I want to add that Mr. Bill Acker on his own accord showed up with 13 cubic yard of asphalt too address the issue of quality. I did not ask him to do this. Upon his actions I fully paid him the rest of my bill. that day. I also withdrew my complaint from the Attourney generals office in AZ. He Did a great job fixing the issue. I also notified the registry of contracting in AZ and let them know what he did. I am now satisfied with the job. Thankyou Mr. Acker

I am in sierra vista AZ. BA ASSociasiatiates are who they known as now. I was working in my camper when a pickup truck showed up in my driveway. I approached
the vehicle and asked what I can do for him. The man explained to me that he was
with a construction company and they had an aweful lot of left over asphalt and they
were hoping that they could save some loss by helping me out and at a very low cost
to me. He proceeded to tell me that There would be no charge of labor or anything
else except The cost of material. about $30 dollars a cubic yard. He said he would
put enough down to support my trailers. I said that the pavement would need to be
about 8 inches as that is what I remember the specification for trailers at a weight
of 10000 lbs. I then told him "Are you sure? You do realize that the cost of that
stuff is about 70 dollars per cubic yard." He proceeded to tell me that they need to
get rid of this stuff and
his company needed a place for it. I asked where is the stuff? He said that in a
couple of hours when they are done with the job they are performing now they will be
by with the machinary
and asphalt. I said ok. Again the man reiterated that it will only cost me the
about 30 dollars a cubic Yard. I Then told the man that I was a wounded warrior and
I may not be able to get everything ready for them due to my extensive injuries. He
proceeded to tell me again that his guys would move everything and there would be no
charge of labor of any kind. That he was a mason 1st degree and everything would be ok.
We just need a place to put the left over asphalt. He said we will draw up a contract
that not to worry he was a mason and a man of his word. That there was to much asphalt
and had to get rid of it. He then asked me If I was a mason.
I said yes. He shook my hand giving me the hand shake of a first degree mason.
I thought this was odd because I had no insignia on in plain view.
I asked him if he was one? He said yes. I asked where? He said in louisiana
but I am only a first degree. I asked him where did he live? He said here in
sierra vista az.
I then asked him how long had he been here? He said that he had been here 3 years. I
then asked him if he was gonna Demit from his current lodge? That he could join Huachuca
lodge 53. I then asked him if he was a fisherman. He said yes. I then asked him if he
had done any fishing here in az? He said no I havent had time. Then I told him about
parker canyon and San Juan, New Mexico and finally about lees Ferry in the grand canyon. He then
said he had to go. I said go ahead I will see him later.

