I have attached all the exhibits with the explanations below
It is sometimes understandable for people to not understand the DEP, and NYC Department of Buildings rules and regulations there are many forms that need to be filled out and sometimes the customer does not know the difference between an annual inspection and the initial inspectionThe initial has been performed by Big City Plumbing and I provided documentation
The annual inspection report which is not part of my contract and is due every year was authorized by *** *** to perform this workWe performed the work, sent a bill, sent emails, and statements for several months without a wordNor did she call to complain about an additional ser***ed, performed over a year ago
My feeling is that she did not want to pay for the annual report and figured making a complaint would be easier
Once you review all these documents, please remove her complaint from my file
I would like to know, if you look at the documents, *** *** has signed for the initial and the annual reports, giving us authorization to proceed, I wonder if this is a criminal offense

Exhibit A: The initial installation (contract)you already have, dated 1/**/was for a 2” and a 1” RPZSee attached photo, exhibit A, of RPZ, it comes with the valves, the valve that we changed was authorized by *** *** which was not part of my original contract cold water valve for boiler room on left side of building and she paid for, now after years she is complaining
Exhibit B: Invoice #***, dated 4/*/2013, which you have, was for the annual Back flow test required by the DEP, not the initial one performed as per my contractRPZ’s have to be tested every year and there is a fee every year. *** *** called us back to do the annual test which we have done, and never received payment
Exhibit C: *** *** sent you the annual test report, if you look on the top right hand corner this is not the initial test but the annual one

Exhibit E: Job signed off on 3/**/meaning all applications, test, and all requirements from DEP, Department of Buildings, have been completed

Exhibit G: Please see email from Big City Plumbing to the architect *** *** dated 2/**/2012, stating drawings he provided and the 1/2" RPZ and piping is actually 2" and we did not charge her for the changes and applications that we had to file
In addition to, the only open invoice is for the annual test and filing

Please find attached all approved documents for the initial test for and the annual test for from the New York Department of Environmental Protection, stating all test have been completed, approved and signed off
In *** ***'s letter, I will try to answer by exhibit numbers
Exhibit A - Paid for, completed and signed off
Exhibit B - I am happy that *** *** acknowledged that she hired one of Big City Plumbing's tester's to perform the test and if you look at the documentation my name is on it along with the tester, *** ***. I informed *** to return all funds to *** ***, and payment would have to be received in the company's name
Exhibit C - If you look at the Nreport, my name and ***'s name is on the report and I have never received payment

Closing statement, *** is a tester for Big City Plumbing, and as you can see from all documentations, ***'s and my name is on both applications
*** refunded all money to *** ***, checks for $each and checks were cashed on 4/*/& 4/**/2013, and I still have not received payment for the annual test that *** has performed
In conclusion, the initial and the annual test have both been completed and filed by Big City Plumbing and *** *** admits to hiring my tester and Big City Plumbing for the annual test and never paid me

At this time, I have been contacted directly by Big City Plumbing & Heating, Inc. regarding complaint ID [redacted], however my complaint has NOT been resolved because:
I need to contact DEP personally to verify whether they have received the test reports.

Review: (1) Two back flow prevention de[redacted]es (RPZ for short) are required to be install on two separate water mains in the building at [redacted], as per DEP regulations. An architect was hired to draw up blue prints of what needs to be done.

(2) Big City Plumbing (BCP for short from hereon) was hired on Jan 2012 to implement the blue prints and file all necessary paper works with the authorities for $9000. The paper works include permits with the Building Department and filing the Initial Test Reports for the 2 RPZ with the DEP.

(3) After BCP finished putting in the plumbings, an inspection by the architect revealed BCP left out a valve that was on the blue print. This was a mistake by BCP, but BCP wanted an additional $175 to put the valve in.

(4) I paid BCP the additional $175 so the job could be finish without further delay.

(5) On Feb 2013, got notified by DEP that the Initial Test Reports for the 2 RPZ have not been filed.

(6) Contacted BCP about this. BCP now wanted an additional $250 for filing the reports.Desired Settlement: BCP should file the 2 Initial Test Reports ASAP without additional payment. BCP should be responsible for any fines, if any, from the authorities due to the delay of this matter. BCP should refund the extra $175 that was paid for the valve that they missed to install the first time.
