Customer placed an online order on 8/29/2015 for the 30-day product supply on a... trial period basis. They paid one charge of $3.95 shipping and handling for a 30-day supply of the Biofinite. Every customer is given the option to try their first 30 day supply without charge for 14 days from original order date. During the 14 days, if the customer is not satisfied with their product, they are to contact customer service via phone or email with a notice of cancellation and the product must be postmarked for return within those 14 days. If the customer keeps their 30 day supply after 14 days from the date of order, they are automatically billed for the product and then billed and shipped a new 30 day supply every 30 days thereafter. The customer has the ability to cancel at any time by calling customer service or emailing [redacted] . If a customer needs to contact customer service, the phone number is listed on [redacted] , the product, the pamphlet that arrives with their order, and the package the product is shipped in. The terms are disclosed clearly on [redacted] where the customer would have ordered the product. The customer also has to click “I agree to the terms and conditions” twice before the order is processed. If the customer does not click the box to agree with the terms, the order will not process. The terms and conditions are disclosed directly on the ordering website, at the bottom of the first page, and also highlighted in a large white box on the second page where the customer inputs their billing information, as well as sent out with the product. As Mrs. [redacted] did not contact customer service during their trial period or return the product, they were automatically billed for the bottle on 9/13/2015 and then again on 10/13/2015 for a replenishment bottle as explained in the terms and conditions agreement. The first attempt to cancel with our company was made on 1/12/2016 via written letter. Mrs. [redacted] was immediately sent a confirmation email regarding the cancellation from any future orders of Biofinite as stated by the terms and conditions. As we are fully invested in customer service, we have issued the requested refunds of $175.26 back onto the card. This is a full refund being processed back onto their card for the items they have in their possession. We ask the consumer to agree to the terms and conditions twice before processing the order to verify that they have read and understood them completely. We provide a synopsis on the website, and a brochure with a paper copy for them as well.

a 14-day trial basis placed by Mrs. [redacted] on 07/22/2015. We provide this trial for consumers to receive the item and try the product to determine if they wish to continue with the item. The stipulation of the trial period, is to make this decision within 14-days if they chose to cancel. If the item is kept outside of the trial period, they are charged for the original product at the retail price of $87.63.
The original trial order was processed on 07/22/2015 at $4.95 for shipping and handling. The original email confirmation will verify this date, and we can provide a copy of the account if necessary to verify when the order originally processed. We shipped the item the next business day, and the trial period was started.
The first attempt to cancel was made on 08/11/2015. Mrs. [redacted] verified with a customer service representative that they were cancelled from all further billing and shipping. Due to the nature of the call, the consumer was offered to keep the bottle at the discounted rate of $43.82 which Mrs. [redacted] declined in a recorded call and account was successfully closed.
In regards to the collection notice, we apologize for any inconvenience this has caused the customer as the notice was mistakenly sent via a third party collections agency. Mrs. [redacted] I does not owe BioFinite any payment for product or services and can disregard the notice. We can assure the customer that this will not show on her credit report. We have taken the necessary steps to make sure this does not occur again. The customer is welcome to contact us directly if they would like any further information.

Mrs. [redacted] placed the order on 8/09/2015. This is when she paid the initial $3.95 for shipping and handling and this began the trial period to sample from the initial 30 day supply she was sent. Since there was no notification of a request for cancellation and/or a returned product during the allotted time, the customer was automatically billed in the amount of $87.63 for the 30 day supply on 8/24/2015 as explained in the terms and conditions which she agreed to. The consumer contacted Biofinite on 8/28/2015 with an email request for cancellation. The account was cancelled immediately as instructed and the customer was sent a cancellation confirmation via email. We have refunded the customer for the Biofinite charge in the amount of $87.63 due to this complaint, however, we stand by our policies and we would like to reiterate that our customers accept the terms and conditions two separate times to process their order. We state the terms and conditions clearly, and send a synopsis card with our contact information, with each order. Terms and conditions are located on all ordering websites, and should be read as they are there for a reason. Please refer to our website www.biofinite.com or https://biofinite.com/try.php. our Customer Service Department at 1-855-864-3158 or [email protected].  Your order will be deemed accepted upon its shipment and your receipt of a shipment confirmation of your order.  Processed orders will be shipped according to the terms of our shipping policies, which are summarized herein.While we want everyone to be able to enjoy our Merchandise, we may, in our sole discretion, not accept an order or limit or cancel quantities purchased per person, per household or per order.  Some reasons we may do so include, but are not limited to, the following:
Orders that, in our sole discretion, appear to be placed by dealers, resellers or distributors.
Orders that appear to be shipped to a freight forwarding company for reshipment.
Orders that cannot be processed as a result of incorrect or invalid billing, shipping or payment information.  Be sure to double-check your information when placing an order.  We cannot process orders for several reasons including, but not limited to:

