I have reviewed the response offer made by the business in reference to
complaint ID ***, and have determined that this proposed action would not
resolve my complaint. For your reference, details of the events that lead
to my complaint are summarized below
The seller's response is simply false The sequence of events occurred as
follows: On Cyber Monday morning (12/1) I discovered the item in question
advertised on their website for $Biker Trends Website also offered a
manufacture's coupon code for an additional 15% off The offer included
free shipping When I tried to purchase the product I was timed-out by
their website, probably because I took too long to input my credit card
information When I logged back into my account, I noticed that the price
of the item (already in my shopping cart) had increased above the original
asking price, before the discount At that point (about 11:am MT), I
called the company and explained the problem to the woman that answered
She told me that there were only a limited number of items available at
that price, and she would check to see what she could do for me She took
my cell phone number and told me that she would call me back within 1-hours
This was the only verbal contact I had with the company I never
received a return call, as I was promised There wasn't any "name
calling" involved
That afternoon I went back into my account with Biker Trends and
the item I tried to purchase was once again being offered at the same price
So I placed one of the items into my shopping cart and went through the
standard checkout process The final total price was $ I
subsequently received an email confirmation that my order had been received and
was being processed The next response I was expecting, was a
confirmation that my purchase had shipped Instead, the next morning when
I checked my email, I had a new message from ***, with Biker Trends
In this email *** accused me of being told that the price was an error,
before I placed the order He said the new cost of the item was $359.25,
or 40% more
I responded to his email explaining that he must be confusing me
with another customer, because I never spoke with him A copy of his
original email and my response are attached herein as Exhibit A
Basically, my reply was that I expected Biker Trends to honor their
advertised price Shortly thereafter I received a second email from
***, canceling my order See Attached Exhibit B In summary, I am
very disappointed in the deceptive business practices this company used to
attract potential customers This was to be a special Christmas present
for my spouse I went online on cyber Monday like millions of Americans
looking for a good price for items on my Christmas list This
company took advantage of this time of year to prey upon unsuspecting
consumers
After reading their response to my complaint, I don't
believe that Biker Trends ever intended to sell this item at the advertised
price Nor do I believe that advertised price was an "error"
They used this item to generate traffic to their website, employing an
advertising method commonly known as "bait and switch" But, I
am one senior citizen that wasn't fooled and decided to shine a light upon
their practice Subsequent to filing my complaint, Biker Trends has
changed the pricing of this item on their website Please refer to
Exhibit C They now show "Our Price" (in red) at $
and the Retail Price at $
In closing, I am willing to swear that the facts
presented herein are true and correct, to the best of my ability, so help me
God
Respectfully,
*** ***

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
The
merchant isn't interested in resolving this complaint because they see
nothing  wrong with advertising a
product at a price they don't intend to honor.  Their only response is to
blame the customer for responding to their advertisement.  Documentation that they provided thus far
only supports my complaint.  Somehow,
they expect the customer to know what their cost basis is for every
product.      I hope that the Revdex.com
can alert future potential victims of Biker Trends' deceptive business
practices, before they are tempted to make a purchase.  As is demonstrated by their response, their
customer service deserves an F rating.

Review: Made an online purchase 12/1/14 Cyber Monday of a [redacted] seat that was advertised for $301.50. Their website offered an additional 15% discount code for this item. Entering this code brought the price to $256.27. I made the purchase and received a confirmation email and a receipt. The following day I received an email from [redacted] that said "as explained on the phone before you made this order, the price on line was in error". He offered to provide the item for $359.25. Send him a return email explaining that he was mistaken that I never talked to him or was told the price was in error and that I expected the company to honor the advertised price. I received a subsequent email that my order had been canceled. I believe this is a violation of deceptive advertising laws. I have copies of my receipt & emails that I can provide. Your help in this matter is greatly appreciated.Desired Settlement: Honor Advertised Price and Terms.

Response:

I have reviewed the response offer made by the business in reference to

complaint ID [redacted], and have determined that this proposed action would not

resolve my complaint. For your reference, details of the events that lead

to my complaint are summarized below.

The seller's response is simply false. The sequence of events occurred as

follows: On Cyber Monday morning (12/1) I discovered the item in question

advertised on their website for $301.00. Biker Trends Website also offered a

manufacture's coupon code for an additional 15% off . The offer included

free shipping. When I tried to purchase the product I was timed-out by

their website, probably because I took too long to input my credit card

information. When I logged back into my account, I noticed that the price

Exhibit C. They now show "Our Price" (in red) at $429.50

and the Retail Price at $335.00.
