We did set up the tent, tables and chairs on August 17, 2015. When we arrived the patio was full of patio furniture consisting of tables and chairs that we had to move to put the tent up. An employee had stacked two tables next to the chair and the chair fell over and the leg broke
off. A water barrel that weighs lbs never fell over onto the chair as complaint said. lbs water barrels do not just fall over or we would not use them to tie down tents plus water would have been all over the patio Our crew and the complaiining party saw the chair go over and leg crack off. It was an accident. I said the employee would replace the chair or get the leg fixed on the chair I felt bad and left the tent, tables, chairs efor another week rental for another party at no extra charge The employee quit the following week and in September I put up a tent for *** Ski and Patio where complianing party originally purchased the chair and they don't have any patio furniture in stock and not until March could I take it up with them. Complaining party and I have never spoken on the phone or person to person just through emails. In the Spring she wanted to know the status and I hadn't gotten a price from *** for being closed all winter. I sent her a in good faith payment. She then got a quote from *** for a replacement chair for and sent it to me. I sent it to accounting and insurance because originally I did not turn it over to insurance because I didn't know the cost of the chair. Insurance said they do not pay replacement value and wanted to know if there was a warranty on the chair which we were never told. Accounting went on line to *** who had the same chair and color which I sent her with a balance check for 1/of the amount because insurance said the chair is very old. Again we never knew purchase date or warranty information and insurance is only paying half so I forwarded it to complaining party and now I see a complaint lodged against our company. Employee broke chair and it was an accident, insurance is only paying for half the chair and complaining party signed a contract that we are there to set up the tent, tables, chairs not move furniture out of the way. They never prepared the patio for set up or take downShe said her mother couldn't do it because she was years old and didn't have anyone to do it so that's why we did it and accidents do happen. We met the client half way through insurance and my hands are tied and I think the fair thing to do is both parties are in the wrong so we split the cost. Thats' fair

The facts are the chair broke on an accident. The employee set two tables next to it not a water barrel that tipped over. Nothing was heavy. The employee had taken out of his check. That was forwarded to rental customer. At time of chair leg being broke, customer never said the chair was going to cost to replace it or we would would of had this discussion and turned it over immediately to insurance for a claim. I sent her the then she sends me an estimate a year later from *** with replacement cost. She has never called me only emailed me and its not her house or chair its her mothers who I have never spoken to. When I got her email for the chair, it costing that much, I did send it to insurance immediately who told me, was paid, we have found a replacement chair on line, we do not have original receipt of purchase date or warranty info because if one patio chairs costs there must be a warranty and if it broke that easily without any force a warranty should come into place. The chair was on *** on line for and customer has been paid which is half of the amount because insurance will not pay replacement without original receipt or warranty info. So that is where we are right now from Big Top. Me on a personal note feel that customer could have called me over a years time not just send me a replacement bill and expect me to pay for it when I did nothing wrong. She would rather go behind the scenes and complain to the Revdex.com about not getting a replacement chair but never mentioned anything positive about the service we offered or the product we offered and left the tent for another week. I don't walk on peoples patios and break chairs on purpose or let employees do that. It was an accident. Nor do we just come and put up a tent and say hey we are too busy to come take it down so can we leave it an extra week. This was all talked about through emails and upon set up and she knows it. This is where we stand on the chair. Thank you

I am rejecting this response because:Our property was damaged by Ms***'s employee, to which she admitsFor months I received replies to my inquiries from her telling me she was working on supplying me with a replacement chairI have the e-mails to prove it. I don't understand how or why her offer changed to only paying us half the price of a chair from an off website that doesn't even match the finish color of our existing, fully intact set. At the time of the chair breaking, I informed Ms*** of where we purchased the chair-- ***She told me she had a relationship with them and assured me that the chair would be replaced at no additional cost to usI was never asked for information regarding the original purchaseI find this statement taken from her response very odd: "we never knew purchase date or warranty information" on the chairYet her company made the determination that " the chair is very old" and therefore would only be offering half of the replacement cost.I have been more than accommodating throughout this year-long unresolved issueWhen it became apparent that no action was being taken on the part of Big Top Tents, it took one phone call on my part to obtain the information from ***The quote of $for a new chair is attachedMy family does not think her offer of half of the cost of a chair (plus an additional shipping fee that's not mentioned) in the wrong finish color is anywhere near fair! For the record, Ms*** was the one who offered the tent to us for another week because she and her team were so busy that it would be doing them a favor if they didn't have to come & take it downWe weren't having another party, but we allowed them to leave it as a courtesyWhen she initially came to survey the site, she told me her team would be willing & able to move any furniture and I allowed them to do soAlthough that doesn't really matter considering the breakage didn't occur by moving the chair, it happened because Big Top's heavy equipment fell on it.We would like Ms*** to honor her promise and supply us with a new chair that matches the rest of our set.