Orders, in our sole discretion, that we suspect to be fraudulent.  We reserve the right to cancel or not accept any order that we suspect to have been placed as a result of fraudulent activity.  We further reserve the right to cancel or not accept subsequent orders from customers with a previous fraudulent order history.

C.  Arbitration Agreement and Class Action Waiver.  Except where prohibited by law, you and Biofinite agree that any dispute between us (including disputes against any agent employee, subsidiary, affiliate, predecessor in interest, successor, or assign of the other) relating to our Website, the information, services, software functionality, and/or materials (“Services and Materials”) published by Biofinite on or through the Website, any transaction or relationship between us resulting from your use of our Website, communications between us, or the purchase, order, or use of our Merchandise, will be resolved exclusively and finally by binding arbitration and the arbitration decision may be enforced and judgment entered thereon in any court of competent jurisdiction.  Any such arbitration will take place in the county or municipality where we have a principal business address or such other location where we mutually agree.  We may also mutually agree to have the
arbitration conducted by telephone or based on written submissions.  You and Biofinite agree that this arbitration agreement is made pursuant to a transaction involving interstate commerce and shall be governed by the Federal Arbitration Act (“FAA”), and not by any state law concerning arbitration.  You and Biofinite further agree that any determination regarding the applicability, enforceability, or validity of this arbitration agreement will be made by the arbitrator, not by any court.BY AGREEING TO THIS ARBITRATION AGREEMENT, YOU ARE GIVING UP YOUR RIGHT TO GO TO COURT, INCLUDING YOUR RIGHT TO A JURY TRIAL.  In arbitration, a dispute is resolved by a neutral arbitrator or panel of arbitrators, rather than by a judge or jury.  Arbitration is more informal than a court trial; however, an arbitrator can award the same relief that a court can award.  The arbitration will be administered by the American Arbitration Association (“AAA”), and conducted under AAA’s Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (collectively, the “AAA Rules”) then in effect at the time of the dispute.  You may obtain copies of the AAA Rules and forms and instructions for initiating arbitration by visiting the AAA website at www.adr.org, or by calling AAA at (800) 788-7879.  If you initiate arbitration, Biofinite will reimburse you for any standard filing fee which may have been required by AAA once you have notified Biofinite in writing and provided a copy of the arbitration proceedings.  However, if Biofinite is the prevailing party in the arbitration, applicable law may allow the arbitrator to award attorneys’ fees and costs to Biofinite.  If for any reason the AAA is unavailable, the parties shall mutually select another arbitration forum.There shall be no right or authority for any claim to be arbitrated on a class action basis or in a purported representative capacity.  No claim submitted to arbitration is heard by a jury or may be brought as a private attorney general.  You do not have the right to act as a class representative or participate as a member of a class of claimants with respect to any claim submitted to arbitration.  The arbitrator may not consolidate more than one person’s claims against Biofinite and may not preside over any kind of representative or class proceeding against Biofinite, its agents, officers, shareholders, members, employees, subsidiaries, affiliates, predecessors in interests, successors and/or assigns.  You acknowledge that this class action waiver is material and essential to the arbitration of any disputes between the parties and is non-severable from the agreement to arbitrate claims.  If any portion of this class action waiver is limited, voided, or cannot be enforced, then the parties' agreement to arbitrate shall be null and void.  YOU UNDERSTAND THAT BY AGREEING TO THIS ARBITRATION AGREEMENT, WHICH CONTAINS THIS CLASS ACTION WAIVER, YOU MAY ONLY BRING CLAIMS AGAINST BIOFINITE, ITS AGENTS, OFFICERS, SHAREHOLDERS, MEMBERS, EMPLOYEES, SUBSIDIARIES, AFFILIATES, PREDECESSORS IN INTEREST, SUCCESSORS AND/OR ASSIGNS IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING.  IF YOU DO NOT AGREE TO THIS ARBITRATION AGREEMENT AND CLASS ACTION WAIVER, YOU MUST TELL US IN WRITING, AND NOT USE OUR PRODUCT OR WEBSITE.
