Complaint: [redacted] I am rejecting this response because: Thank you for the response My complaint clearly states the issue: that DeFalco's provided towing assistance in a misleading manner Specifically, when I showed the driver my [redacted] membership card (which was valid), he waived it aside and said he would look after the paperwork later That, coupled with the fact that his tow truck had a prominent [redacted] logo on it and that he provided me with a company pamphlet which has prominent [redacted] branding on it, led me to believe I was receiving [redacted] service In fact, when I later met him and told him about the issue, he was very sympathetic and said he wished he could help, but that this was a matter for management to address I am asking for a refund of the $charge that DeFalco's made, because they charged me at rates far higher than the [redacted] rate The [redacted] charge would have been $because the tow was within the mile radius that my [redacted] membership provides forIn addition, I would like DeFalco's to provide $compensation for the 20+ hours I have spent trying to resolve this matter, as well as the mental anguish this has caused my family and I Regards, [redacted]

I am rejecting this response because:
The business response is not even close to what actually occurred ? They never offered a refundThey basically said that I could have my own battery back if I wanted to search the pile of batteries that would be picked up in two days for recycling, also stating that I probably needed a new battery anywayThey were rude and confrontational on the phone. I may consider the offer, but the fact is that the offer was never made to me !

On May 7, 2015 the [redacted] called us out to tow a disabled vehicle on route 78. It was an [redacted] owned by [redacted]. The owner was given rates to have her car towed to her house in Bridgewater, NJ. She agreed to the rates and the driver towed her car to her house. The owner gave...

the driver a little bit of a hard time and that is when he advised her that if payment was not made the car would be brought back to our shop. That is also why the car was not brought to the dealer because the owner would have to be there to pay for the tow. The owner paid for the tow - $210.00. Signed the receipt and the driver moved on. She was charged our contracted rates for towing with the [redacted] Attached are both our rate sheet and her signed receipt. As for what happened with [redacted] and the owner has absolulty nothing to do with us. She has an agreement with her [redacted] membership and not with us. We made no guarantee as to what [redacted] will cover or will not cover. This matter is between [redacted] and the owner. We performed the service we were called to do. The owner has also verbally threatened to dispute her credit card charges as well as filed the same complaint with business consumer alliance. This is becoming border line harassment on the owner's part.

Our trucks have the [redacted] logo on them as well as the New Jersey State Police logo as well. You were never once told there would be charge for the services. Your agreement is between [redacted] and yourself. We are not authorized to call [redacted] on your behalf even if you asked. While on an accident ramp on the highway it is the drivers only concern to get out of there safely. It is not his or our responsiblilty to handle anything with your [redacted] membership. All rates which you were charged are clearly posted in all 3 of our waiting rooms. We can not be of any further assistance to you.

I am rejecting this response because:  Thank you for the response.  My complaint clearly states the issue:  that DeFalco's provided towing assistance in a misleading manner.  Specifically, when I showed the driver my [redacted] membership card (which was valid), he waived it aside and said he would look after the paperwork later.  That, coupled with the fact that his tow truck had a prominent [redacted] logo on it and that he provided me with a company pamphlet which has prominent [redacted] branding on it, led me to believe I was receiving [redacted] service.  In fact, when I later met him and told him about the issue, he was very sympathetic and said he wished he could help, but that this was a matter for management to address.  I am asking for a refund of the $420.75 charge that DeFalco's made, because they charged me at rates far higher than the [redacted] rate.  The [redacted] charge would have been $0 because the tow was within the 5 mile radius that my [redacted] membership provides for. In addition, I would like DeFalco's to provide $500 compensation for the 20+ hours I have spent trying to resolve this matter, as well as the mental anguish this has caused my family and I.

The gentleman did in deed purchase an AAA battery on the roadside due to his car not starting. He phoned into AAA for road service. Our driver responded and tested his battery. His battery tested bad. It turns out that the car had other problems as well, (i believe the member said a lose fanbelt)...

which was causing the battery to become discharged. The member called into the shop to explain this to us. He started he would like a refund. We advised him that we would be happy to honor his request upon returning our battery. He was advised that we would be saving his old battery to re-install in his car. He phoned into AAA to complain about the same thing. AAA agreed with us and advised him the only way he would get a refund was to return the AAA battery he purchased and have his old battery re-installed back into his car. The offer still stands, if he wants to bring us the battery back and have his battery battery re-installed in his car we would be happy to do so. We will not be giving a refund without recieving our battery back.

I am not sure what this person is looking for. We are going on a year at this point. The gentleman was involved in an accident on a highway ramp. One of our drivers saw the accident and came to his aid and provided saftey until the police showed up. Our company did in fact call the police to respond...

due to the unsafe location. When the police arrived they provided cover for our driver while he loaded the car. We were not called by the police but we are an authoried police tow and were given permission to tow the car. His car was brought back to our yard, he requested an estimate which we provided and he was not charged for it. Three days later he decided to have the car removed. He was charged standard rates which are clearly posted in the waiting room of all 3 of our buildings. He should try submitting this bill to his insurance comany for reimburment.
