I sincerely believe that my client is "venting" her frustration and following through on her threat to involve the Revdex.com in this dispute if we continued...
our collection attempts, furthermore it is also my belief that she is attempting to bolster her case by providing enough conjecture to somehow confuse everyone involved.
Our company previously did work for this client in September 2014 where she found our work to be very good and there were no issues with billing. At the time of doing the work in September she ask for a verbal quote to repair a small area of floor tile that had come loose around the sink area of the kitchen. I was happy to provide the $500 quote for that work as she has indicated. This is where things start to go astray in her rendition of the events, six months had gone by before I was actually called out to do the work previously quoted and upon arriving I immediately could see that the amount of damaged tile was considerably more with additional cracks and loose tiles discovered in several other areas as well, at that time I informed her that to fix all cracked and loose tiles it would cost somewhere between $900 and $1000. This is apparently the $944 she has indicated. At this time she ask me if I thought based on how much more damage there was if this is something that was just going to continue to happen. The answer was most certainly yes, the original installation along with factors most likely deemed to be too personal to mention in this forum were causing the tiles to come loose in heavy traffic areas. This is when the option of replacing the entire tile area with an advanced underlayment membrane flooring system designed precisely for this type of floor problems came into the discussion. During that discussion a verbal quote of $6500 was given to the client and based on the clients available budget she became concerned of any potential additional costs to the job, I told her then that the cost included all potential additional costs but for budgetary reasons it was still not feasible with her having to provide the tile.
I told her that unfortunately without knowledge of the overall condition of the materials previously installed that I could not take a chance on quoting a lower cost. Upon further conversation it was mutually agreed that the cost of the project would be $4700 with the client responsible for buying the tile. It was also agreed that a clause would be added to the agreement regarding additional costs in the event previously unknown conditions existed after the project had started. Concerning the plaintiff's indicating that she was not notified promptly of the additional costs, this is most certainly not true for I stayed in contact with her throughout the project reporting to her via telephone and text which by her own account took place. She is also conveniently forgetting the voicemail informing her of the original problems discovered and reported to her on February 6th while she was on a trip out of town as well as the daily update given her. She is also misrepresenting the facts based on the project timeline as well as invoicing, she herself has indicated through recent emails that she was notified of the additional costs by voicemail on Feb.16th and said nothing regarding the cost or any installation issues when I came by to pick up the payment on Feb.20th in fact nothing was said about anything until I sent her the invoice for the remaining balance on March 3rd. This is we she became hostile and threatening and when I decided that my only option was to take legal recourse.
In closing my client has signed a legal binding agreement to be responsible for the additional costs she so adamantly denies owing and we plan to fully pursue all legal options to make sure she pays this debt. Although I certainly appreciate the Revdex.com's concern in this matter, It is my belief that this is a matter to be handled in a court room and not on your website and giving this plaintiff any consideration at this point to be foolish.
