HOA
The Belinski HOA states no campers, trailers, boats, work trucks…. Etc., however, we had a neighbor complain about our camper parked on our property.. and they proceeded to pressure Belinski to enforce this HOA ordinance against us with a lawsuit until we removed our camper from our property. Now we are unable to “ever” park it on our property without monetary and legal repercussions. So I am posting this to inform Belinski builders and any Belinski home owners in the Hunter Oaks subdivision who have any of the above mentioned items parked on their property, that they should also be forced to comply with the HOA ordinance and remove their things off their property as well. If Belinski does not enforce this for the whole Hunter Oaks subdivision, then they need to rescind the stipulation for us as well. So Belinski Builders, what are you going to do? Release us from prohibiting us from parking our camper on our property? Or start enforcing your HOA for all the Hunter Oaks subdivision that violates these rules? You can’t pick and choose who is required to abide by these rules. No changes made? More poor publicity to come public!

Never Again Building through Bielinski Homes, Inc
I built on my own land about 10 years ago. Nothing but constant problems since the completion of my home. First the placement of my home on the land, quality of the windows, the fireplace, brick selection, the placement of my back door with an additional 1/2 space added to the garage. Most recently finally got the whole house painted just to find out the ceilings were different colors than the actual drywall. Every time, I contact Bielinski with questions/concerns they NEVER have any answers. I have been told by employees that they were not around when my home was built so they can not help. If you are building or thinking about building make sure you specifically have everything documented. After they have closed you case you will NOT receive any support after completion.

Have only "good" to say about Bielinski Builders.

Review: During the building of my home I expressed concerns numerous times about the location of the utility boxes in relation to my home; specifically the utility boxes were especially low in relation to the home elevation. The utility boxes were installed on the lot prior to my purchase and the initiation of the the building. When I brought up my concerns I was told the boxes would not be raised, it would not be an issue, and also told "let's see how it looks after the rough grade." After the rough grade it was clear that there was essentially a hole next to my house where the boxes sit. It made the space between the service door and driveway unusable because it was a dangerous slope. I met resistance in getting this addressed, but right before closing Bielinski agreed that this was a problem and agreed to have a retaining wall installed after closing. We went ahead with the closing. The wall was installed the following week; I was out of town and had been clear at closing that I would not be around that upcoming week. The wall that was put in was not up to grade level with the rest of the yard, and the walkway between the service door and garage was about 10-12 inches below the siding. I assumed it was not completed. When I contact Bielinski they insisted it was completed and that the grade was appropriate. I had an independent landscaper look at the wall, was told it was incomplete and not up to the correct height for the grade of the yard. I was given the following estimate: "Provide and install approximately 1 to 1 ½ ton of mixed color 12" to 14" granite boulders and raise level of Utility box containment well area to proper grade heights. Installation include about 2 ton of ¾" crushed lime stone traffic bond for area between rocks and foundation.....$487.00 plus tax. Since I was having the yard grading completed by this landscaper I asked Beilinski to pay for that portion of the job. Instead Bielinski sent their own contractor again, he filled in the crushed limestone walk way but did not bring the rest of the wall up to grade level. In addition, the gutter drain pipe crosses that limestone walkway, creating a tripping hazard next to an already precarious walk way, as well as dumping the drain water directly in the utility box well. I have repeated contacted Bielinski and sent pictures expressing my concerns for safey and liability, and have asked that this wall be completed to my satisfaction and that the gutter drain pipe be moved to eliminate the tripping hazard. The responses have been slow, sometimes days to weeks, and have been refusal to do anything further. I have sent many pictures showing the hazards, with continued refusal to do anything further. Two days ago, my son's foot slid down the steep slop where the additional boulders should be, and he fell into the well area, injuring his leg and hitting his head on the ground. I contacted Bielinski again restating that is area is incomplete, is a safety hazard and a liability, and I wanted immediate action. It has been two days now with no response.Desired Settlement: The utility well wall needs to be raised to grade level with the yard surrounding it, and the drain pipe needs to be moved to eliminate the tripping hazard. I want this company to take responsibility for the problem that they created and fix it, not try to wash their hands of it because the building is now completed. I would like the work on the wall to be completed by a landscaper of my choosing, paid for by Bielinksi, as I do not trust at this time that their contractor is acting in the homeowner's best interests. He did tell me he does a lot of work for Bielinski, and also told me they negotiated the price of the job down from the estimate he gave them.

