Employee texting my personal cell to vent his frustration at me for canceling the roofing contract. Owner threats to sue if I do not remove neg post
David Smith came out to my house on 5/13/20 and let me know my roof and gutters definitely had enough damage to open an insurance claim. I signed an actual "Home Restoration Contract" supplied to me a month later by Mr. Smith. But wrote a formal letter to Mr. Smith and BNR to advise my canceling the contract and found another company that was more favorable to my situation (within the 3 day recession period allowed by law).

That same night starting at 8:24 in the evening David Smith begins to text me stating how I lacked integrity and continues on and on to say how I am greedy and dishonest for not continuing the work with him. I literally had to block Mr. Smith's phone number.

The office manager emailed my insurance company to advise I canceled the contract (I have been told this is protocol). David Smith also felt the need to email my insurance company to advise the same. Not once but a week or two later he emailed them a second time telling my insurance company how to do their job and reset their numbers they had drawn up already. This is now 3 emails BNR has emailed to my insurance advising them to cancel all numbers and start over with me. At this point Mr. Smith has went above and beyond out of line.
I called the main office to let someone know about this and was told the owner himself would return a call to me. I did not receive a call but 4 days later at 1 am on a Saturday night - I repeat 1 am on a Saturday night - I get a very long email from the owner ***, using capital letters, to emphasize certain words. Within this very long email he let me know that I have until Tuesday 6/16/20 at 8:00 am to take down any negative reviews and sign a "Non-Disparagement Agreement" a "Mutual Contract Termination Agreement" and a "Hold Harmless Agreement" or he will sue me for the following...
1) Breach of Contract (let's go!)
2) Betterment (No work has been done to my house to this date - nor do you know anything about the contract with my roofing and insurance company)
3) Defamation/Slander (This is a 100% factual and provable review)

*** finally called me two times back to back today at 7:41 am - I repeat 7:41 am to try to discuss this matter. I did not answer and at this point it is not my duty to track him down to meet up over a phone call.

Certified Consultant David Smith and Owner *** have beyond become bullies, completely crossed the line and showed their true colors. Your handling of business with me warrants this review.

Desired Outcome

To advise they cannot text message their clients to retaliate for a cancellation of contract or to be threatened lawsuits for writing a 100% factual review

Contingency Contract between *** & Blue Nail Enterprises
Signed May 13, 2020
Customer *** signed a contract with Blue Nail on May 13, 2020. The contract states that he agrees for Blue Nail to assist with his insurance claim. Blue Nail assisted with his insurance claim by creating & sending an estimate. That estimate contains the scope of work & amount that Blue Nail will charge to complete the repairs correctly according to building codes & manufacturer specifications. The contract states that if the claim is approved, all work in the claim will be performed by Blue Nail Enterprises for the amount approved. Once the customer signed the contract, our employee began creating, documenting, calling & negotiating our estimate with his insurance carrier. The insurance carrier approved our estimate. Our employee notified the customer that our estimate was approved by their insurance carrier.

Home Restoration Contract between *** & Blue Nail Enterprises Signed June 8, 2020
The customer was sent a home restoration contract showing the total amount approved, his responsibility (his deductible) along with upgrades of which our employee was going to supply at no charge. *** signed this document on June 8, 2020, at 4:45 pm.

Letter sent by *** to Blue Nail Enterprises on June 10, 2020
On 6/10/20, the customer sent a letter stating that he would like to rescind the agreement altogether and "go with your competition." We obliged his request even though he was in default of the contract (the rescission period expired on 5/16/2020). We notified his insurance carrier by email that we would not be performing the repairs per our estimate and attached his letter. Blue Nail Enterprises is obligated to notify the insurance carrier of the contract cancellation. Blue Nail Enterprises has no information to share with the insurance carrier regarding cost of repair or scope of work for the new contractor. The newly chosen contractor is responsible for sending and negotiating an estimate for approval to Mr. insurance carrier.
Our employee invested a great deal of time and effort on behalf of Mr. with his insurance carrier. That employee became frustrated when Mr. decided to contract with another company after they had negotiated and gained approval for the project. That employee did express his frustration to Mr. using the phone number provided to us by Mr. for corresponding. Although we understand and recognize why the employee was frustrated, we do acknowledge that they should have refrained from expressing those frustrations to the customer. We have reprimanded the employee and placed a warning in their employee file.

We believe that the customer does not clearly understand the terms of each contract that he signed. The contingency agreement and home restoration agreement each have specified rescission periods. The home restoration contract does allow for the customer to rescind upgraded items if they change their mind before materials are ordered, or labor completed.

Mr. called our corporate office on June 11, 2020, and asked to speak with someone of authority above the office manager. That person, the owner, was out of the office when the call was received. The owner was sent a notification to contact Mr..

Owner, *** contacts Mr. June 13, 2020
After seeing the negative review posted on the Blue Nail Enterprise Google My Business profile by Mr., the owner then realized that he had missed the notification to call the customer to discuss the issue at hand. He responded after he became aware, which was after midnight to Mr. via email. That email advised Mr. that he was in breach of contract, acknowledged his frustration with our consultant, asked that he refrain from further disparaging posts, and requested that he remove the negative review that contained inaccuracies. We advised that his removal of the negative google review would save both parties time and money by eliminating the need to have any further discussion or pursue litigation. We then requested that he confirm agreement to the above terms by signing a mutual contract termination and a non-disparagement agreement. Mr. requested that Mr. respond by 8 am on June 16, 2020
Mr. has refused to answer calls from Mr. on the morning of June 14, 2020, to discuss and has not agreed to sign any of the requested documents.

