I am rejecting this response because: Your response is yet another example of your blatant misconductNow my response will intentionally be SCATHING and quite lengthyIt will relieve some stress and serve to better illuminate the issues.
Be advised I most likely have far more business and legal experience than you, a small business owner There is no need to be“careful” about the statements I made because they are completely truthful (not libel) so you can stick your threat).
On the other hand you are not being truthfulThere is no way I would have put out over $to remove my neighbors snow without having the consent "to mitigate future damage”I expressly and repeatedly told you that I would not pay for itYou said the adjuster would take care of reimbursement
That snow that was frozen solid and packed to above my roof line it absolutely had to be removed so that I would be able to remove my building’s snow in that same small alley areaAs a result of me waiting for that snow to be removed my building sustained major damage that I must also be reimbursed for
You defend yourself by boating about the reputation of your agency, one that you evidently did not startThe reputable founders likely would have handled this matter more professionally
Instead you a professional licensed( ?, E&O insured ) Insurance agent have conducted yourself horriblyHere are just some examples of your actions
1) You deny representing that I would not be responsible for the snow removal cost Further you were told this amount exceeds an entire months income from my veterans disability check and that at age I had no other income to pay for the snow removal and that it was not my snow
2) You remember our conversation regarding selling me insurance but do not recall the rest including the fact that you said that you did not have a business card but you would bring one to me or place it in my mail boxYou did not and I believe that was a deliberate attempt to escape any responsibility
3) You know that your insured's building collapsed due to NEGLIGENCEDuring this disastrous winter (inches) the more responsible building owners were removing snow from their buildingsThe age of the building, the condition,
the type of construction and the responsibility to care for the tenants property clearly indicated a need for preventative measuresThe local TV news shouted out warnings and that
Building structures (in far better condition) all around the area were collapsing under the weight of the snowIt was NEGLIGENT to ignore the warningsI guess with Nationwide having to pay for an unnecessary building destruction claim there is no money left to pay for my the damage I have and still a dealing with through no fault of my own
4) Now AGAIN there is ANOTHER incidence of damage to my propertyThrough the NEGLIGENCE of your insured clientYou received written notice of this. I have had a ton or more of debris (Ft by Ft Steel panels attached to Ft by Ft wooden studs) tossed on my building’s roof and around my property and scattered around the street caused by the demolition activitiesImagine if that NEGLIGENTLY caused flying aluminum had injured the kids playing in the nearby street.
There is a pattern of NEGLIGENT behaviorToday there is a trail of disaster debris still on the property that is dangerous and causing yet more problems for me.
I think building code enforcement and the Fire Department have cited the property violation and Posted Public Warnings
I no longer have the SAFE and quiet enjoyment of my property due to debris hitting my building and pickers day and late at night scavenging the debris.
And you do what? Nothing! I would think you would have an obligation to Nation Wide to mitigate any further damage claims by advising your client about their responsibility to use proper care and to address the damage to my property caused by the most recent demolition
For such a reputable community leader, I would expect a visit (about a mile drive for you) or at the least a phone call or other communication about the damage and repairs needed to my buildingYour behavior is unconscionable, reckless and shadyYou will not get to weasel out of your responsibility
You,your agency, Nationwide the “act of God people," continue your despicable and reckless behaviorI guess you figure you all can escape responsibility from this poor impoverished old manWRONG!

I have no ill will for my neighbor, they are not responsible for the settlement of this matterI do not know my neighbor who owns the property and we have had no discussion at all about this issueIt seems they do not know what to doI do not believe they acted maliciously to cause the problem
Had you and Nationwide handled this properly you would have found me to be very reasonable and cordialIn more than years of owning and ethically managing substantial businesses I have not been sued, nor have I sued I have not been litigious.We could have resolved this for a fraction of the cost you and Nationwide are now on the hook forNow I am angry and "P - OD”.
This very long response may be therapeutic for me as well as being an enlightening part of a paper trail for litigation
Both you and Nationwide Insurance are responsible for so many of my terrible experiences as well as my presently unresolved problem such as sourcing the funds to pay for roof and ceiling damage as well water leaks to name a few
Another current issue is the location of very large containers that are near the curb and feet from my propertyThis diminishes the value of my propertyI am denied the benefit of the visibility of and around my building that are needed for optimum building use such as rental sign and banner advertising
I have plenty of time to pursue this but I would rather make better use of itI will not let this dropI will not let go (this week,next month or the next number of years) until I have an acceptable resolutionIf I had money I would probably have done what you hoped for (ignore him he will go away)I do not have the means to afford or absorb the expenses and am now under financial distressThe amounts due me are a mere pittance for Nation Wide or your E&O carrierIf need be, we will be connected for some time
Now, unlike you, I will not project a veiled threatenI’ll just tell you the facts of what I will do if necessaryI will enlist the aid of every government agency, every not for profit agency, traditional media and employ a vigorous social media campaign and any thing else that I can to expose the disreputable conduct by you and Nationwide Insurance by simply being truthful. This story should be told.You can calculate the effect on your businessesFortunately for me there is an abundance of assistance available to Veterans and Senior CitizensEvery one should practice their smiles
I was advised by a prominent law firm that specializes in insurance matters that I may be able to have the Oregon State Insurance Commission or another Federal or State Agency take action on my behalf based partly on “bad faith.”
The first fuel I'll add to this fire will be the attachment to this Revdex.com record the earlier correspondence I had with you and Nationwide
Next I will forward everything to Nation Wide Insurance
Then I will name my neighbor (your Insured) in this disputeVery likely his attorney will act to shield him from liability by getting his insurance (nationwide) and Blackaby’s E&O Professional liability Insurance to payAs they say “ you can run but you can’t hide” (Nation Wide and Blackaby).)

from a Mr. [redacted]. Let mebegin by saying I have been in the insurance business for 47 Yi years as an agent and Blackaby InsuranceAgency, Inc. has been doing business since 1919. We pride ourselves on doing business honestly,ethically, and with morals and values.On January 11, 2017, our office received a call stating the roof of the building located at [redacted] inOntario, OR, collapsed due to the weight of the snow. The insured is out of the area but a friend wasoverseeing the building. I immediately left my office to inspect the property and take pictures. I didencounter Mr. [redacted], he did speak to me about two issues:*Would I prepare a quote to insure his building? I told him I was not able to do anything for the nextseveral weeks due to the snow. I did give him my name and the name of my agency and told him wewould be glad to complete an application and prepare a proposal for him.*He was in the process of removing snow. I told him this would be considered a liability claim and wewould set up a claim with the company for my client that owned the collapsed building. This was doneand the company denied the claim determining that my client was not negligent. Mr. [redacted] wascontacted by Senior Claim Representative explaining the denied claim (see attached letter).At no time did I tell Mr. [redacted] that I would pay to remove the snow. An agent is not able to resolveclaims or determine what will be paid and what will not be paid. An agent submits the claim to thecompany and monitors the progress of the claim. This claim was handled in the normal process as everyother claim.In January 2017, Blackaby Insurance Agency, Inc. was awarded Business of the Year by the Ontario AreaChamber of Commerce.