Prior to the date of this email Bielinski has offered and Ms. [redacted] has accepted Bielinski’s offer to relocate the downspout. As for the boulders/stone situation, in order to resolve this matter Bielinski hereby offers to pay $400 to Ms. [redacted] to so that she can change the boulders/stone area with her own landscaper and therefore dictate how it is completed. The payment of money would be in exchange for a full release signed by Ms. [redacted] of both the downspout and wall matters. Bielinski did receive a bid from its contractor for $385 for the additional boulders. Let us know if this offer is acceptable to Ms. [redacted]. Thanks.

Review: We contract with Bielinski Homes in July of 2012 to build a home at the above address. We moved in on December 19, 2012. At this point the yard had not been rough graded. They finally came out in June but we were not happy with the grading. We called the City of [redacted] and they verified that it had not been graded correctly. We now realize that this lot did not support a 4' exposure on the basement on both sides of the house. The original grading plan submitted to the city called for the lot next door to drain across our yard but as it stands it will grade across the middle of our back yard. They said they would come and do more grading, but have not come. Before we can finish grade our yard, they have to finish the grading on the house next door. But now they have a new start on the other side of the model home next door and dumped all their dirt in the model's backyard. So now we are third in line to get our yard done. We have a landscaper standing by but cannot do anything because Bielinski isn't doing anything. They also have a policy that they will not do any warranty work until you are in 4 months. They came in April and we reported a possible leak in the basement and flooring issues in the dinning area. We finally called the concrete people ourselves in June and someone came out right away but we have still not seen anyone about the flooring. That was 3 months ago.Desired Settlement: We are now going on vacation and will not be able to put in our yard until mid-August. We would like the grading to be completed by then. I am so tired of being ignored. Once they have your money, you become invisible.

Mrs. [redacted] is correct that she and her husband contracted with Bielinski to

construct a home for them and that they closed on the home in December of 2012.

The date of closing is very important because it is the root of two of the three

issues that Mrs. [redacted] complained about. Because of the December closing,

Bielinski was not able to complete the grading of the lot due to the cold

temperatures and frozen ground. In these instances Bielinski typically returns in

the spring to complete the grading. Southeast Wisconsin has just experienced the

third wettest spring on record and with all of that rain the grading was not able to

be completed as the ground was simply too wet. It is my understanding that the

weather is forecast to be drier and should allow for the grading to be completed

soon.

The issue pertaining to the possible leak in the basement also arises out the closing

date and grading issue. Because the lot grading was not completed, the home

experienced some ground settling and the water intrusion into the basement. It is

my understanding that some minor grading work was completed which stopped the

leak issue. Lastly, it has been reported to me that flooring issue was resolved

earlier this week.

At this time Bielinski understands the frustrations that the [redacted]s are

experiencing but the biggest issue, the grading Is out of Bielinski's hands as we wait

for the ground to dry out so that the grading can be completed. Bielinski requests

that the [redacted]s continue to be patient as Bielinski intends to complete the grading

as soon as possible. Let me know if there are any questions.

I just wanted to say that Bielinski has been Amazing to work with! I work in the service providing industry, and have heard story's about builders not listening to there buyers. This is not the case with Bielinski. They have been helpful through every step of the process. I can't even express how easy and fun it has been to work with there team. I know this sounds odd hearing the words easy while going through the building process, but it is! We were able to choose from 6 different builders for the subdivision we are building in. I feel like we hit the jackpot when we picked ours!!! Thanks Bielinski for being honest and helpful during a process most don't find enjoyable. You have made ours better then we could have ever imagined!

Review: When we built our Bielinski home in 2005 we were told before signing the building papers that because we were a first time builders with Bielinski we were entitled to 1% off the price of a new home should we ever decide to build with Bielinski again. Time was not an issue. The time came this April 2015 when we put our house up for sale and worked with Bielinski on a new lot and home package. Once it was finalized, we inquired on the 1% discount and were told they "no longer honor that program." We feel this is false advertising and possibly a bait and switch. Bielinski has acknowledged the 1% offer did exist but can't offer it anymore due to economic changes.Desired Settlement: Bielinski should honor the 1% discount to those customers who were told that if they purchase/built again with Bielinski Homes they'd be entitled to that discount.

