I am rejecting this response because: There are many inaccuracies in the response On Wednesday, Mar1, I contacted Windows & Doors of MN owner, Frank ***, to alert him that I would like to suspend the order Upon getting my text, Mr***, without checking with his supplier, immediately texted a reply that it was too late because the windows were already being cut Then he proceeded to cash my check the same day, one day prior to my authorization to do so, in order to prevent me from stopping payment with my bank Suspecting he was being dishonest about the status of my order, I contacted the manufacturer directly, Weather Shield, on Monday, Mar6, An employee there was able to look up my order and verify that my order was not put into production until Friday, Marwhen Mr [redacted] replied to their "Acknowledgement" to accept and proceed with the order He had lied to me about the windows already being cut, and he knew I wanted cancel my order, and yet he authorized Weather Shield to begin manufacturing themIn addition, Mr [redacted] states that "I knew he would be out of the country until March due to a vacation that I was on." That, in fact, is untrue I have a text from Mr [redacted] on Saturday, Marstating that "I am in Florida till the 13th I can send it (the invoice I had requested) when I get back to the office Training" No mention made of being inaccessible by phone due to a vacation and being out of the country In fact, he states he's in Florida training, which one would assume is training for his business and fully accessible in the USMr [redacted] also claims he has received pieces of glass from my order Not only does that contradict what he personally stated to me on Thursday, Marby phone where he explained that the glass is held at the manufacturing facility in order to ship on a full truck, thus the 3-week delay once an order is received from the original placement date But I was informed by Weather Shield directly that the glass was expected to ship on Mar24, They have not sent a partial order to Mr*** Mr [redacted] indicates in his response that there is "no three day right to resend (I assume meant rescind) on special order glass..." This may be his policy, but Minnesota law allows for days for a contract to be retractedI have record of all correspondences with Mr [redacted] and his supplier, Weather Shield, to back up my claim that I attempted to cancel the order on Mar(two days after ordering them), he directed Weather Shield to begin production on Mar3, and he cashed my check one day prior to my authorization I also have documentation that the windows have not already been shipped to him He should have canceled my order prior to the windows going into production and this situation could have been fully avoidedI stand by my request for a full refund of both my window payment and my bank charges

Our firm was contacted by the customer listed above and we had a meeting that took place on February 27, in regards to replacement glass During that meeting we inspected the whole property, took measurements, verified Codes, and gave the customer an option on which glass was bad and which glass could wait After the meeting which took about two hours the customer decided to go ahead and replace all the glass that is noted in the orderDuring that visit/inspection the customer was very aware and excepted that by us placing the order on that date that due to special orders there is no refundsThis is also noted in the agreement that she signedThe only request that the customer had was due to she was paying by The only request that the customer had was due to she was paying by check was if we could hold off on depositing the check until Thursday, March On Wednesday March 1, we received a phone call from the customer stating that the check had been cashedWe apologize to the customer for the check being deposited one day earlier and informed her that we would pay the return or bounce check feeThe customer was happy with that and did at that time expressed concerns about seeing if we could cancel the order I inform the homeowner that the order was already placed and that due to it being special order glass that I cannot cancel the orderI contacted manufacturing and the glass had already been placed for a cut and was just waiting for the additional steps in which takes roughly to weeks to processThe customer was OK with that but at that time was not happy with having to go ahead with the order I inform the homeowner that I would be out of the country until March due to vacation that I was onI just arrived back in country on March at 7:in the morning and gain access to my emails and noticed that we have a complaintUpon reading this complaint I have responded The customer was very aware of that we would be out of country I have no access to phones or emails so therefore seeing that the homeowner was trying to contact us we would not be able to respond accordingly The customer is requesting full refund and a refund of the overdraft feeOur company is willing and has always noted to the homeowner that we would cover the cost of the overdraftHowever due to special order glass the agreement cannot be canceledThis was very much implied and stress during the February 27, meeting in which the customer had over two hours to think about while we were measuring and provided her a cost and quote Roughly pieces of glass have already been received in our office and we are just waiting on the additional glass to be sent out Due to the customer having plenty time to think about the glass order and our company informing her that once the order is placed that it cannot be refundedThis customer has placed glass orders before with our company and is very aware of the policiesThis is nothing new to this customer for she is a repeat customerThe customer knows how these orders are placed and how the process worksBy the customer contacted the manufacture and depending on what department she has reached they will not know the status of any order in nor will the manufacture disclose any orders to the customer directlyThe order was placed on February 2, and the glass has already been received with the exception of the remaining glass that is still being madeIt is noted that she stated in her complaint that our company was unethical and untruthful and that the three day right to resend was in placeThere is no three day right to resend on special order glass, we have been very honest and upfront with this customer and that is why we have been a repeat customer for herWe apologize for any inconvenience but at this point we cannot refund and the amount and the glasses already been made

Windows and doors in Minnesota has placed an order upon approval of the customer for special order products. The customer was very aware that all special orders are nonrefundable or returnable. We did not receive a cancellation notice at any time nor have we received one to date. Even if the homeowner wish to cancel she could not do to the items are special order products. There was no mention that anytime that she wanted to cancel the order within the three days. The only communication that was transferred was that she was looking at how to make payment. Either by check or by credit card. We have a text message back stating for us to go ahead and cash the check and that was on Wednesday. This gave us for authorization to deposit the check on the date that she told us to which is in writing. The only options the homeowner has at this point is to receive the products and cancel the labor portion in installation. The insulation has not been paid for for that cost is due at completion of the job. Due to special order products being ordered the homeowner is aware and took appropriate time to consider her options in which in the end to go ahead with the order which was placed at the property after her signature. By the homeowner refusing to acknowledge that she was aware of our whereabouts and that I was on vacation is hearsay. She is only using these tactics to try to get out of an order in which would place our company with glass that we have nowhere to put for it it is special ordered for her property specifically. At this point we cannot cancel or refund the cost of the materials. We do have some of the glass on hand already and we are waiting on the rest of the glass to come in. Orders take up to 3 to 4 weeks. This means that we can receive the glass at any time during that period. WDMN- Jon will not refund in the amount paid today for the only amount paid was for materials only which is special order. Again if the homeowner wishes to not go forward with the installation she is more than willing to receive the parts and not have us install them. However since the parts have already been ordered and they are nonrefundable or nonreturnable no refund is due
