Review: On July **, 2013, I paid to park my car in the BG CROSSING, INC. parking lot (License# [redacted]) located at [redacted] at 9:00am. When I went to pickup my car at 5:00pm I noticed the car had been hit on the front bumper. There is damage to the paint and the bumper is scratched and will need to be repainted. I brought this issue to the lot attendant and he suddenly forgot how to speak English. He did say to speak to the person who parked my car in the morning, that the morning parking attendant spoke English. I returned the next day and spoke with that person and he denied damaging my car. I asked for the lot manager and he provided my with a telephone number for a [redacted] who reportedly manages the lot. I called and left multiple messages; however [redacted] never returned my calls. I found the company that owns the Lot, which is Mastermind Ltd. I called the company and spoke with someone named [redacted] and she said that they owned the lot but someone else managed it. [redacted] gave me the same number which the parking attendant gave me. I called it again and left another message, yet nobody returned my call. I called back Mastermind Lts. regarding this issue and they are also not returning my calls. It has been over a week and I am unable to put in a claim with the company to resolve the damage to my car. This type of runaround is unacceptable and not the way to run a business. If the parking lot insists on having attendants park vehicles then they must be held responsible for any damage to those vehicles. There should always be a manager available who speaks English.Desired Settlement: I would like to resolve this issue by having a professional body shop prepare an estimate for the damages and have BG CROSSING, INC. and/or Mastermind Ltd. pay for same.

As per-parking lot attendant #** ([redacted]), he received [redacted]'s car on July **, 2013 at BG Crossing, Inc ([redacted]) with a minor scratch on the front bumper. As per company policy, [redacted] must inform supervisor of any damages on the car when accepting/receiving the car. [redacted] informed his supervisor [redacted] (Parking lot attendant #*). [redacted] spoke with [redacted] regarding his car and explained to him that the car was received with the minor scratch on the bumper, therefore it is not the responsibility of the parking lot attendant or the company

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

This is In response to [redacted]'s account of the incident. [redacted] did not inspect my vehicle in my presence and inform me that he would be documenting any perceived damage and reporting back to his supervisor. I inspect my vehicle prior to and following each time I use the parking lot. There was no damage to the front bumper of my vehicle when I handed the keys over to [redacted]. However; when I received the vehicle from the lot attendant at the end of the day, I observed the scratches to the front bumper. I attempted to speak to the attendant regarding the damage, however there appeared to be a language barrier and he was unable to help me in any way. I attempted to contact the lot owner and, after reaching out to Mastermind, I found they were unwilling to work with me in order to resolve this issue.

In respond to the unresolved claim #[redacted] BJ Crossing, Inc parking lot; does not offer bailment services. Language of such is explicit at the place of business. Customers willingly leave their vehicles with a parking attendant for private parking services only. Customer’s are fully aware of the risk associated with doing so, and accepts liability in the event of theft, damages to the vehicle while left on the business premises. The choice of parking a vehicle at BJ Crossing, Inc is willingly indemnification of the establishment of any liability.

Additionally parking lot attendants are to report any visible damages of a vehicle when receiving them into the parking lot. As per parking lot attendant #** ([redacted], he received [redacted]’s car on July **, 2013 at BJ Crossing, Inc ([redacted]) with a minor scratch on the front bumper. As per company policy, attendants are to inform supervisors regarding any damages on any car when accepting/receiving the vehicle.

[redacted] denies that he handed his vehicle with damages and claims that damages occurred at the establishment such claims are false. [redacted] did inform his supervisor immediately and [redacted] did inform [redacted], regarding his vehicle and explain to him that unfortunately BG Crossing, Inc can’t offer nothing to [redacted] as his claim is baseless and the accusations are false.
