We hired Bill Jacobsen Enterprises to build a driveway to our rural property on ***. The driveway was lost with the widening of the road and permitting took quite a bit of time and effort with the county and our attorney. We do not live in the area, but drove down to see the driveway in late December 2016. Though we were told it would be completed by then, there was still some work remaining. One was, unfortunately, that our tenant rancher could not accommodate Bill's schedule to cut the fence and install a gate. Hence, Bill stopped at the fence, leaving a little extra fill dirt, but otherwise a truncated driveway that just drops off at the fence. The tenant rancher apologized, has since installed the gate, and is willing to complete the driveway himself but needs the remaining fill dirt and shell topping. We mentioned this to Bill when down there in late December with no objections other than that the concrete driveway had to now cure and that more dirt earlier might have enabled the cows to escape. In early January we paid Bill the remaining balance of $12,755 after a good faith down payment of $5,000 at the outset.

Desired Outcome

Finish the job Ideally we would like Bill to finish the job. However, we recognize that the delay was largely caused by the fence not being open, so we merely request that the remaining material be delivered so that the tenant rancher can complete the driveway past the fence. We would appreciate that be coordinated with the tenant rancher (which Bill has met and has his phone number) and that the materials be of the same quality, in sufficient quantity, and this all be done in a professional manner.

I have gone the extra mile for this customer and I am truly sorry he is still not satisfied. I worked off and on since Sep.9th 2015 on this project for him with the state, the county, and his attorney, I made many trips on his behalf to the Building Dept. and his future job site. Which he moved on me several times. Answering hundreds of his questions some the same over and over again. During the 12 months before a contract was signed July 28th 2016 I received and read and answered 93 emails from him and all on his behalf or for his aggrandizement. After the contract was signed I have 58 pages of email correspondence with him asking me to send the county/state questions. During that whole year without knowing if I had the job or not. I asked him for 100. dollars to help me out with office supplies and gas. I told him if I got his job I would take the 100. off his bill. He never sent me anything to compensate me for all my hours of hard work on his behalf. He circumvented me. The reason it took so long the customer did not want to do the driveway the way the county/state wanted him to have it done. He had me rebid the job at least six times. I had to keep going through the proper channels with the Government agency's. On Aug. 19th 2016 I obtained as per the contract a Right-A-Way permit to install a driveway and 2 sets of different size pipes through the Right-A-Way 100' feet off the edge of road pavement to the existing fence. The afore mentioned fence is on the property line 100' off edge of pavement.I have the drawings from the County/State engineers with all the requirements to install this driveway through the Right-A-Way only. Not on my customers private land pass the fence. Nor does the contract say I will be working on his or any private land, only the Right-A-Way which belongs to the state/county. I hold all the proper special licenses/insurances to work in the Right-A-Way. At my request after customer signed the contract I asked for pipe money so I could purchase the pipe for him and have delivered he sent 5,000. We called it good faith money. My foreman on the job advised me that on the other side of the fence the Right-A-Way driveway we were installing to all County and State requirements was going to have a drop off onto customers private property. Out of the kindness of my heart I told my foreman to put as much dirt as he could on the other side of fence on customers private property as a courtesy to my customer. So he put so much dirt over the fence it looked like if he put any more the cows could climb out. Their was plenty of dirt on the other side of fence so no one could say the driveway was cut off hence the word truncated. Thinking I will have a happy customer. In late "December" I met with the customer at the job site and we both agreed that the job could use more dirt on other side of fence. The concrete needed to cure for 30 days before any dump truck could drive on it and he agreed. We still had a day or two to finish up the job before calling for a final inspection. The job had already had 2 inspections that had passed. However the customer was looking for reasons not to pay me the total amount for the job.1)He said the driveway looks like it is not wide enough as per the contract. He made me find a tape measure and measure it for him. The driveway was 14' wide exactly like the contract required. 2) Then he said that the 100' wide Right-A-Way has some litter. This is a state highway about 100 vehicles go by this job every hour. So in a 24 hour day that's 2,400. We have been picking up litter everyday since we started this job. I told him my guys will pick any and all up as needed.3)The sod is not dug in as good as it should be. I told him we will take care of that before final inspection.3)He kept saying it does not look like a driveway over and over. 4) Than he said the shell part of the driveway does not look like shell. The tenant rancher helped me out with this insult and calmed him down. They started digging to see how thick the shell was. The shell was to proper elevation. A couple of weeks later the remaining balance for the job came in the mail from the customers mom. Now I hear from him approx.; 4 months later that he wants me to buy more dirt and shell to build a road on his private property for free and he said that I truncated his driveway. I think he used the wrong word for ending the driveway. Nothing was cut off. He should have used the word tapered off mitered off. There is no part cut off. Since a gate was put up.I never said I was going to build him a road for free on his private property on the other side of fence. The other side of fence on private property was never mentioned for over a year of over 150 emails total, which was almost 58 pages of correspondence and on the contract or on the Right-A-Way permit. Nor did the approve site/plan by the building dept. drawing from the county/state engineers have any wording about going onto private property. I agree that to finish off the driveway on his private property that the job needs more dirt and shell but not at my expense. Anybody can do this job with no licenses required on private property. In all honesty your mother owns the land on the other side of the fence that we have been discussing not you. Ask her for some dirt she has more dirt on all those acers than she knows what to do with. Billions of yards of dirt. Enough to build many thousands of driveways. I have no free dirt for you sorry. I gave you all the charity and good will you deserve. Time for me to move on to my next lucky customer. BTW for the record you are the first person in my *** year career that has mentioned anything positive or negative to the Revdex.com. They did not even have my email until now. I had to receive your stupefaction by land mail.

It is clear from the above response that Bill does not intend to finish the driveway. However it is only a reasonable expectation that we contracted for a complete driveway. Surprisingly, Bill is objecting when there is so little left to do, but enough that it would be difficult to use as a regular driveway. As for the shell, I told Bill that my shell driveway experience was from south Louisiana where I lived previously, so I was surprised when this seemed more like crushed gravel. Lastly, as I mentioned when we met in late December and again after seeing the driveway in late February, the driveway needed the balance of materials to be complete. We mailed him the full balance due within 2-3 days of his final invoice based on trust that the driveway would be completed, ie, that at least the remaining material would be delivered. When he objected after being paid, we asked what then was reasonable, but have had no cooperation.