D. Billing and Cancellation Terms for Trial.  As one of its product offerings, Biofinite offers consumers a recurring shipment/subscription plan (“Subscription Plan”).  If you sign up for the Subscription Plan on the Website, you will be given the opportunity to try out the product for a period of 10 days (starting from the day you receive the product) without paying any money except for the cost of shipping and handling.  At the time you sign up for this Subscription Plan, the credit or debit card you provide will be charged the shipping and handling fee, and you will be mailed one bottle of Biofinite.  If you cancel the Subscription Plan within the first 10 days from the day you received the initial order by calling 1-855-864-3158 or emailing [email protected], you will not be sent any more bottles and your subscription will be canceled.  If you cancel and your subscription will be cancelled and you will only be charged the initial shipping fee.  When emailing us, please include your full name and address, as well as the name of the Merchandise that you ordered.  If for any reason you are charged for the cost of the Merchandise but you have canceled your Subscription Plan within 10 days of your receipt of the Merchandise no later than the 10th day after you received the initial order, then please call us at 1-855-864-3158 to obtain a refund for $87.63.  Please allow up to 30 days for refunds to process.If you do not cancel within 10 days of receipt, the card you provided will be charged $87.63 for the bottle you received.  Until such time as you cancel, approximately 45 days from your original purchase date and every 30 days thereafter you will be sent another bottle of Biofinite and your credit card or debit card on file will be billed for $87.63.  You may cancel your membership at any time by simply contacting customer service by calling 1-855-864-3158 or emailing [email protected], but you will be responsible for payment for any Merchandise that has either A) already been shipped to you or B) already been delivered to you at the time you cancel.  Once received, your request for cancellation, whether by phone or email, will be processed within 3-5 business days.I UNDERSTAND THAT IF I PURCHASE A SUBSCRIPTION PLAN, THIS CONSUMER TRANSACTION INVOLVES A NEGATIVE OPTION, AND THAT I MAY BE LIABLE FOR PAYMENT OF FUTURE GOODS AND SERVICES UNDER THE TERMS OF THIS AGREEMENT IF I FAIL TO NOTIFY BIOFINITE NOT TO SUPPLY THE GOODS OR SERVICES DESCRIBED.We reserve the right to modify the prices charged for any products we offer, or to add or remove any products or offerings from the Website at any time without prior notice to you. The consumer placed the order on 7/05/2015. This is when they paid the initial $1.99 for shipping and handling and this began the trial period to sample from the initial 30 day supply she was sent. Since there was no notification of a request for cancellation and/or a returned product during the allotted time, the customer was automatically billed in the amount of $47.33 for the 30 day supply on 7/27/2015 as explained in the terms and conditions which she agreed to. As there was no cancellation the membership continued on a monthly basis with charges of $47.33 recurring on 8/26/2015 and 9/25/2015. The consumer contacted Biofinite on 10/11/2015 with a request for cancellation. The account was cancelled immediately as instructed and the customer was sent a cancellation confirmation via email. Based on the nature of the phone call a single refund of $47.33 was issued immediately. The refund will take three to seven business days to fully process. The customer would have received an e-mail confirmation for the refund credited to the account.
We have refunded the remainder of the amount charged to the customer for the Biofinite in the amount of $94.66 due to this complaint, however, we stand by our policies and we would like to reiterate that our customers accept the terms and conditions two separate times to process their order. As Mrs. [redacted] did not contact customer service during their trial period or return the product, they were automatically billed for the bottle on 9/13/2015 and then again on 10/13/2015 for a replenishment bottle as explained in the terms and conditions agreement. The first attempt to cancel with our company was made on 1/12/2016 via written letter. Mrs. [redacted] was immediately sent a confirmation email regarding the cancellation from any future orders of Biofinite as stated by the terms and conditions. As we are fully invested in customer service, we have issued the requested refunds of $175.26 back onto the card. This is a full refund being processed back onto their card for the items they have in their possession.
We ask the consumer to agree to the terms and conditions twice before processing the order to verify that they have read and understood them completely. We provide a synopsis on the website, and a brochure with a paper copy for them as well.

