Birdy's Loft Reviews (3)

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
1. Ms. Goglia is lying.  I was never notified verbally or in written communication of her liability policy.  Never.  I will swear to this under oath.  Furthermore, I always had someone with me when I took clothes to her for consignment and when I picked them up.  They will state that I was never given written or verbal notification of her liability policy at any point in time.  I have a witness that will disprove Ms. Goglia's statement that we had a verbal agreement.
2. The dress Ms. Goglia refers to in her response is not the dress I have filed a complaint over.  I never wrote down $60 on an inventory sheet for this dress because there was no paperwork for this dress.  She simply told me she would put it on sale for $250.  I would never have accepted $60 for this dress or anything less than $250.  I guarantee the inventory sheet she has with my signature on it does not list this dress.  I only signed one inventory sheet and this dress was not on it.  I have a witness who will verify this.  Any inventory sheet listing this dress on it has been forged.  I have sent her a picture of the dress, described it to her via email, we discussed it in person with the dress present, so she is simply, once again, lying. If Ms. Goglia has any integrity, she will admit fault and pay me the $30 I have requested for damages.  This is more than reasonable.

Review: I put several pieces of clothing on consignment at Birdy's Loft with the owner, Deborah Goglia. One dress, priced at $250, had two removable straps that were lost. I took my dress off of consignment and have asked numerous times in person and in writing for Ms. Goglia to reimburse me $30 for the price of the straps plus loss of value on the dress due to loss of accessories and versatility. Ms. Goglia claims she is not responsible for lost, stolen, or damaged items and the straps to my dress were stolen. I was never notified verbally or in writing of her policy regarding lost, stolen, or damaged items before, during, or after the time I entrusted my dress to her care for consignment.Desired Settlement: I request payment be made to me in the amount of $30 for the straps and depreciation of the dress. She has refused payment higher than $10, and this is simply not acceptable. Ms. Goglia also needs to improve her business practices of properly notifying consignors of her policies before they put items on consignment with her.

Response:

All consigned items are left at consigner's risk. I take care of all my consigner's merchandise at best as I can. We had verbal agreement that Birdy's Loft will not be held liable for, damage, to loss or theft of consigner's property. The price of the dress was listed for $60.00 per "owner" choice, which is listed in her handwriting on her inventory list. Sincerely,Deborah GogliaBirdy's Loft