Bielinski does not allow buyers to use multiple promotions or discounts. It is my understanding that Mr. [redacted]’s proposed contract included a discount on the lot he intends to purchase as well as a promotion of some upgrades to the home. Please see the attached promotional exhibit that was part of the documents provided to Mr. [redacted] to negotiate the current deal. The notes on this promotional exhibit explicitly state that it cannot be combined with any other offer, promotion or discount. Bielinski is willing to offer the 1% discount to Mr. [redacted] but then the lot will need to be sold at full price and the upgrade promotion will need to be removed. I believe if you compare the two prices, the current lot discount and promotion is a better deal. Let me know if you have any questions.

However, what Mr. [redacted] is failing to realize is that the current promotions/discounts do have qualifications. I again attach the Rider to the offer that details the current promotion. The notes on this promotional exhibit explicitly state that it cannot be combined with any other offer, promotion or discount. Again, Bielinski is willing to offer the 1% return customer discount to Mr. [redacted] but then the lot will need to be sold at full price and the upgrade promotion described on the exhibit will need to be removed from the contract. Review: Product(siding) placed on home was improperly repaired on my home during one year warranty. This resulted in discoloration and just flat out ridiculous craftsmanship on part of the builder.Were given an ultimatum by builder that they would basically fix it in a way that was cost free to them due to supplier paying money to deal with issues. They agreed to replace a quarter of our siding and said any fading issues were not their problem. They then said they would replace it and paint our home but once again fading was not an issue that they would deal with. This action would result in a multi colored look to my home.Desired Settlement: Full replacement of siding on home which would not 'requite painting

Mr. [redacted] is correct in stating that there were some defectively installed siding

pieces on his home that were not repaired correctly. These siding pieces do not

meet current building industry standards. Bielinski has offered to replace the

defective siding pieces with the same product in order to meet the current building

standards. In addition to replacing the defective siding pieces, Bielinski has offered

to paint the remaining siding so that the siding will match the newly installed

siding. For purposes of this discussion, I am using the term "defective" to mean

improperly installed or repaired. Bielinski's offer was made pursuant to what it is

required to do per its warranty with this homeowner and per the Industry standards

when It comes to fading. There is no warranty for the fading of painted products

and the siding that Is installed on the subject home is a painted product. This

owner is asking for the entire replacement of the siding but this is above and

beyond Bielinski's obligations under the warranty.

Bielinski is willing to perform the offer that was made but Bielinski is not willing to

re-side the entire home. I had a telephone conversation with Mr. [redacted] on this

issue on Wednesday, July 17, 2013 and reiterated Bielinski's position.

Dear Revdex.com of Wisconsin:Mr. [redacted] executed a Building Construction Contract for a home. In that contract, there are allowances for various items because Bielinski does not guarantee the pricing on certain items such as grading. The contract that Mr. [redacted] signed, including all change orders, included allowances for rough grading, trucking of excess fill and placement of stone for the driveway. Because Mr. [redacted]'s home was constructed over the winter, Bielinski was not able to have its grading contractor come in and complete the rough grading because the soil is frozen. The home is completed and an occupancy permit has been obtained. Most customers wish to close and take occupancy of the home as soon as it is done. Therefore, we offered Mr. [redacted] the opportunity to close by paying his outstanding amounts to us (approximately $24,000). We arrived at the amount due by providing Mr. [redacted] a credit for the rough grading because it was not completed ($3,000 credit) and a credit for not trucking fill off of the site as it was not needed ($3,000 credit). The bills for the gravel stone for the driveway was also less than the allowance so a credit was to be provided to him for that. I have attached photos of the gravel that was installed which was ample for Bielinski to complete its work. Mr. [redacted] really has two options at this point. He can close with us now by taking the credits outlined above and then work with a contractor to complete the grading once the ground dries out. This again is typically preferred as the customers want to get into the house as soon as possible. Bielinski's contract also provides that the customer cannot take occupancy until all amounts are paid to Bielinski. The other option that Mr. [redacted] has is that we can wait for the ground to dry out and Bielinski can have its contractor finish the grading. Note that if Mr. [redacted] chooses this option, it is possible that the credits provided for work not be done will no longer be provided and in fact, Mr. [redacted] may owe more money if the costs to complete the grading exceed the allowance amounts. It is my understanding that Mr. [redacted] continues to speak with [redacted] of our office regarding his options. 10 years ago we built our first home and used Bielinski Homes and here we are again building again and our first and only choice was Bielinski Homes! Our first home was a "smart package" in a Bielinski subdivision so everything was done and very simple, the second is on some family land so we had to start from square 1 with all the zoning, permits, bringing in electric, gas and everything. Any road block that we hit, all we had to do was make a call or drop an email; and we had help.
I would highly recommend Bielinski Homes for your building needs, we were able this time to take a custom home of theirs and make changes to make it our own. From start to finish special thanks to [redacted] and [redacted] in the design department and [redacted] and [redacted] for making our dream house a reality! If I forgot someone, you know who you are.

