The buyer, [redacted], decided to purchase her 2005 Ford from W.A. Auto Sales, Inc in June of 2012.  W.A. did not have financing available given her credit situation, so we at Big Tex Autoplex agreed to help her get her truck financed through one of our lenders.  The buyer, along with the...

owner of W.A., decided to purchase a service contract through Johnson Sewell Ford that was to be financed in with the truck purchase.  We at Big Tex Autoplex made a check out to "Sewell Ford" as instructed by the buyer, and the buyer was to take the check and purchase her own warranty with Ford. We did not know anything more about Johnson Sewell Ford, including their name, than what we were told by the buyer. Upon presenting the check, the buyer was notified that Johnson Sewell Ford could not accept a check made out to Sewell Ford. She was then informed that she would need to bring in a corrected check. As soon as [redacted] at Big Tex Autoplex was notified, [redacted] explained to the buyer that she would happily reissue a corrected check as soon as the incorrect check was returned by mail or in person. The buyer, to this day, still has the original check that was issued. At no time did we agree to just send another $1800 to Johnson Sewell Ford, nor would that have done any good, as the buyer would need to present the check and sign papers to actually purchase the warranty.  We at Big Tex Autoplex have sold many, many warranties through one, single warranty company since May of 1997, and we have never had this issue.   When given the communication that took place, the fact that the buyer still has the original check, and the fact that the buyer never signed any papers purchasing a service contract, it becomes very clear that she would have known throughout that she never had a warranty of any kind on her vehicle.  None of this would have ever been an issue at all, had the buyer simply picked up a new check, taken it to JohnsonSewell Ford, and signed the papers to purchase her warranty as agreed at the time of purchase.  I'm certain that if the buyer had shown up at the Ford store to purchase her warranty with a credit card, but realized she'd forgotten her wallet on [redacted]'s desk, she would have come directly back to pick it up. Unfortunately, I don't feel she thought it was important enough to make the short drive at the time.
