Answer to Revdex.com Complaint [redacted] Mr [redacted] complained about a broken fence The fence was fixed on 11/7/ Fencing is not a health or safety issue, it is also not a habitability issue It is not a requirement in Texas to have or fix a fence on a rental property

Complaint: [redacted] I am rejecting this response because it is a lie.I was mailed the following paper from Birdy properties stating that they transferred my security deposit to [redacted] for Rent Regards, [redacted]

This tenant was informed that he signed a lease that stated the refrigerator would NOT be repaired or replaced at the Owners expense He was informed that we would remove the old one and he would have to purchase a new one in accordance with his signed *** Lease He stated that he would
keep the old one, he then proceeded to unplug and plug back in the old refrigerator numerous times over the past weeks which is what created the problem yesterday He cause any obstruction and mildew growth by his own actions We informed the Owner of the property and he graciously decided to purchase a new refrigerator for the tenant, even though he was not required to do so This information was passed on to Mr*** on the same day of his complaint The *** Lease states that a property manager has days to attempt to cure a problem reported by a tenant We cured the problem in day, so I do not understand why this complaint was even filled Yesterday our maintenance technicians wasted hours trying to get a hold of Mr***, he would not answer either his phone or his door We had to email him numerous times to inform him that our technicians where at his property Today we are having the same problem, we have his new refrigerator ready to be delivered but he will not respond to our email or phone calls We are trying to deliver him a brand new refrigerator day after his turned in his maintenance request I believe that we have gone above and b**ond for this tenant I do not believe a Revdex.com complaint should be allowed to be filed if the individual doesn't even give the company time to provide excellent service We could not have done a better job, but here we are having to respond to a complaint

Answer to Revdex.com complaint *** Mr*** stated that he paid a $cleaning fee upon move in. This was actually $that was added to the deposit and it was a "Refundable Deposit" which means if the home would have been left clean upon move out, it would have been refunded in full
The Final Walk Out stated that some spots in the home needed cleaning. Mr*** says that they stated the home was clean, and it does state that it was clean but missing some spots. The charge of $for cleaning was for the areas that were missedConcerning light bulbs that Mr*** claims we charged $for that "magically went out" after they turned their keys in, Birdy Properties uses the final walk through to identify which light bulbs needed replacing and the Residential Lease Item 17A(4) states that the tenant is responsible for light bulbsConcerning the satellite dish charge of $to remove and the towel holder that they purchased (we credited $for the towel holder itself, parts only), these items were credited to Mr*** in December of check #that Mr*** came by our office to personally pick upThis check was for $Birdy Properties will not refund Mr*** any more of the security deposit funds used to pay for repairs that were authorized to deduct per the Residential Lease and the Texas Property Code

The tenant could not provide proof that the light bulbs were working upon move out or that the home was clean Birdy Properties has provided proof in photos to the prior tenant of these items needing completed at the time of move out

I am rejecting this response because:I find that it is customary in *** for landlords to fabricate information against *** *** or *** tenants. I am not going to allow this one to to be dismissed. *** is full of mold, oak spores and rag weed. The refrigerator is years old with dry rotten gaskets. I cut the refrigerator off every days to make peace between myself and Birdy Properties. Th** provide a lease that states that th** are not responsible for any appliances or the maintenance of said appliances. My next door neighbor got a bill for $for a toilet seat. The neighbor next to her had to contact an attorn** to have an air conditioner put in. Th** have another clause in their lease that states that all rent payments first go to penalties and after the penalties are paid, then the payments will go to rent. This is in violation of TREC ( *** Real Estate Commission ) law. Birdy Properties is a closely held family business which according to the FASB ( Federal Accounting Standards Board ) is ripe for fraud. Officer Wilson and my attorn** ( *** ) from the Coquat Law firm stayed here on March 31st, for hours waiting for the refrigerator to arrive. Officer Wilson and my attorn** were here when Birdy Properties called and lied that th** came to my house at 12:PM and I was not here. Th** were appalled. Birdy Properties does not realize that I have renters insurance from Farm Bureau Insurance. I had to go to the emergency room for a lung infection that the mold caused me. Birdy Properties did not offer me any assistance for the amount of food that I lost

The answer to the original complaint was not a lie Here are the facts: This tenant signed a lease with the previous Owner and gave them the security deposit That Owner had the home foreclosed on and the Ownership changed to *** *** ***, LLC who hired Birdy Properties to manage the home for them We informed the tenant of this change by providing a TAR which let them know that we did not have any security deposit funds because the previous Owner did not provide them to us The property was then sold to *** *** Rent and we provided the required TAR to inform the tenant that the home again had transferred ownership and that Birdy Properties would no longer be managing the home, on this form it again stated that there was no security deposit funds being transferred since Birdy Properties was never in possession of any security deposit funds If the tenant has an issue with the security deposit funds they need to address the original Owner of the home in which they signed the original lease and gave the security deposit funds to They are the ones responsible to return these funds to these tenants