During the wait I prepared the area as much as I could and during this time I recieved a
phone call to pick up my child in school due too an emergency. I left a note on the
door explaining I had an emergency and I would be back and left my phone number. I
left and returned about an hour later and the trucks
were there and a bobcat was already doing grading. I wasnt too happy that they were
working without me being presentI went up to the salesman
and apoligized about having to leave. He said not a problem. I figured you would be
right back. He brought me aside and started to write on a contract.
( see exhibit A: first contract) he explained that the charge would only be for
30 dollars per cubic yard. I filled it out and he was talking to me while I was
doing this. So he reassured me that they will do a good job and again I asked him
what thickness they were putting down would be enough too hold my 10,000 lb trailer.
He said enough to support my trailers. He then took off to inspect the grading and
barked some orders to guys and then told them he was going to compact the earth.
Another fellow of dark complexion a bit taller than me with an accent from louisiana
started to talk to me. We chatted about Roads and again I asked where were they
working in the area. He told me that they were doing some highway stuff. We talk a
bit about the road projects and he said that they
would go in and fix the mistakes that the other contractors did when they were
doing highway 92 resurfacing project. That was currently being worked on.
The salesman that I dealt with asked me for about 13 gallons of fresh water for
his rolling compacter. I agreed and went to pull out the hose. He filled up and went
back to work I sat back and watched. The crew of about 6 guys( this is only an
estimate) Began to back up the machinery to start spreading. They
began close to my fenced in area in front of my manufactured home. After the
first pass of applying the asphalt I questioned the salesman about the thickness.
He said it would be enough not to worry. I said what was the standard for the
weight of 10,000 lb trailers when laying down asphalt. He then said it would be good
and would hold them. They continued laying down three passes at about 38 feet by
32feet. I again questioned about how thick and how many cubic yards they were putting
down. They measured the asphalt pad with the wheel measurement, the salesman did this,
and told me that it was about 32 feet by 38 feet. I said ok but what about the
thickness is should be 8 inches for the trailers and it doesnt look like it is.
He said not really. We said that we would put down 150 to 200 square yards the
thickness doesnt matter. I then said the truck that they are using carries about 13
cubic yards.
The man who was operating the spreader then retorted that the laying of
the asphalt was "as it lays" per square yard. I then asked what was the the
square yardage and they showed me on his phone calculator that the measurement
was about 200 square yard and that the thickness doesnt matter. I said how can
you say that." " of course thickness matters. they again reiterated that is was
" as it lays." So I awas totally baffled about this kind of measuring. One of
them volunteered that the thickness was about four inches. I am not sure
who. So then Iwas asked if I wanted more layed down. I said well yes this
isnt enough for my trailer to park on. Again I asked about what happened to
the cubic yard that I am supposed to charged for. They said "no it is a square
yard." I asked how can you sell by the square yard and not the cubic yard.
The man on the spreader (earlier identified as the uncle by the salesman)
said that if they went too thick the asphalt wouldnt dry in this Az heat.
I responded that did not make any sense. That in fact the pavers that
build roads put down about 8 inches on top of compacted base of 12 inches. I
said I need more pavement to put my ttrailer down. I then called my
wife to see how much I have to spend. Meanwhile she was looking into this
company on the internet.I went into the house and came out with my credit card.
The salesman then began to say he could go
a little more narrow and maybe get to the end of the driveway for another
$5000. I said no I only have $2000 dollars left. He said he could get to
where the trailer would end. Then he began writing up the second contract.
(see exhibit B) This time he wrote that I owed $4500. I then questioned him
about $30 per cubic yard as we discussed in our initial
conversation. Then I noticed that it said three thousand and asked him about that.
He then said he was a mason and his word is good. That I have nothing to worry about.
That if he did it by cubic yard it would be alot more expensive. I was hesitant.
But signed it because I couldnt park my trailer there now due to a partial pad cracking.
By this time I am wondering about the trailer cracking a partial pad with a heavy
Recreational toy hauler loaded might do. I signed the contract feeling very
uneasy about what was being said.
They began to spread the other portion to where the end of the
trailer would go. When they started the spread again I asked the the
man on the spreader what the thickness was? He said that it didnt tell him
the thickness. The machine doesnt say. I then insisted that these machines do tell
you the thickness and I want to know what the thickness was. He reluctantly said
that it was 4 inches. I was trying to process all the misinformation
at this time. So they continued spreading and again I asked what was
the thickness. The man on the spreader then said that It will vary
there are high spots and low spots and that it may be 2 inches to 2.5
inches thick. By this time I am shaking from too much anxiety and confusion. I am
just upset and not sure what the hell is going on. So then the crew
starts to move out the equipment and bring in the roller. As I watched and questioned
the thickness again out loud I heard a response that it may be as thick as one inch in
some places due to high and low areas. The Salesman then said lets go into the truck
where the air conditioner is and make payment. I gave the numbers on the credit card and
my card was denied because it was a large unkown purchase to card company.I called the
card company and they said they needed to talk to the primary card holder, which was
my wife. I called My wife who had finnally called and told her that she had to
authorize the purchase and the credit card company would call her in 15 minutes.
I asked the guy where thier business was located. I noticed at this time there was no
address on the contract. No response from the sales guy. I then asked where they were
located again and he said they worked out of thier trucks. I pressed him real hard saying
that you cant get a ROC # in any state without a legal address. After some more prodding
I got the address and wrote it on the back of the business card that he
handed me. Mean while I was talking on the phone with a guy to process payment.
So then I said on your contract you have a ROC number for bonding I am guessing.
He yes so I gave called my wife and gave that to her to research. I then started to
look up this number on the internet myself.
A man by the name of Bill Acker or something came up as the person who the license
belonged too. I asked him where was this guy? The salesman said thatI was talking to
him on the phone.

