Review: I went into Bishop Court to sign papers and give them the $400 deposit and was going to have my boyfriend go in to sign the papers to finalize our move-in date a later day. After a miscommunication of the bedbug adendum I talked to people around me and heard from multiple people that this place is ghetto so I decided I would keep looking. 2 days after signing my half of the lease they told me that my deposit was nonrefundable. The money order had not been deposited yet so I figured it would be an easy process. Apparently we signed an agreement the day we toured the place and submitted our applications stating it was nonrefundable but as she walked us through the paper she only told us that the application fee was nonrefundable (understandable) and that the form locked in our rate at $900 so that they were not going to raise or lower the rent on us. My boyfriend went in to check the papers and talk to the assistant manager, while there she also showed him the unit we were going to rent (in attempt to save the issue) and it was nothing at all like the models shown and he was very unhappy with the quality. They told us that if they rent the place within 30 days of when we gave the deposit we might get the money back but was vague on if we really would or not. I am having troubles accepting the fact that they get to keep our $400 when we haven't finished signing the lease and do not want to move in.Desired Settlement: I would like the $400 deposit back.

[redacted] and [redacted] applied for a 2 bedroom apartment on 2/23/2014. Their application was approved on 2/25/2014 with a standard $400.00 security deposit. [redacted] came in and paid their $400.00 deposit in a money order on 3/1/2014. Their move in date was scheduled for 3/10/2014. She came to sign the move in paperwork after signing came back in the next day to express concern over the Bed Bug agreement. The staff explained that this is a standard form, indicating that there were no bed bugs in the apartment she had rented.The Bed Bug Agreement also states that if a resident should contract bed bugs they must notify management immediately. [redacted] indicated that she had never heard of this agreement before. [redacted] then left and came back the next day to cancel her move in because she had read bad online reviews about Bishop's Court Apartments. Ms. [redacted] and Mr. [redacted] both signed an offer to rent agreement that states an applicant has 3 days to cancel their agreement with us starting from the date that they were approved. It also states that if the applicant fails to immediately enter into the agreeed residential rental agreement and pay the first months rent and security deposit, landlord may deduct from the amount received an amount equal to one day's rent for each day the premises are vacant from the date tenancy was to begin to the day the unit irs relet,not to exceed 30 days. Mr. [redacted] came in subsequently and viewed the apartment. At no time did Mr. [redacted] or Ms. [redacted] express dissatisfaction with their new apartment. He said he would get back to us the next day and that is when they cancelled their move in. He had indicated to oyr staff that they had already left a deposit at another apartment complex. The apartment was re-rented and Ms. [redacted] and Mr. [redacted] were refunded $250.00 of their $400.00 deposit per the offer to rent agreement.
