Date: 09/15/2015My Name is Lucky K***I am Service manager at Blue Mountain Truck and Trailer RepairLocated at *** *** **, Myerstown PA ***, it has been brought to my attentionThat *** *** has filed a complaint of fraudulent Transaction into his bank
account by Blue Mountain Truck & Trailer RepairWith respect to this very serious accusation, I have personally looked into this matterAs Per My investigation, Service Notes, and other Documents pertaining to this complaintI have Following Information for you to reviewI hope My Findings will be assist to solve and clarify this matter• 05/01/*** *** brought truck for repairs on front drive axle, major Parts were needed.*** *** decided to bring his own parts, when he brought parts for us to install, scheduled his truck in for the installation of Used Differential CarrierWhen Job was done, called him to Inform about Status of his truckFor the matter of down time for the truckTruck was droped off on Friday noon time, On same day we diagnosed and informed him what was neededFollowing two days was weekend we do not work on weekend on customer's vehiclesThis pushed his truck into following week, Which was told to *** *** at drop off timeAlso Repair could only be completed when we would have received the partsParts were bought & brought by customer• 05/06/At Pickup time*** *** Came in with Request to hold his check for next two weeks, before DepositingSince He has No Credit Established with us, He is strictly COD (cash On Delivery) customer, I was notable to extend any credit to him in writing, but I did extend him the courtesy to hold his check until last Friday of May (05/29/2015), Which gave him additional weekAs per my notes had his check submitted to be deposited into business account for Blue Mountain truck & Trailer Repair Following Wednesday (06/03/2015)By Next Few Days, ** *** Stop by the Shop and complained in very rude manner about "why the check was deposited, He had no money in that account, it Caused Charge backs etc, and started yelling at the shop crewI tried to cairn him down, and remind him about the Courtesy gesture We had offered him about depositing the checkInstead of understanding the fact, that he had failed to maintain sufficient funds in his account from where ho made the check, for a promised paymentHe started to accuse shop of fraud, and taking money from his accountI explained him process of returned checks may cause addition fees from our ends also, which will be his responsibility too, Further notified him about Automatic "Resubmit" Service by *** Bank will retry Transaction after Few days to clear the check, So he should make sure there are sufficient funds in his account to cover the payment for his truck repairHe left without making the payment, nor he arranged other method of payment• As far as customer claiming that either Or any of the service team had agreed upon any payment plans(depositing one check on 6/8/& another on 06/15/22), calling again to check back when to deposit the check, Or Dropping Off any checks with my wife (who lives miles away from shop, has nothing to do with this matter) with notes or stamped envelope, There are no documents, Special notes, or any communications found indicating such agreements between any of the parties• As Far as *** ***'s Demand of his costs on returned checkHis action of knowingly paying for service with check from account without sufficient funds, Even after Giver Extra Time to make funds availableIt Shows clear disregards toward his responsibility to pay for service which was provided to himAny and all costs in regards to returned checks or canceling checks are due to fault of his ownIf anything He should be investigated for intentionally writing a check, and not maintaining sufficient funds in his account• I have attached Documents relating to this matter• *** Bank Resubmit the check and it was cleared as per my information (around 6/20/2015).There was no fees charged to Blue mountain Truck and Trailer Repair by the *** bankBut *** *** has returned check fee of $unpaid, plus any legal or administrational costs to resolve this matterI have investigated this matter with all due diligence, Apparently *** failed to recognize, and respect the courtesy that was extended to him as grace period to pay his billInstead, he is trying to misuse the systemPut in place to help & protect good hardworking folksFor any further questions please contact us at ###-###-####.SincerelyLucky K
