Review: My family has owned a condo at the Lodge at Whitefish Lake for over 20 years. On 5/29/12, Biggy's Landscape Service planted/replaced flowerbeds at the Lodge damaging my automobile with scratches on the rear passenger door from smeared mud and boots. Then on 6/1, a Biggy's lawnmower threw a rock denting my truck lid. Thinking they were Lodge employees, I immediately called the Lodge and explained what happened. They would speak to them and get back to me. When my truck lid was damaged I contacted the lodge looking for the manager to discuss but she was out until June 7th due to family obligations. The Lodge COO, informed me on 6/7 that they are not lodge employees but contracted by the HOA. Also was informed for first time no surveillance video. 6/20 the HOA directed me to contact Biggys directly to resolve.I finally spoke to the owner of Biggy's, [redacted], on 6/27 and explained to her what happened to my door and trunk lid. She was understanding and stated that these things happen infrequently but they "DO" happen. Ms. [redacted] continued to say they have a dedicated auto body shop in Whitefish, MT that they use in situations like this but since I live in Spokane to get a couple estimates and forward them to her to take care of the car. On 7/3 I called Ms. [redacted] to let her know that the estimates were delayed because our road was oiled and my car was garaged until the oil dissipates. Again, nice conversation and she said no problem. Estimates were emailed on 7/ 16 with follow up calls the same day and 7/23 with no return call. On 7/26th I finally reached Ms. [redacted] and instantly she was saying how they are not paying for anything and that I cant prove anything. This was a complete turnaround from our previous conversations. She did not give a reason but was overly aggressive. She spent the last few minutes trying to convince me how nice she was and offered me a $150 goodwill gesture. I refused the $150 goodwill gesture."Desired Settlement: Biggy's pay for damages to my automobile. Estimate=$594.80Much more detail available for incident as well as repair service.

Hi [redacted], I have no free time to formally respond to the complaint filed. Here is my response: [redacted] called our company to claim that we had damaged his vehicle on two different occasions. During the first phone conversation, I did not deny that we damaged his vehicle, because I did not know for sure. I asked him to get an estimate for the damage, and in the meantime I would talk with my crews and the managers at the lodge to find out what had happened. After speaking with my employees and the lodge managers, we came to the conclusion that there was no way to prove that Biggy's had damaged his vehicle. Not only was the vehicle over ten years old, but the claim that Biggy's employees sat on the ground and got muddy footprints on his car door was absurd. The other damage claim was that our lawn mower had spit up a rock and dented his trunk. That dent could have happened anywhere at any time. It was barely visible. We have mowed the lawns at the lodges for seven years, and have a perfect record of no damaged vehicles. Not only that, but the grass is bagged, there is no way for debris to fly out from the mowers. The claim by [redacted] that two crews had damaged the vehicle on two different occasions in the same week was absurd as well. The next phone conversation I had with [redacted] was to let him know that we would not be paying for damages, because there was no proof that Biggy's did the damage. The lodge managers agreed with with my decision to offer him $150 as a nice gesture, which [redacted] did not accept. Please let me know if this will work. Thanks.
