On January **, 2013 we inspected the refuse compactor at the claimants apartment building for necessary repairs. A proposal for necessary repairs was sent to the claimant on January **, 2013. Our proposal clearly stated that because the compactor had not been used for a long length of time the ram (pusher) had oxidized to the chamber of the compactor. Our proposal clearly stated that we would make our best effort to free the ram and that whether we were successful or not the contract amount of $880.00 plus tax would have to be paid. Also in the proposal I strongly suggested that the compactor be replaced.

The signed contract to attempt to free the ram was returned to us on April *, 2013 with the required deposit of $352.00. On May *, 2013 my mechanics went to the claimants building and applied penetrating oil all around the ram. The next day a crew of two mechanics returned to the claimants building and attempted to free the ram. They were unsuccessful. As per our signed proposal the claimant was invoiced on May *, 2013 the amount of $880.00 plus tax for a total of $958.10. The deposit issued by the claimant was posted against the invoice leaving a balance of $606.10. The balance went unpaid. My office made numerous phone calls to the claimant requesting payment of the balance. Each phone call was met by taunting and resistance by the claimant. On August *, 2013 I personally called the claimant to request payment. I was laughed at by the claimant and told the building had no money. Within my rights I placed a mechanics lien on the building. I also placed the building with our collection company. The claimant has filed a complaint with the Revdex.com claiming we should not have placed a mechanics lien because the invoice in question has been paid in full. Why then did the claimant laugh at me on the phone and state the building has no money to pay me? Please have the claimant provide cancelled checks showing full payment for this invoice.