So feeling obligated I began to call my other credit card and preauthorize
a $2000 purchase. Then my wife calls and starts to tell me about predatory
paving and what she found about this company. She said they were some people
complaining about weeds growing through the pavement afterwards.I asked my wife
to talk to the credit card company as we have already had work done. Then my wife
asked where is this guy. I said on the other line. By this time I have had
it, about all the lying and misinformation. So I told the man on the phone
that until I see him in person with his id there will not be anymore
payment. The man on the phone said that he was too busy to see me in Sierra
Vista at my home. I told him tomorrow I would be in Tucson as he said he was there.
He said he had to go out and do some contracts. I then retorted
that he was in luck. I would be in tucson early in the morning until
around 1pm. Again he said that he just would be too busy. I said fine
Call me when you can make arrangements and show me who you are and with
ID in hand. There will be no more payments till I know who I am dealing
with and what is going on with this job. I got out of the car and went inside
to try and figure out what the hell just happened in the aproximate 2 hours all
this occurred.

Later that night I went on the internet to see what the standards for a pavment
for cars and then for 10,000 lb trailers. I saw that you needed :

quotes from contractors, you may be confused as to how thick your driveway needs to be.
This article will discuss driveway thickness.

Weight:

How thick the concrete required for a driveway is based on the weight of the vehicles
that are going to be using it. Most households with cars, trucks or SUVs can suffice
with a concrete slab that is four inches thick. This is based on vehicles weighing
10,000 lbs. or less. To give an example, an average SUV or pickup truck weighs between
4000 and 6000 lbs, and even a boat on a trailer generally isn't more than 8500.

Where you will see the need for a thicker driveway is if you plan to have heavier
vehicles on it. For the average household, that larger vehicle is often an RV. Most
RVs start at 10,000 lbs. and go up to 30,000 (which doesn't necessarily take into
account extra weight loaded into it). So if you are looking to find a place for your
personal RV, you'll want to go up to 5 or 6 inches of thickness for your concrete
driveway.

Thicker Better for Preventing Cracking?

Concrete will crack. Period. However, thicker doesn't always mean you are getting a
guarantee of less cracking. Generally, cracking is caused by other factors that can
relate to thickness, but are not caused by the thickness. For example, as mentioned
above, if too much weight is put on a thinner concrete driveway, yes, it can ultimately
lead to cracking. Another major cause of cracking is not having a solid base beneath
the driveway. Concrete does its best on solid surfaces that have no movement. In areas
where the ground is mostly sand or clay, severe cracking is more likely to happen. And,
in such cases, a thinner poured driveway would suffer faster than a thicker one.
However, a good contractor will know how to lay a proper base to prep the land for
the concrete slab, so whether the driveway is four inches or five, precautions have
been taken to protect it from excessive cracking. Likewise, the use of wire mesh or
rebar (reinforcing bar) in the laying of the concrete will hold the integrity of the
concrete longer, regardless of the thickness of the slab.

Price Differences

Although pricing for the job itself has many variables and can fluctuate across the
country, it is approximately 20% more concrete cost to go from a four inch thick slab
to a five inch thick slab. However, adding that extra inch boosts your driveway's
weight capacity by 50%.

If you do go with the four inch thickness, you'll save money because that thickness
doesn't require rebar to strengthen it. Most contractors use the above mentioned wire
mesh that is considerably cheaper and still very affective.

the next day I went to tucson and then when I got home about 5pm I had a visit from Bill
Acker at about 520 pm. He drove in a pickup truck with another individual. I was in the
house and heard someone yelling outside. I went outside. Bill ackerman identified himself.
and this was not the individual that I was dealing with as signed on the contract. He
wanted to know why there wasnt full payment. I responded that at this time there wasnt
goods and services were not performed as the salesman had promised. He said
that it was his nephew. I then told him that I will be sekking an attourney tomorrowand
will have him contact him. And that I had mailed him a certified and return receipt letter
to the address given to me. To please read and respond. I have nothing further to say.

