Unfortunately, things do break from time to time and we make that very clear in all our documentation sent to the client, which by the way was her son, not Ms***All of Ms***'s concerns regarding being held responsible for
damage to the spa or any other item she used in the house are completely unfoundedAT NO TIME DID WE EVER INDICATE OR EVEN HINT THAT SHE MIGHT BE RESPONSIBLE FOR ANY DAMEGE TO THE SPA CONTROL PANEL OR ANY OTHER AMENITYAny such concern is purely a fabrication of her own makingMs*** failed to mention that she demanded a 50% refund on her stay because the spa did not work out of days on her stayAs to that request, *** did indicate that a 50% refund was not reasonable and would not happenAs to Ms***'s statement that the spa company did not go look at the spa, we are simply reporting what the spa company told us and are in no way lying to herIt seems self-evident that the spa company did send someone out...otherwise how could they have reported to us the control panel was not working and could not be fixedDuring this process Ms*** did threaten litigation against us, at which time ***, quite properly, indicated that she would have to cease conversations with Ms*** and refer the matter to meAt all times ***, who is our office manager with over years of customer service, was completely professional in her handling of this matter with Ms***, despite Ms***'s obvious angry and threatening attitude and commentsWhile I am an attorney admitted to practice in Florida and Georgia, but not California, I can always represent myself pro se in the event of litigationSince we are not seeking and never intended to seek any damages whatsoever from Ms***, she does not need the spa report and this statement to you suffices as a written statement that we will not be seeking any money or compensation from Ms***The spa is of course only one small component that goes with renting a vacation home in Big BearThe cost added to the nightly rate for a home with a spa is $However, I am happy to offer a credit of $per night for the lack of use of the spa for nights...a total of $assuming of course that Ms*** agrees not to litigate and finds this to be a satisfactory resolution of the matterWe are certainly sorry that the spa stopped working, but it was something beyond our control
