We are writing this letter to you, and submitting it as a response to the complaint you have filed with the Revdex.com relating to your concerns about the actions *** *** and Sutton House Apartments (Management) has taken, has not taken, or you believe we should take, to
respond to your complaints about noise you report is coming from the neighbors that live in the apartment above you. You write that you work from home, and take care of an infant, and that you believe your neighbors are violating the lease and the “noise ordinance.” You complain that a prior offer from Management to allow you to transfer to a different unit, and to waive our standard transfer fee, is not a satisfactory response. You are disappointed and feel our response lacks professionalism. We regret that you are not satisfied with the living environment of your apartment and Management’s response to your complaint. Please appreciate that our offer of a transfer, without the standard transfer fee, was done as it is the one thing we can offer and control based on the facts and investigations we have conducted and received to date. Please note that the residents that live above you have lived at this building for a period time that proceeded your tenancy. There were no prior complaints from the previous residents about the level of noise or other activity associated with their apartment. Although your recent complaint states they have “violated the noise ordinance,” we do not have any police reports, complaints from other neighbors, or results from our own inquiries and patrol’s investigation to suggest that the levels of household noise from this apartment is exceptional, or would rise to a level where it could be considered a breach of lease and grounds for lease enforcement action by Management. We understand that you work from home and may be in your apartment more often than others. Different households have different hours and needs for their unit. Residents with small children are expected and permitted to have some amount of “household noise” that is associated with children running, playing, and “being children.” This includes some amount of crying and, on occasion, children being excited, yelling, or arguing with a parent. Unless and until the noise becomes persistent and extreme, we cannot, as a matter of adherence of fair housing principals, issue a lease violation or take adverse action against another resident for conduct that is within the scope of ordinary household use. We would note further that we have now received a complaint from the upstairs resident believing that your actions, and response to their household’s living, includes banging on the floors in response to their daughter crying is a violation of their rights and a lease violation. Management would like to do what it can do address your concerns. We can restate our offer of a transfer or, if you are not satisfied with your tenancy at Sutton House, we would be open to signing a mutual termination of your lease. At the moment, it appears that this is a situation with two residents having some frictions with each other that relate to the transfer of sound, voices, and noise that appears to be within the scope of “household noise” and living activities that needs to be expected in a multi-unit, residential rental community. Management will continue to respond to any complaint or report you bring to our attention of noise and will have our staff respond, and attempt to investigate, any noise that appears to be excessive or ongoing. The reports we have received to date, however, from the police and our own patrol service has not found a basis for a violation or any breach of lease. Sincerely yours, Management

I am rejecting this response because: As per page under Disturbances and Noise in the tenant handbook that I have attached and checking the businesses after hours complaint log (every call is recorded with dates and times issues occur) you will see that this has happened more than half a dozen timesFurthermore after my latest complaint, my brand new truck was keyed!! This I know for a fact was the neighbors since we have not met anyone in the complex!! As for the counter complaint that we knocked on their floor in response to their child crying, that is a complete lie and fabricationAnd if that actually occurred, why weren't we given notification at the time or got a email from the office!! If this is the final decision as to rectifation of this, then I will accept the offer of mutual lease terminationBecause this is I feel not in keeping with the lease agreement!