Review: My window are suppose to be double pane and not leak. My windows have failed in between the panels and have condensation 24 hrs a day which make them fogged up and not able to see through. They are guaranteed for 25 yrs yet bielinski brothers do no answer my request for replacement.Desired Settlement: They should replace all windows in my house as they all leak cause of failure to the panels in between windows.

Per our contract and warranty documents, this customer's limited warranty from Bielinski Homes, Inc. expires 1 years from the date he closed on his purchase of the home. The warranty from Bielinski would have expired on February 19, 2004. In response to the customer's email to us regarding the window issue on March 15, 2016, we provided him with information on the window manufacturer and directed him to contact the manufacturer as he would need to discuss these issues with the manufacturer. Please see attached email chain.The customer needs to deal with the manufacturer at this point for his window issues as Bielinski's contractual warranty to him has expired more than 12 years ago.Let me know if there are any other questions. Review: Hello,

I have filed a few issues for my 11 month warranty, some of which were still opened from my 4 month warranty (7 months and they were not taken care of). I had to call and e-mail [redacted] numerous times regarding many of the issues on the 4 month as well as the 11 month warranty. She has been failing to return any of my calls nor respond to my e-mails. I filed for the 11 month warranty around 11/01/2012. Many of the items had to be repaired by myself since I would not hear back form the warranty department and I cannot wait for [redacted] to complete the inside of my home. To be honest, they have held up many of my projects due to the lack of communication. I feel like I should back-charge [redacted] for the work that I completed that needed to be completed by their subcontractors.

As a side note, I had to wait about 5 months before they contacted the subcontractor to come out and fix our master bathroom shower, which was leaking into the basement. The subfloor remained WET for that amount of time and the area is now showing small signs of mold.

The most recent issue is regarding a support wall in the basement (to help take some of the bathroom floor load since the floor joists flex more than they should) and the stone cap on the exterior of the home. I have not heard back regarding either of these issues so I told [redacted] to forget the support wall in the basement because it will get fixed by me (like most warranty items already) but I do really need the stone cap fixed. The cap is pulling away from the wall when it should not be.

Like I said before, they have failed time after time to contact me regarding ANY of the warranty issues and when they do, it still takes over two months to get a representative out here to see the problem. I do not know where else to turn. I tried contacting a higher-up employee; however, I believe [redacted] is [redacted] so [redacted] is "untouchable"

I am VERY dissatisfied with the warranty service from [redacted] Homes. The only reason I might build with them again would be because of Steve [redacted] and the sales team - they both were excellent to work with, returned calls and e-mails usually the same day, and they made the entire home building process enjoyable.

I would really appreciate it if you would be able to get a hold of [redacted] and have her do her job.Desired Settlement: The current issues on my 11 month warranty fixed, to have [redacted] actually return my calls, and reimbursement for the labor to repair the open issues that were NEVER taken care of.

Mr. [redacted] is correct in stating that there have been some difficulties in Bielinski

responding to his warranty Issue on the stone cap. Bielinski is committed to

repairing this stone cap and will do so as soon as possible. The subcontractor that

originally installed the stone cap, [redacted], is no longer in business and

Bielinski has had difficulty finding a suitable replacement contractor for this work.

Bielinski understands Mr. [redacted]'s frustrations with this matter when he sees other

contractors in the neighborhood but Mr. [redacted] needs to understand that the

contractors he sees are not necessarily the proper contractor for this specific job.

According to Mr. [redacted]'s email to [redacted] dated August 5, 2013 (copy attached)

which is the same date of his complaint to Revdex.com, Mr. [redacted] is only looking for Bielinski

to repair the stone cap at this time. Otherwise, Mr. [redacted]'s complaint is quite vague

as to what he is looking for from a settlement perspective.

Bielinski will work to perform the stone cap repair as soon as possible.
