I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me because I did receive the remainder of my deposit. This is one renter that wasn't going to stand for their poor business practices of withholding excessive dollar amounts in security deposits

I’ll be brief.  This tenant signed a one year lease good from 10/25/2014 through 10/31/2015.  That lease then converted to a month to month lease on 11/1/2015.  The lease clearly defines the tenant terms as well as the landlord terms.  To terminate the lease properly, the tenant...

needed to give a written 60 day notice by the first of a month.  The notice we received was dated March 10, 2016.  So, according to the lease the tenant signed, the notice doesn’t take effect until April 1st.  The tenant is liable for the April and May rent.  While she did move out on May 5th, that does not absolve her from owing rent for the entire month of May.  We were able to rent to a new tenant on May 13th. So this tenant would only owe rent through the 12th because of our efforts to mitigate the amount she owed due to her lack of a proper notice to vacate.   This tenant’s lease also clearly stated that the Security Deposit is not rent.  This tenant did not pay her May rent and so a late fee was properly assessed.  This tenant’s lease also clearly stated the apartment must be left in clean and ready for the next occupant condition.  We paid a cleaning person (professional meaning a paid person not an owner) to wash all light fixtures and walls because of the yellow discoloration left from this tenant smoking.  While smoking is allowed, the residue wasn’t cleaned up. The cleaning person had to clean up cat litter from an interior closet that appeared to be where the cat litter pan was kept.  The stove and refrigerator were not cleaned under and so the cleaning person had to remove all the cat hair.  I believe we were justified in every one of the deductions from this tenant’s security deposit return.  Leases are contracts and should be understood by both parties.  After receiving an email from this tenant on June 9, 2016 about her desire to receive the amounts deducted, I did in fact mail her a check.  While I believe we were justified, the cost for the owner to pay myself to spend any more time on this matter, wasn’t.  Please know that I am grateful to your association for taking the time to inquire about this and I hope my statement of the facts helps everyone’s understanding of this matter. [redacted]