They never again tried to bill my credit card for the balance. Never again did they contract me saying I owed anything. The only charge I paid was the $3.95 charge which is above. They easily could of bill my credit card for they had the information and this is usually how it is done. I would have then fought this with the credit card company. I never did receive a bill in the mail. I do receive my mail for I receive this from you. I do not owe for this product, it was returned. This is ridiculous that they did not try to even contact me once about this. I have left them two messages. Not very nice in the last two days and they once have not returned my call. Cancellation needed to occur within nine days of receipt, with results not evident until thirty days of use.When the business was called about this the representative started giving different information/stipulation like noted days started counting when order made and that this information was displayed when order made. This information was not seen and it was looked for when ordering. The product was returned and the representative was told of the cancellation. As noted the complaint is with the misleading language about a free offer that is not free. That the true terms were not clearly stated. Review: Sent a 14 day trial bottle of skin cream. Instead it was a month supply. This was to be purchased for over 80 bucks. Could be sent back before the 14 days is up. It took five days for it to arrive! Plus I have to send it back and I have to go to the P.O. And pay the postage and packaging! Since there was no notification of a request for cancellation and/or a returned product during the allotted time, the customer was automatically billed in the amount of $47.33 for the 30 day supply on 7/27/2015 as explained in the terms and conditions which she agreed to. As there was no cancellation the membership continued on a monthly basis with charges of $47.33 recurring on 8/26/2015 and 9/25/2015. The consumer contacted Biofinite on 10/11/2015 with a request for cancellation. The account was cancelled immediately as instructed and the customer was sent a cancellation confirmation via email. Based on the nature of the phone call a single refund of $47.33 was issued immediately. The refund will take three to seven business days to fully process. The customer would have received an e-mail confirmation for the refund credited to the account.We have refunded the remainder of the amount charged to the customer for the Biofinite in the amount of $94.66 due to this complaint, however, we stand by our policies and we would like to reiterate that our customers accept the terms and conditions two separate times to process their order. Review: I agreed to a free sample of biofinite and a one time charge of the shipping fee which was only $3.00, they then waited for their fourteen day period trial subscription to charge 87.63. I did not agree to their trial subscription nor did they send any information or include any information on cancelling the trial. They made it very difficult to contact them and when I disputed the charges they told me they were not refunding my money. This business is very shady, they never sent an email or a letter or anything notifying of the subscription nor the charge. I have not received ANY products from them for the trial so they basically charged me the 87.63 for nothing. I did not agree to this subscription and I want my money to be refunded in full or if they are never going to refund me then they need to send 87.63 dollars worth of product.Desired Settlement: Refund of my money in full

Review: I ordered a beauty product (after seeing the advertisement on Facebook). It allowed a 14 day FREE trial as long as I paid $4.95 for S&H. I cancelled the product prior to the 14 days and I also returned the product back to the company( I have a copy of my receipt from the USPS).

We provide this trial for consumers to receive the item and try the product to determine if they wish to continue with the item. The stipulation of the trial period, is to make this decision within 14-days if they chose to cancel. If the item is kept outside of the trial period, they are charged for the original product at the retail price of $87,63.The original trial order was processed on 08/10/2015 at $4.95 for shipping and handling. The original email confirmation will verify this date, and we can provide a copy of the account if necessary to verify when the order originally processed. We shipped the item the next business day, and the trial period was started.The first attempt to cancel was made on 08/21/2015. Mrs. [redacted] verified with a customer service representative that they were cancelled from all further billing and shipping. Due to the nature of the call, the consumer was offered to keep the bottle at the discounted rate of $43.82 which Mrs. [redacted] declined in a recorded call and account was successfully closed.In regards to the collection notice, we apologize for any inconvenience this has caused the customer as the notice was mistakenly sent via a third party collections agency. Mrs. [redacted] does not owe BioFinite any payment for product or services and can disregard the notice. We can assure the customer that this will not show on her credit report. We have taken the necessary steps to make sure this does not occur again.
