this model and was described as follows in the *** listing:Up for listing today is a Terex 72-front end loader serial with a broken windshield and has hours, which Iam sure is higher than thatIt was the sellers first loader and has been taken care off, of course there is wear and tear as is to be expected considering the age of the unitThis is a consignment item and the seller ensures me that the Item is ready to goWe do offer a day money back guarantee if the item is not as described or pictured (this does not include freight to the destination or return freight)There is no warranty written or implied and buyer Is responsible for freightWe do want you to feel comfortable when buying from us as everyone has reflected by our 100% feedback In the over years in the *** communityThat is why if you have a question, concern, would like to schedule a time to view the item, see additional pictures or videos, or acquire a freight quote (please provide loading dock capabilities, zip code, andif residential or business address) feel free to contact us via the *** link or call Ashley at ***We are asking $6,OBO and no reasonable offer is not consideredThanks forlooking and have a great day!With some of following pictures that were included in the listing listed below!** had to have this item on top of a mountain in California and required freight an extensive amount of work and changing of trucks to get the item to himThe freight was costly, and completely his choice I These loaders brand new go for OO's of thousand of dollars and he realized he was geWng a used machine with wear and tear for its ageIn the listing it offers the buyer an option to schedule a time to view the item and he did not make arrangements to have someone inspect the machine hereWe were assured by the seller that item was ready to go and was operational I am including a letter to this effect from them as well,to show that in no way did Big Sky General Rental INC misrepresent what we were saying Also when the buyer (**) informed me he was upset I put him in contact with the seller to see if they could figure out how to resolve the mechanical issue side** then had a mechanic come up and inspect the machine and provided a barely legible work order slip that would require hours of work which he estimated to be $3,and since parts in his experience were usually about the same he demanded a full refund while keeping the loaderThere was no part estimate and at least $2,worth of extra parts were included with the loader at no additional charge We offered a full refund on the receipt of the loader and he would not take it as he didn't want to pay return freight We then offered our commission which was $to him as well as talked the seller out of $off, (the seller is adamant the item was operational and he got a good deal on the loader) but ** would not take it and demanded a full refund while keeping the loader againHe then threatened to leave negative feedback on *** which has been built to 100% over the course of years He left the negative feedback and I am disputing it with *** over the whole transaction I am responding to your complaint as I do not feel that we are in the wrong and Big Sky Rental did not misrepresent an item

I am rejecting this response because:The delivery location, value, parts supplied, and age of the machine doesn't excuse the fact that the machine was represented as well maintained and ready to go, and is notThe condition was grossly misrepresentedA proper description would have been "poorly maintained and needs a whole lot of work"We have only found more problems and more evidence the brakes weren't working, after replacing the emergency brake air valve we found both brake power clusters to be inoperableAfter adding brake fluid to an empty system we found one wheel with brake fluid leaking down, may be another also, as we didn't get fluid to one of the wheels at allThis means at least one wheel needs to come off to get the brakes workingThe mechanic already has twenty seven hours into it, with an unknown number to goIt's two hours one way just to get to the machineWe had the machine hauled directly to the place it will be used because the seller told us it's ready for workNow it's in a place without shop and powerThe sellers attempt to pass the buck to the person she sold it for is ridiculousI have no recourse against him, she sold it to meShe's responsible for the accuracy of the listingShe put her reputation on the line taking the word of someone instead of making them demonstrate the machines conditionI also encouraged her to talk to the mechanic, and she did notHe was eager to explain the situation to herThis sale is a contrast to my many other purchases on eBay, most others have described their items well and have been very responsive in taking care of any problemsThis seller dismissed what I was saying from the beginning, and wouldn't talk to the people that also had knowledge of the situationThis includes the truck driver that delivered it
