system. We take issues like this reported issue seriously and attempt to work with our clients to resolve them within the scope of our terms and conditions for our business. After this person reported the problem to us, we surveyed our own product and did not identify any product that matched the complaint of this client. For this line of designer jeans, this was the only complaint in our customer support records. The complaint was reported the second week of March and the transactions took place January 6 and January 9, 2016. This individual was very aggressive in their email making demands that something had to be done immediately. We told this individual that we needed to do our internal investigation, so we can assess the situation with factual information. In order to be transparent and clear, all on location participants in our auctions sign and date our terms and conditions. This person did sign our terms and the original documents are on file. Furthermore, the terms and conditions are announced during the auction and this client was present during the auction. Participants are offered two extensive opportunities for public inspection of the product. This person lives in the area and could easily spend hours reviewing the product for any concerns. The terms and conditions are available on our website. At no time, did we alter these terms and conditions before, during or after the auction event. A signed versions of the terms are stored in our files with original signatures. An excerpt from our terms is listed below and this client agreed to those terms with a signature. "All property is sold "AS IS, WHERE IS", and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Fusion Surplus Solutions, Inc. may attempt to describe the merchandise in advertising, on the Internet and at the auction, but makes no representations. In no event shall Fusion Surplus Solutions, Inc. be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value."Bidders are also informed in the terms that any problems must be resolved on the day of the auction and before they take their product. Our auctioneer announces this information before the start of the auction and we make copies of the terms available to all clients that ask for them.In addition to our investigation, we went back to our supplier and confirmed the source of the product. All of the product we receive is original Rock and Republic product. This was confirmed by our supplier that handled the disbursement of the product from a Rock and Republic warehouse. We interviewed the person in charge of this disbursement of product and they confirmed the product is from the Rock and Republic supplies. Some product may be samples, discontinued items, damaged items, and unreleased product. People will get confused over the authenticity because product was released that never went to the retail stores. According to our source, the product is Rock and Republic. Therefore, the accusations made by this individual are inaccurate and false.We do our best to resolve issues with clients. In this situation, we were unable to verify the claims of this complaint after a thorough investigation and multiple interviews. Furthermore, this person chose not to report the problem until weeks after the event and this person did not follow our process to resolve problems like this one by reporting it the day of the event. As stated earlier, we do our best to work with clients to resolve problems; however, this is the liquidation business and product sells for a fraction of original retail value. We are already working with the Arizona Attorney General's office to address this person's complaint and a complete response will be filed with the Attorney General's office.
