On June 12, 2017 I gave Joe at Black Label Services a check for $4760 as a 50% down payment for 6 windows to be ordered & installed. He said they would be out within a couple days to measure the windows. I contacted Joe on June 29 because they hadn't been out to measure yet. They finally came out on July 6 & measured. Joe said it would be 6-8 weeks for the windows to come in & be installed. On August 24th, I contacted Joe to check on the status of my windows & he said that the came in but were the incorrect size. He said he had switched installers since the first measurements so he would send out his new installer to measure. The new installer came out around the 28th of August & took new measurements. Joe said he would get the windows on order and they should be in in about 6 weeks. Joe called me on September 28th (15 weeks after down payment) to tell me that he still hadn't ordered my windows because he didn't trust the measurements the latest and greatest installer had given him nearly 5 weeks earlier. He told me that he found a new installer that he could trust and he could send him out to take new measurements again & get the windows on order. Joe also told to me that he understood if I had lost trust in his company & Joe offered me my money back on September 28th. I originally told him to proceed with the order and had the installer out to measure again. After asking Joe more questions about this installer and why I should trust him, I determined I wasn't able to trust Joe & his company to get my job completed. On October 2, I talked to Joe & asked him if I could get my money back because I no longer trusted him to do the job. He said he understood & apologized for the mess. Joe told me it has been an embarrassment for his company & told me he would send me a check in a couple weeks for the down payment amount. It has been 7 weeks and I haven't seen a check. I have called every number I have for him & texted him with no response since Oct 2.

On, October 30, 2017, I spoke to with BLS's customer and reminded Mr. that it would take 4-6 weeks to send his refund check since 2 sets of windows had already been ordered and paid for as part of his project. The situation did not obligate BLS to cancelling the contract with Mr. and BLS had done so out of a display of good will by offering that option provided he understood that the refund would take 4-6 weeks. When we spoke, a check had already been in the mail to Mr.. I found that this check was mistakenly sent to the wrong address by our bookkeeping people and promptly cancelled it and sent a new check. I personally was responsible for dropping the ball in this regard and explained that to him. He graciously accepted myapology. During our conversation, we agreed that there was miscommunication and misunderstanding on both of our parts pertaining to the timing of this check. Accepting that, Mr. received the check and it cleared our accounts within a couple weeks of our conversation.

I have reviewed the response made by the business in reference to complaint ID 12512899, and find that this resolution is satisfactory to me.

In October of 2015, I gave Black Label Services a check for $2,679.00 which represented a 50% deposit for gutter installation. After many unanswered calls, Joe *** finally admitted to misappropriating my money & told me that he would be going out of business. He never took responsibility, instead blaming his demise on others. He assured me that another installer would take over the bid & set things right. Despite contacting Master Shield & Black Label Services on multiple occasions I have yet to see relief.

Black Label Services Response

Black Label Services was not aware of the lack of installation on this project until this notice. Due to actions outside of our control, Mastershield had given the dealer rights to their products to another company in MN after this contract was initiated. The project was handed off by Black Label Services to the new dealer along with the deposit monies. Since learning that the new dealer has not installed the project, Black Label Services has began to pursue them for the deposit monies. Black Label Services has been in contact with Ms. and has agreed to return her deposit since the original contract was with Black Label Services. Black Label Services will attempt to be made whole by the new MN dealer.
