Response to Revdex.com Complaint #[redacted]
To whom it m ay concern:
Unfortunately this customer is not telling the truth about this situation. He starts his complaint by stating that...

our company fraudulently charged his AX credit card. This is untrue as the customer himself came into our store to orders both machines in question. We have signed credit card slips and rental contract by the customer. He also claims that we did not deliver these machines, however in his very next line of complaint he states that the machine was “driven” by our worker to his job site at [redacted]. This is the fact; our company did deliver the machines to this customer at his job site. Then the customer claims that our worker “refused” to offload the machine at his job site, this is an absolute, outright LIE! I have pictures of the machine offloaded at the customers’ job site, with the customer standing right next to the machine. (Unfortunately there is no way to attach these pictures, however upon request I can email these pictures to Revdex.com.) Again the machine was delivered and offloaded at the customers’ job site. However after delivery, the customer cancelled the rental. This is when the customer insisted upon a full refund.
Our response to this is that there shall be no refund because we did our part in regards to serving the needs of the customer. Also per our rental agreement that was signed by this customer, 24 hour notice is needed for any cancellation for a refund to be issued. This customer cancelled after the machine was delivered to his job site. However in good faith, we still refunded to this customer $500 out of the $600 charged. No fleet in America runs for free, we kept the $100 as compensation for our truck going to the job site, our man offloading the machine and then our man having to bring the machine back again.. This is gas and time which equals money ………….This customer is being unfair in his request for a full refund.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

Big Sasco's attempt to manipulate public opinion and/or debate me is nonsensical and futile. The facts are clear:
1)The company agreed to provide a bilingual driver as a precondition to the rental agreement that would start on 7/*. They breached that agreement and sent a driver who did not speak Spanish. Further, their [redacted] advised the driver to return the subject scissor lift and cancel the agreement when he heard I was concerned about public safety etc. since the agreed upon proper training would not ensue. On another note, any picture Sasco claims bolsters their position is immaterial, moot and irrelevant. Obviously a delivery did not occur if Sasco concedes that its driver returned the lift to the store within an hour. Further, even if it was delivered, which it was not, pickup and delivery is clearly marked "FREE' on the agreement. This is clearly a sound affirmative defense to Sasco's lies. Also, in this jurisdiction contracts can not be unilaterally changed by one party. Thus, 'FREE' pickup/delivery delineated on the agreement means FREE.
2)Big Sasco is poorly run and untrustworthy. All prospective customers, vendors and stakeholders beware.
3)If Big Sasco continues to falsely question my integrity, this matter will likely escalate to a court of competent jurisdiction. Govern yourself accordingly.

The [redacted]'s opinion regarding my credibility is moot. That is, she was not present on 7/* and can not attest to the material facts alleged herein. Review: A worker fraudulently charged my American Express card knowing he would not deliver and leave the contracted scissor lift and demolition hammer at [redacted] as agreed today.Specifically, the worker drove the machine to 29 Buffalo and refused to offload and leave it at the since the [redacted] told the worker to return it for reasons unbeknownst to me. As such, the company breached the contract and I am entitled to a full refund of $600 since I am within the 24 hour cancellation period. The company not only wasted my time, but they are attempting to withhold my funds and scam me out of my money.Desired Settlement: Credit my American Express card for the amount charged.
