Complaint: #***
I am rejecting this response because: Big Ben's Towing is incorrect in their statements I will answer, refute and provide documents for each assertion.*** *** was towed on 10/04/at 1:14am, The reason why her vehicle was towed for for expired tags on the vehicle and the expiration date was 09/07/ My tags are not expired, see attachment The expired tag in reference is a day, out-of-state Drive Away Permit because I purchased my car in Illinois, and it was wasn't removed from my window. The apartment complex that she was parked at the time requires all vehicle to be current on registered vehicles, and at the time her vehicle registration was days expired, and not one time she mention that herher plates are on the floor of the vehicle until now I am and have always been compliant with the *** *** requirements; there was/is a parking pass, also in my window, provided by the complex I could not have secured the pass without providing proof of current registration to the complex (as seen in the attachment) When I noticed my vehicle gone and called Ben's, I was informed that I was towed for expired tags, I told the dispatcher that my tags are not expired and that they erroneously towed my vehicle I then told the dispatcher that this particular tag has been in my window since 9/7/and that Ben's has never towed my vehicle when they saw this tag and that I had a permit, every time they came into my complex.Big Ben's Towing & Recovery has a policy in place for all impounded vehicle when it come to the payment, we only take cash or debit, we don't not take Check, Credit Card, Money Order or any other form of payments for private impounds because of the high risk of stop payments As seen by the signs posted in Ben's office (also attached), *** *** is listed as a form of payment Any establishment should know that AX is and never has been considered a form of debit, so why is it posted as a form of payment? You will also see that a sign posted on their wall states according to Laws of Maryland CHPage Section C - "(1) Accept payment for outstanding towing, recovery, or storage by cash or at least two major, nationally credit cards."Big Ben's Towing & Recovery is open hours a day, our office hours are 9am- 6pm, I have drivers that always be available to release vehicle hours a day There is no posting on Ben's website nor their office door which states the hours of operation from 9am-6pm; the only time posted on both and my receipt is hours Ben's is misrepresenting the fact that a driver is always available; when I called the office at approximately 7am, to inquire about my tow, I informed the dispatcher that I was on my way (along with telling him that I will deal with their illegal tow, legally) I called a cab to drive me to their location and no one was in the office (the cab driver can verify this, as he waited with me for a period of time) I called the office# again, and the dispatcher informed me that "the' driver was out on a tow and it would take him minutes to arrive I argued the 24hr supposition, and that I was waiting outside in the cold I was then told the driver would be there in minutes When the driver still failed to appear, I called a 3rd time and was again informed that the driver was on his way When the driver finally arrived some minutes later, he DID NOT have a tow attached, as the dispatcher previously stated. The part that *** said that the fence slammed into her vehicle is not correct because when she claimed that it happen my driver snap pictures of where she said the wind blow her fence door into her vehicle and there was no damage done to her vehicle and again I attach those photo's also with this email The only truth to ALL of the statements submitted by Big Ben's Towing is that there is no monumental damage to my vehicle from the fence slamming against my vehicle However, if a fence did not slam into my vehicle, then why did her "driver snap pictures"? When the fence slammed in front of the driver, myself and my driver, I was upset and took pictures Then the driver also took pictures to prove that no damage occurred. This isn't the first time *** vehicle was towed from the apartment complex, so she knows the parking rules for the complex, I can understand that she is upset with her vehicle being towed again, but she took the risk when she parked there Finally, to disprove all the the aforementioned falsehoods and this one, my vehicle has never been towed by Big Ben's Towing and/or from the *** *** complex, and I ask Ben to show proof of this previous tow? However, Ben's did try to again, illegally tow my vehicle a couple of weeks ago, claiming not to see my issued temporary parking tag When I confronted the tow driver, before he attempted to jack my vehicle up, I provided him my parking pass and he still tried to tow my vehicle But I was not going to let Ben's tow my vehicle and they did not Let me also mention that this same "expired tag" was in my window, but that wasn't why Ben's attempted to tow my vehicle So yes, I am very familiar with the parking rules for the complex and am very upset that Ben's is a predatory, unprofessional and unethical business I watch this company prey on vehicles in my complex, lurking around before the imposed tow hours - looking for cars to tow Ben's has not use flatbeds to tow cars, as stated on their website, and they did not "provide a report to *** *** within hours of leaving the property" when they towed my car, also stated on their website Maybe this is why the company has numerous complaints and a F+ grade with the Revdex.com?