Our office responded formally to the negative Google on June 16, 2020, with the following statement:
We always welcome honest feedback; however, we do take offense when that feedback is skewed and contains non-factual data. We acknowledge your frustration and apologize for the hard feelings this has created. As part of the process, Blue Nail provided your insurance carrier an estimate on your behalf for approval. Once we received your letter rescinding the contract, it was our obligation to inform your insurance carrier that we would not be doing any of the work per our estimate. The contractor that you have chosen will submit their estimate and pricing to your carrier.

Mr. responded by adding additional content to the original negative google review and then filed a complaint with the Revdex.com.

BNE is completely twisting all facts. Once I received the actual contract with the actual numbers, I rescinded. The office manager emailed my insurance to advise me going with their competition. Not only that but *** felt the need to email my insurance company an additional 2 times. That and Mr. texting me late evening calling telling me I lack integrity and going on and on because he is mad I went with another company, he is now harassing me.

I called the office to let them know. All I received was a 1:00 AM email, from the owner, threating me with three lawsuits if I do not sign a Non-Disparagement Agreement" a "Mutual Contract Termination Agreement" and a "Hold Harmless Agreement" and take down my factual post.

The owner also felt the need to call me at 7:41 AM the following Monday morning. Of course I didn't answer.

To this day I have not received any further phone calls from the owner and have not received the Non-Disparagement Agreement, Mutual Contract Termination Agreement or Hold Harmless Agreement. Please send me all three of these forms, signed by you, and I will be happy to review.

I have also not received any documentation on the three lawsuits I have been told will be brought against me if I do not remove the posts. The posts are still up.

Let me start out by saying this. After talking with many roofing contractors and feeling like I needed a bath when I was done. I chose Blue Nail Enterprises. They were straight and to the point. There wasn't a high pressure sales tactic or any promises that sounded to good to be true. I also chose this company because they met all of my needs. I needed a roof and siding. They were patient with me while I figured out what roof and siding I wanted. They were also patient with me while I battled the insurance company about the damage. Like I said no pressure. And I give a special 5star review to Cathy. When I called about questions and concerns about my bill. She was attentive and courteous with my concerns. In less than 24 hours she had fixed my problem. So thank you Cathy Rodgers for making my experience a good one. And thank you Blue Nail Enterprises and crew for doing a beautiful job on my home and for making a stressful situation a pleasant experience.

We hired Blue Nail to replace our roof which was damaged in the June storm. The process from the start to finish was seamless and the yard cleaned before the crew left. A representative came to review the completed work and asked if we had any questions or concerns. Cathy in billing was very helpful in proving the final bill both electronically as requested. I would recommend Blue Nail for anyone's roofing needs.

Work was done on time and to my satisfaction. Cathy helped finishing the paperwork my insurance was asking for. Thank you for your support!

We hired Blue Nail to do roof, gutters, fence, paint and siding on our home. After 4 months only the roof, gutters and one coat of paint on our garage was completed. In the beginning several rescheduling was because of the weather. Which is understandable. But when you start to reschedule because you are too busy to get to us and another customer decided to add to their order the day of their job and you are going to accommodate them and reschedule us......THAT WAS UNACCEPTABLE!!!! Old gutters were left on the side of our house. Roofing material left in drive way. Cable line cut and garage door stopped working. The person that referred me did not get there referral money. Customer service was.... I AM AT A LOST OF WORDS TO DESCRIBE THE LACK OF CUSTOMER SERVICE!!!! The only thing good to say is my roof looks good and so far it is still standing 3 months later with no leaks.

Blue Nails did the roof on our Church and our house and we had problem with the roof leaking,refuse to stand by their word
Our roof was leaking and they said that it was not holding water, we have photos, they first said 900. on damages and then said 2400. It should be covered in the warrenty. We sent a lot of business their way and now hope no one goes through the same as we are.

Upon receipt of notice from Revdex.com, we called Mr. and Mrs. to make an appointment to address their issues. The owner went to the church and discovered there were other problems that were causing the leak, not the workmanship of the roofing. The customers were given the recommendation to fix the problem and we are awaiting their response as to whether they would like to proceed.

Great company with experienced personnel. They did a wonderful job and showed respect and kindness to me and my personal property. I have and will continue to refer my friends and neighbors.
They did a major repair on a slab leak, installed a patio cover and gutters in a timely manner and best of all worked directly with my insurance company on the claim regarding the leak.

My husband contacted Blue Nail Roofing to inspect our Roof and property for damage caused by a severe hail storm last year. We both met with the Representative who did a thorough inspection and provided pictures to backup the damage estimate. The Blue Nail Representative returned to discuss the estimate with the Insurance Representative. We awarded the contract to Blue Nail and could not have been more pleased with the job as it was handled timely and with precision. They explained everything up front, during and upon completion. Everyone who came onto our property was courteous and professional and the job was completed as contracted. We will not hesitate for a moment to contract with Blue Nail again when and if the need arises and we highly recommend them.

Don't trust this guy. His and himself have not respect for your personal property and then refuse to fix the damage they have done and blames your insurance company for the damage. He talks nice and asks you to give him a break but he doesn't you or your insurance company any break. Don't trust this company._

Hello Sharon,
I am unsure what your complaint with the Revdex.com is asking for. We completed everything we said we would, compensated you for alleged damage to furniture, and asked that we be paid for the work we completed. If you have a concern, please let me know and I'd be happy to consider for resolution. My staff have tried to be nothing but courteous and responsive to your requests. If you need something, please let me know.

As of 2/15/18 we have not had a response from Sharon Lane.

Blue Nail Roofing has taken care of me and my family for all our roofing needs. After a recent hail storm they were able to come and take care of me with fast and friendly service. I went to work and came home to find a brand new roof and everything cleaned as if no one had been there. Would definitely hire again!
