Complaint: [redacted] I am rejecting this response because:Black Slate Construction ( [redacted] ) DID NOT inform us of any defective flooring materials and initially refused to acknowledge the problemIt was not until we retained a third party flooring consultant to evaluate the kitchen floor tile installation that the contractor even acknowledged the issueIf their installers had initially found the materials defective, they should not have installed them in the first placeThey should have insisted that we replace the materials or present a change order indicating they could not accept responsibility for the installation in light of the defective materialsAdditionally, if they had indicated that the materials were defective, they would not have even offered to negotiate a credit for the installationThe fact is, qualified tile professionals would not have installed the tile if they found it defectiveAdditionally, when Black Slate Construction ( [redacted] ) finally acknowledged the problem, they agreed to credit the project for the labor and agreed to replace the materials at their expenseThey did indeed credit the labor...which they would not have if they initially informed us that the tile was defective before installing They also ordered the replacement tile, but they did not pay for the order.We did not need him to reorder the tile for us since we initially ordered the tileWe needed him to REPLACE the tile at their expenseThey stiffed us with the bill after giving us the tile order informationThey stopped answering our calls and messages once we learned they had not paid for the tile order as we had agreedIn addition to the tile floors in the kitchen, the entire master bath shower must be rebuiltBecause of poor workmanship finishing the tile for the soapboxes and stcurb in the shower, we had to contract a third party to properly finish out the showerAs they initiated the work, we found that Black Slate Construction neglected to add the proper waterproofing to the backerboard jointsThey also screwed in the shower pan liner rather than gluing the liner in with proper adhesiveThey also set tile directly on sheetrock rather than installing backerboard in the soap boxes they built outIn short, they did substandard work in the master bathroom that has resulted in us having to completely redo the work we already paid for and replace the materials we had to demolish as a result of their negligence Regards, [redacted]

If their installers had initially found the materials defective, they should not have installed them in the first place. They should have insisted that we replace the materials or present a change order indicating they could not accept responsibility for the installation in light of the defective materials. Additionally, if they had indicated that the materials were defective, they would not have even offered to negotiate a credit for the installation.
