Dear *** ***, As your landlord, I felt I had fulfilled my duties under the terms of your leaseWhen you first reported that you had discovered bed bugs in February my staff called our pest control company who made an immediate appointment for inspectionWe reviewed the different
treatment plans with you and the cost associated with each planBased on cost, you had requested a basic chemical treatment which you stated you would payTo make sure that we treated the bed bugs in the best possible way I ordered the fire and ice treatment, which is a more effective treatment than what you had requested, and you were not asked to pay the difference in cost At that point Brothers standard two-week follow up, they still found some evidence of bed bugs so they retreated your apartment and scheduled another two week follow up, where they deemed your apartment to have no visual detection of bed bugs. I then scheduled Brothers Pest Control to perform an inspection for bedbugs for all surrounding apartments to yours and have documentation stating they did not find any presence of any other bedbug infestationWith no evidence of any apartments surrounding you to have an infestation you were held accountable for the treatment and charges billed by BrothersI then notified you of the final bill and you refused to pay it. As stated in your lease we then have the right to show your apartment to potential future residents once you had given notice We always gave at least hour notice to show your apartment At no time did anyone enter your apartment without notice or permission. Upon your move out on May 31st your security deposit was held to pay towards your pest control bill and you were then billed for the additional amount owed I received no further correspondence. I am rejecting this response because:
I made clear to you in a letter dated 3/30/that reads as follows: Dear Manager, I, *** *** reside at your property located at *** *** *** * ***, Rogers MN, This is in response to the invoice you sent me for bedbug treatmentI call your attention to Minnesota Statute 5058.161, subdivision 1, which makes the landlord responsible for maintenance unless the problem was caused by the "willful, malicious or irresponsible conduct of the tenant." I have not engaged in any such conduct regarding the bedbugsAdditionally, it is however inconceivable for you to conclude without any iota of evidence to attribute the alleged bed bud infestation to us after habitation of the apartment for nearly seven monthsTherefore, like any other maintenance problem-leaky toilet, flying bats in the attic, etc -- the cost of the problem falls on you as landlord and not me as tenant.Besides your treatment for the bed bug has deprived us for the last six months from fully utilizing the rental space per our lease agreementWe have been seriously inconvenienced by your instruction to bag our belongings for the duration of your treatment and do not seem to care for the inconvenience we are experiencingSince your invoice appears to validate Minnesota law I do not plan to pay itPlease rescind the invoice within fourteen days. Thank you for your prompt attention to this matter and I look forward to hearing from you soon. Clearly the landlord is not being truthfulI made it very clear from the beginning that I was not paying for the treatment for the reasons stated above
