proof. The only proof I have is the 65.00 gift certificate staring me in the face.
