We have not "stolen" tools from DeJager's trailerWe did remove materials that were already paid for through our draws with the bankIt's a good
thing we did, because while we were under the impression that DeJager was going to be working on getting our deposit back like he had said after we spoke at the bank, he jumped the gun and decided that we were in breach of contract, hired an attorney and began sending us letters demanding even more moneyAs you can see in the contract, the builder is actually the party to breech the agreement
Not one thing DeJager has said adds up to any sense and many people have born witness to these theatricalsIf you look further into the four companies DeJager owns they are not new to this type of issue with all sorts of cases pending, guilty verdicts and monies being paid back
Ultimately, as you can see with the statements that DeJager has provided we have paid in a large amount of money and only have footers and a septic tank to show for itDeJager has been paid $46,and we have had the following work done; Excavation $3200.00, Sewer $4275.oo, Footing Labor $1500.00, ICF Materials that we removed from the trailer on our property $10,That leaves a difference of $27,that we are still owed for this builder defaulting on the contract
This all came about because he said that he required all of the money for logs ahead of the delivery, but the bank, as well as our common sense, said that significant progress would have to be made on this build in order to receive another draw (the April requested draw for $19,826)It is not common practice, or industry standard to be so far ahead on the buildNor is it industry standard to pay for all the materials prior to inspecting themWe called and spoke to several banks, log brokers and companies, including the one *** DeJager said had our deposit and none of them had a deposit for him, us or any of his companiesEvery single one of these companies said that industry standard is 50% up front and 50% upon delivery and many went on to say that it didn't sound right that the builder was behaving this way trying to get so far ahead of the build
We offered to pay the lumber company directly because the bank has zero faith in this builder so that we could continue the project that is already months in with only footers and we were under the impression that DeJager was trying to rectify the issue he was having with our deposit and was going "to make some calls"It's a good thing that we followed the advice of our attorney and removed the materials that we had paid for because it is evident that this builder NEVER had any intention of making this right when he showed up and ripped the temporary loop out and removed his trailers prior to receiving a response from us or our attorneyDeJager was content to walk away with $27,of our money and not think twice about it
We would like the sum of $27,to be returned to usThere is no deposit that he placed with a log company and I think he is operating in the red from misappropriating fundsHis intentions show that he was trying to get the second 50% for the logs while never paying on the first 50% to a log company and always getting further and further ahead without work doneWe know this because we called the log company that he mentioned and they don't have ANY deposit
We do want to make sure that materials and work that were performed are paid forWe don't want to be dishonest about that
