It is disappointing to see this type of a complaint from a third party who does not understand the law, especially when her father shook the hand of the owner and thanked him when he picked up his carWe have a contract with the State of California who dictates our hourly rate from the minute law enforcement contacts us until the tow is completed no matter how long it takesWe take pride in the integrity of our company and treat everyone with respect and professionalism

I am so sorry for the delay but I do not accept there responseThey still did not Answer why they are charging us for storage when we are the company that hired themThey even stated that they were waiting for us to sign the release so why charge us, the dealer, storagePlease help me clarify to the extra fees and also why they stated they wanted to lien the car if didn't pay

Cost U less Cars sent Tracker Auto Recovery a repossession order for a vehicle they financed for a consumerThey failed to notify us that they had dual assigned the vehicle and it had been repossessed prior by another repo companyIn the State of California this is not allowed under CA State
Repossession LawsAs soon as it was brought to the attention of Tracker Auto we immediately contacted Cost U less and were informed that *** was unavailable to speak to usThe consumer tried to contact Cost U less also with no response backFinally three days after *** contacted our office and explained that he dual assigns vehicles all the timeFirst to repo it gets paid, was his commentThis is unethical and illegal in the State of CAThen he does not close the repossession with any of the companies once the repossession has been completed by another company violating the consumers rights under the CFPBThis is what happened with the Monte Carlo in questionThe consumers rights were violated by Cost U less since they never informed Tracker Auto to not run the assignment any longerThe consumer had just got the vehicle back from the other company and then it was repossessed againTracker Auto Recovery attempted many times that first day to rectify the situation as quickly as possible and worked along side the consumer to try and get the Monte Carlo released by Cost U Less but could not get ***, who was the only person with the authority to release the unit to call us back*** at Cost U Less does not understand the legality or the severity of the legal consequences in this type of situation due to his lack of responsibility in this situationIn response to the fees our average repossession fee is $300-$depending on the the circumstancesHis first repossession was at a discounted rate of $since it was already on our impound lotHe never signed a formal written contract to set feesThe case in question he was charged the repossession rate and storage on the vehicle since he did not respond to our efforts to contact him at all until the consumer contacted his mom to get this resolved after waiting three days
