Our company was contacted by the homeowner in March of and asked to provide an estimate to replace the roof on *** *** after it had sustained storm damage. During the initial inspection we were allowed access to the interior and shown staining in an upstairs bedroom in
line with the chimney. The initial inspection is the only time we have had access to the interior to observe existing conditions. We performed roof work per *** *** Insurance claim and material manufacturer specifications. No structural changes were approved or suggested to the home. A year workmanship guarantee was provided in this contract. The summer 2016, more than 4-1/2 years later and a conservative 40+ inches of precipitation per year, the home owner called and wrote a letter explaining he had “damage around the base of the chimney”. A second letter, dated 8-21-16, was sent and the homeowner “gave us notice that our employees failed to do a workmanlike job” when installing the roof, and expressed surprise that we would “do such poor work”. The homeowner suggested we pay $for another contractor to re-shingle the area in question or re-shingle it ourselves. Our shingle crew and the original estimator/salesman went to the home on 9-2-and took pictures of the cricket at the chimney where they found no defect in the counter flashing or shingle installation. Obvious deterioration/defects were found in the crown and tuck pointing of the chimney and three lead sleeve flashing had been damaged by squirrels. The homeowner was present, but we were not given access to the interior to observe the “damage around the base of the chimney”. We supplied an estimate dated 9-22-to repair the chimney and three lead sleeves. We received a letter dated 10-27-claiming two contractors had said our workmanship around the chimney area was defective. The homeowner asked us to pay the lesser of the two estimates from the two contractors, or a complaint to the Revdex.com would be issued and/or file suit. Copies of the contracts from the two contractors were provided with this letterOne contract states the chimney cricket was improperly installed without slope. The cricket is a structural component built into the home during initial construction, with slope, designed to divert water from ponding on the back side of the chimney. Our company was contracted to replace the storm damaged roof to match the existing as close as possible, which we did. If the workmanship was truly defective we would have known after the first heavy storm, let alone years of consistent storms.