Answer to Revdex.com Complaint [redacted] Mrs. [redacted] complained about her security deposit.  This property was foreclosed on during the lease with the original landlord (DTND Sierra Investments, LLC) of the property.  If Mrs. [redacted] paid her security deposit to the original landlord those funds...

were not transferred to the current owner ([redacted], LLC) or Birdy Properties.  When the new lease was prepared the security deposit amount being held was listed as $0.00, because the amount of security deposit Birdy Properties had was $0.00.  Mrs. [redacted] also complained about a pet deposit for a service animal, and the newly prepared lease clearly states in Item #12a that Ghost (Service Dog) was listed as an occupant and not a pet, there was no pet deposit for pet form because Ghost was an occupant of the home.  Birdy Properties no longer manages this home as of 1/31/2015

I am rejecting this response because: I fully understand that the tenant is responsible for lightbulbs, however I was charged $60 to replace lightbulbs, which were ALL working when we turned in the keys.  I didn't know we rented from a company that was wasteful and threw out good/working lightbulbs.  The $220 was a ridiculous amount of money to charge for cleaning "some" spots of the house. I guarantee you they did NOT cleaning anything because I cleaned that house with my wife for over 8 hours after we moved everything out of it. The house was cleaner when we left than when we moved in, yet we got charged for leaving the house in BETTER condition than we found it in.  Yes, I did get a refund for the satellite dish, after I had to prove I had cable for the one year I lived there because they didn't know their own property or they would of know that there were two satellite dishes on the house before we moved in.

I am rejecting this response because:  3 Days and only after the City Code inspector made a phone call:   There are no [redacted]s in any Birdy Property office or family, and there never will be, and Birdy Properties does not give back to the [redacted] Community.  The lease has every possible escape route to protect Birdy Properties from doing any maintenance on any of its properties.  The owner simply needs to find a more reliable management company with a better reputation.  The Birdy family is the lowest of the lows.  There is even a clause in the lease that states that all rents will go to late penalties, not rent.  This is in violation of the [redacted] Innkeeper laws and the TREC ( [redacted] Real Estate Commission ), and will never stand up in court.  I respectfully request that this complaint be allowed to stay on the Revdex.com website.  Alamo Service Pros is owned by Birdy Properties and you can find a copy of all of their records at the [redacted] State Secre[redacted]y of States office or you can find it at [redacted].  This company was created by and is owned by Birdy Properties so that th** can make this phantom company responsible for their irresponsible actions.  The young people th** hire are not smart enough to keep their mouths shut about Alamo Service Pro.  [redacted]  l  Alamo Service Pros ###-###-#### - Office  l  ###-###-#### - Fax[redacted]  *  [redacted]  Another law Birdy Properties continues to break is the 24 hour law.  You must notify a tenant 24 hours ahead of time that you are coming into his or her apartment.  Th** sent someone in here to measure my carpet....  3 months ago.  Still no carpet.  I offered to purchase the carpet myself.  Th** will not allow it.  This is going on my third summer here and the air conditioners have not been properly maintained.  Th** sent someone here to fix the electrical outlet, he told me he could only do 3 outlets because of a budget.  I asked them to cut the grass behind the building...  Th** sent a man and woman that were more interested in kissing and cuddling than cutting grass.  I took pictures of them.  It was not professional at all.  The entire kitchen cabinets need to be replaced.  I found a baby possum in them when I first moved here.  The draft protector under my entry door does not exist and the carpet is worn to the point that snakes, spiders or birds can come in without you knowing it.  I am taping the blinds together with black piping tape because the tip of the blinds will not stay in.  No one should have to live like this.  Birdy Properties loves to take your mon**, but when it comes to maintenance, th** don't want to be bothered.  Still no light behind the building to ward off burglars.  I told them that I had a Heart attack and wanted to move downstairs, th** ignored my request.  Such an insensitive landlord.  I cannot climb stairs because I now have a pacemaker in my heart.  These are horrible landlords.

Birdy Properties has followed the written lease and the Owner has provided a brand new refrigerator, even though not required.  All this was done with in one day of the written complaint provided to us.  Birdy Properties is a family owned and run business, a family that includes [redacted] family members and [redacted] family members and employs individuals who are [redacted] and [redacted].
