I am rejecting this response because: The statements made by *** *** are untrue. As shown on the estimates from *** ***, the first date of possible repairs due to lack of appointment time was 08-26-2017. At which time they informed me of the safety issues. *** (Black Bear Motors) does not teel you the he stated "The brakes were mushey because the brake rotors need to be turned." I took the pickup to *** * *** in Roseville because the tire was not available at anyother dealer. They also stated as show on the receipts that the tire has extensive damage and had tread seperation( This was the second estimate) After the tire was replaced, I went to *** *** in Roseville and they confirmed the rear brake rotors needed to be turned. At the same time I had the brake system flused. After the rotors were turned and the brake system fluushed and bleed, the issue of the master cylinder and brack vacumm booster was confirmedduring all of this, I attempted to get the repairs done at the least cost by getting estimates and verifications for the safety issues. As shown on the receipts, the work was done at the least expensive of the reputable dealers available. As to *** *** statements that me not giving him a chance to take care of the probles and just hitting him with repair bills is 'FALSE' we had numerous emails back and forth before one telephone conversation that did get very heated. In all of the correspondence, he denighed any resposabillity for sellin an pickup with major safety issuesYes I did take it for a test drive (Brakes were mushy and the cruise control did not work) after having the pickup checked it was determined the Horn, Cruise Control and SRS (airbag) sytems are all controled off the same electrical fuse circuit. If one safety item does not work then the others do not workAt the very least, I feel that Black Bear Motors should yhe repairs, supply a copy of the 'SMOG and Safety Inspection Certification' and take resposability for selling an UN-SAFE vehicle. AS stated by him durring our heatred telephine conversation, " "He ia a very small dealer and knows very little about cars. He sells them and once he is paid, he moves on." This dealer should be made to take resposability for his actions and not be able to just sell an unsafe vehicle and the just walk away

The truck was originally posted for $4500, but was negotiated down to $3650 due to interior condition and cruise control not working. The customer did inspect the vehicle and also took a test drive. The customer did have the option to take the vehicle to a mechanic for inspection, but did not do so....

At the time of the sale the horn, brakes, and tires were in safe working condition. Brake and lamp inspection was also passed. The customer was satisfied with the vehicle and made the purchase with a total amount of $4000 with taxes and registration. Upon purchase of the vehicle, the customer did receive a NMVTIS report. The customer did sign the buyer guide and purchase contract stating that the vehicle is sold AS IS the dealer assumes no responsibility after the sale. The customer did not purchase any type of warranty. Seventeen days after the vehicle was purchased, the customer issued a complaint via email stating that the vehicle was unsafe and that repairs were to be paid by Black Bear Motors. The customer did not give me a chance to help resolve the issue, but rather bombarded me with repair bills after owning the vehicle for seventeen days. Customer was angry and hard to communicate with. The dealer does not take any responsibility or obligation to pay for any repairs as was disclosed and signed by the customer on the buyer guide contract. Black Bear Motors did reach out to the customer via "phone call" to bring the truck in to see what the issues were. The customer did refuse and the vehicle was already repaired. The dealer does not take any responsibility or obligation to pay for any repairs. AS - IS -No Warranty Customer will pay all cost for any repairs. The dealer assumes no responsibility for any repairs regardless of any oral statements about the vehiclE as is stated on the buyer guide that was signed by the customer. At Black Bear Motors we take pride in our vehicles and when given a chance with proper communication, we do our absolute best to resolve any issues that the customer has.  Thank You Black Bear MotorsMember [redacted]