I went into the house and about 5 mins I heard someone yelling. So I went out. Mr
Ackerman disclosed to me that he was a mason. I asked him, what degree? He responded
third degree. I asked what lodge and he said told me of a lodge in LA that I dont
remember now. He asked me where was I member? I told him my Lodge was Huachuaca #53
here in town He said he would see me at my next meeting at lodge. I said, fine

Mr Mr. Ackers is very congenial. He approached my 89yo father in Kennewick with an unsolicited offer to pave his large old driveway in 2012 and Dad said no. Mr Ackers came round again in 6/2013. He offered to pave a short 20ft segment at a rate that was excessive by local standards(3K). My old dad agreed for reasons unknown, even in retrospect, to pave a 20ft section. Large trucks full of hot tar and gravel arrived within minutes and over the long day section after section were proposed by Mr Ackers and agreed to by this old man. By the end of the day a section measuring 120 ft (for $20K) had been completed. Dad didn't understand how he could have agreed to such a massive project or expenditure on less han one single days notice but "the trucks and men were just there".
I understand from others that Mr Ackers seeks out potential costumers, offers a modest project, and expands from there, the elderly or gullible having difficulty saying no to such a strong sales pitch. True, this is the American business model and buyer beware. But my old Dad had no use or ability to afford a $20k paving project and was persuaded (bamboozled) by a expert salesman on his doorstep. No laws were broken. But I would take great care if Mr Ackers comes around your place offering to pave just a little piece of your driveway.... [redacted], ** Seattle

Review: The situation happened on Thursday October 10th around 2:30. I, [redacted], was coming home when I saw a guy in a white truck in my driveway. As I pulled in he came up to my car window and explained to me that he is an asphalt contractor and is doing a job about a block away. He said that there was going to be a little left over from the job and would give us a really good deal. I told him he would have to talk to my fiance [redacted]. We had just got concrete laid in our garage so there was about a 3 inch dip from the concrete and gravel outside, therefore, [redacted] told the contractor yes it would be nice to lay a slop from the gravel to the concrete. The contractor said he would do it for half price 25$ per yard. [redacted] and I were told that there wasn't going to be much left since it was left over from a prior job. We asked the contractor numerous times what the estimated end total was, he always avoid the question; but said he would do a good job and if we were not completely satisfied then we did not have to pay. When the contractor said he was done with the job he said the total was going to be 3,500$ after we complained about the price he immediately dropped the price to 2500$. 2500$ is not what we feel is laid in our driveway; when I measured there was approximately 125 square yards and varies from an inch to an inch and a half think. We never agreed to that much pavement and believe that in the near future it will crack and deteriorate. There is still a gap from the asphalt to the shop, it is wavy and completely covers one of my rain gutters. I am not satisfied with the job nor did I want was much as they laid. We were taken advantage of and scammed.Desired Settlement: We would gladly pay for the slop that we agreed on.

I had mr aker pave my driveway and I was so impressed by the quality of the work and his equipment at no time did I feel pressured to buy but with the great deal I could not afford not to pave I seen another review and they was not happy but I think it must have been a person who was mad because his father spent some money he was looking foward to when his father passed away I dont understand kids who worry about their inheritance when their parents worked hard and made money and want's some reward to show for their hard work the kids are just counting their parent money before their parents a dead

Review: On 09/21/2013[redacted] of Asphalt Paving Contractor had put done asphalt on her driveway for $7000.00.[redacted] has now being seeing the asphalt coming up like little volcanoes (8 to 10) of them have been found and weeds are forming inside of these holes and growing more and more. There was floating water in these holes also.Bill Acker also informed [redacted] that if had any problems or concerns to call him.[redacted] has tried to call [redacted] many times, but both his cell phone and office phone are no longer in service. She has a warranty also with this company.Desired Settlement: [redacted] would like a refund, more of a professional job done. If not going that route, then would like the driveway completely redone.

Review: We hired Mr. [redacted] on 9/5/13 to pave our driveway. The initial quote he gave us was $4-5,000 for the area covered for 2" deep asphalt driveway. He ended up charging us $7,000. We ended up paying the price. However, now the driveway is falling apart and has holes in it. It is only 1/2" deep on the inside where you couldn't tell the depth.Desired Settlement: I want Mr. [redacted] to refund a minimum of 75% of his product since it is not the product he claimed and we will end up having to tear it up and replace the job.
