an investigation I have come to the following conclusion: Kwik Kar of Harker Heights is not responsible for the damage to the customer's car.Results of my investigation; (any comments that are my opinion will be in italics and bold type.) Everything is else is based on facts.Vehicle Information; Hyundai Accent 1.6L FlMileage at the time of incident - (dealer rep stated 137258) so for the sake of this report we will go will 137258.Last known oil change done at our store, 6/13/4:09pm mileage 132615.This car was to return for an oil change at 09/11/or 135615Previous time car was in our shop: 1/4/127814This car came in on 10/24/for a vehicle safety inspection and had a light bulb replaced.We have no prior service history on this vehicle, except what car fax has recordedMileage between last oil change and incident:4643, which is miles over dueThe short answer is the customer is claiming that we did not put oil in their car (it is alluded to in the letter) no car can travel miles with no oil in the engineSo that means that oil was lost during that drive timeI suspect something happened shortly before the incident and it caused the oil to leak, burn or leave the engineAlthough it is possible that it had bad piston rings and they were getting worse as time went onIt is the owner's responsibility to check their engine oil every time they refuel(According to the owner's manual page 7-4) almost all cars that have no oil in them fail within miles max.We had this car on a return internal of miles because of the oil used (Semi-Synthetic, SAE 5wthat exceeds ILSAC GF-and API SN/SM/SL, the car calls for GF-or better per owner's manual page 8-4) because the customer drives under severe conditions per the owner's manual pages 7-and 7-17.When this car came to us the second time it had traveled miles, making it miles overdue. This customer had purchased this car around 12/08/miles on it.In closing, there is no way this car went miles if we had filed to put oil in itWe have not had an opportunity to inspect this vehicleThe dealer rep told us the car was spitting oil out of the tailpipe and had failed a compression test which would lead one to believe that the piston rings were worn outIt would take an enging teardown to determine thatIt could have been some other failure but that has not been made available to usI have all research papers in my store and can provide them upon requestWe stand behind our original decision, that we are not responsible for the damage to the customer's car.*** ***Managing Owner*** *** ** *** ***

I am rejecting this response because: We had a mechanic look at it and agrees with us.Mr ***,I did my own research as wellI found that section maintenance page on the Hyundai manual indicates that under severe driving conditions oil changes are required every 3,milesYou indicated 3,which is not accurate and also cited we were around 1,miles overdue at the time of the car breakdownWe were only miles overdue not to mention that Car and Driver's editor *** ***, cites in an article from January that "an oil change every miles is outdated and an overkill.....and your mechanic knows this". My son put in quarts of oil into the engine after the incident happened as he noted there was minimal oilIt holds 1/quartsI'm curious as to how the engine had room for three extra quarts of oil if, as you allege, there was oil put into it at your shop. Also, if there was an oil leak, why did we not see this in the driveway or garage? The exhaust shows no indication or residue of an oil leak nor burning offThis was not indicated to us when we took it to the dealershipThere is no written documentation by the dealership stating there is a leak in the exhaust pipeIf you have one please provideAlso, if you would like to inspect the vehicle we would be glad to bring it to youI also know per the conversation with your manager on 11/7/that the mechanic that did the job is no longer with youI'm also curious as to whyYour manager also said that your protocol is to show the customer the dip stick after the oil change as verification and this did not happened either.In closing I still believe strongly and even more so now that your business neglected to take care of our vehicleI say this because we have taken the car to a mechanic and without doubt has confirmed our suspicionIf you are a reputable business, please consider taking this seriously as we are not one to take advantage of anyone nor any businessWe are after what is right and fair

You have asked about oil leaks and no evidence in the driveway, I believe you had some kind of failure that caused an oil loss just before your car broke down. As to paperwork from the dealership all I have to go on is what they told us on the phone. I still stand by out decision not to offer any compensation, as  your car traveled 4,643 miles since the last oil change before the engine failed. If it had no oil in it when it left our shop as you are claiming, it could not go that far.
