Major discrepancies with fees. Requested hold on work and charges but charged anyhow. Ignored requests to discontinue relationship and transfer site.
Website created by Bloomerang in 2018. Spoke with Art about expanding services for marketing in fall of 2019. Confirmed verbal agreement by email on Nov. 14 that we wanted to proceed with the $599 rate with a la cart pricing for additional services.
Seem to have been charged for hosting on 10/28, 11/14, 11/20, 11/29 and 12/30. Was told that the new rate of $599 including hosting.
Charged $1500 on 11/18. Later informed that that the $1500 was for research for Click Per Pay campaign but when we asked for more information Art said that all that work in the Google account was deleted.
No invoice for $60 charge on 11/21 so we don't know what this was for.
On Thanksgiving 11/28, Art asked for updated card info to run some charges. At that point we were extremely concerned by the terms of the contract that we were being asked to sign and didn't understand the nature of the charges that had already been run on our card. We responded with request to put everything on hold until after the holiday weekend. Card was charged $1249 the next day anyhow. Bloomerang had credit card on file to pay for monthly hosting fees. Industry standard is to invoice clients not just take the money from them as they see fit. Charging our card without our permission was the final straw.
After disputing $1249 charge, we were sent a credit memo from Bloomerang for $800 but we did not actually receive an $800 refund back to our account. Inquired about this refund but was given no answer.
On December 10, formally requested by phone and reconfirmed by email that we have decided to discontinue relationship and we wanted to transfer ownership of website that we paid for in the fall of 2019. The website was untouched since it's original creation. We also asked for transfer for any work done towards our campaign. Art's response on Dec. 10 said that he would return $500 /mo to manage the campaign since the campaign was never launched, he would turn over the google work and our website and would outline the details of this agreement in a formal letter. We never received any of these things.
We heard nothing more and never received transfer of our website. With the progression of our business, we really needed to take ownership of our website to make updates. If we had ownership of our website we would not need Bloomerang to host it. We inquired what the $1500 charge was for on 11/18 as the dollar amount was the same as the quote for website updates which were never done. He responded that it was for our pay per click campaign instead. We asked for this work to be turned over but he said he deleted it.
On January 16, we asked again for ownership of website. He said he would do so with a confirmation from the owner and release of responsibility of Bloomerang. The owner responded asking for immediate transfer of website and that we accepted full responsibility for the site. Art said he would do this and refund $649 for work that was not done. He also stated that he had no intention of withholding the website from us. On Jan 23, we recapped our full dispute and requested answers to our questions about charges. Art responded that he was handing this matter over to his legal counsel. We asked again for the website to be transferred to us as he had agreed to do but got no response relating to that. With our paid for website locked under Art whom we are unable to do business with we have had to create an entirely new website. Since we were given no ownership for the work that was done we are requesting a full refund for the following totaling $5,508.

We also refuse to pay for hosting from February to current since Bloomerang has refused to transfer ownership so we are unable to make critical updates. We have hired a new designer to create a new for us.

Refund for $5,508 as detailed in complaint.

First ***, I want you to know we are glad you are enjoying the website *** we created for you. Although for over 8 months we asked for content, we hardly got anyone willing to provide it so we did as much as we could for the most part. We went through multiple employees (***, ***, ***, *** and yourself ***), trying to gain content needed for website development. Before I continue, it is clear you have seen increases in traffic and you have been pleased without product and unfortunately when we simply asked you to pay your $99 dollars for hosting, this occurred.

I am sorry unfortunate circumstances have occurred where *** said the company doesn't have money to support what the owners want. You wanted holiday planning IMMEDIATELY, just like the 24 turn around the website we created with a team that worked overtime and the Google set up I did with my team. These emergency requests are what we accommodated until I guess ownership saw the charges in which *** called me on a Sunday asking what we can do now. This was NEVER our fault. We strongly disagree that you were uninformed about charges; we use QuickBooks that automatically informs you of billing prior to being charged - giving you time to respond in real time. No Marketing Company will provide website hosting for free; nor would they say the Website cost includes hosting - it just isn't done. Attached are multiple invoices clearly noting services, dates & service fees. Many charges you are questioning were approved before being charged - such as Domain names (your website URL), Live Chat options, Name Change (added "on Lovelee Lake"), Website Hosting and monthly services.

The following is more detail in our efforts to help you and to see you try to hurt our company like this is unfounded. Bloomerang Solutions is proud of our A+ rating; we feel it complements the work we do, correct and up front.

I spent hours composing my original complaint, yet I feel Bloomerang's response did not directly address any of our issues. We spent countless hours previously trying to resolve our issues directly with this vendor before taking our complaints to Revdex.com. We were charged in advance for services we did not receive. Charges were run on our credit card despite us clearly directing to hold off on charging our card. There were multiple emailed statements from Art saying that he would refund us some of the disputed charges and give us ownership of our website, but he refused to follow through with any of these.

In rephrasing my original complaint, I have recompiled my narrative, listing invoices that we are disputing backed up with excerpts from email correspondence for context. My comments are italicized. Please see attachment for details.
