Blue Sky Before & After School Care

The owner of this establishment is refusing to give me a tax statement because she says that I owe her $65 for child care for the week of Dec 17, 2013 for which my child only attended 1 day out of the week. Ithought that I only owed her $10 for that week because on a previous week my child only attended 1 day due to illness, she charged me $10.During the week of Thanksgiving 2013, I paid $35 for two days. That is why I feel that I should only owe what was paid in the past for a 1 day attendance. I don't believe rules should be changed in the middle of the game. Not to mention [redacted] the owner of the business has not given me 1 receipt since my Aug. 7, 2013 enrollemt. I am due a tax statement mailed by a certain date regardless of what I owe.I will be contacting IRS because I need the total amount paid for the 2013 year and the ID # of the business in order to file it on my taxes.Desired SettlementI want the owner contacted by a member of the Revdex.com staff explaining to her the law concerning tax statements. Ihave never stated in any shape or form to her that I would do such a thing.On July 30, 2013, Ms. [redacted] signed a document stating, "I understand that tuition is due theMonday the child attends the program, and the hours of operation are from 6:30am- 6pm,Monday-Friday." The week of December 2-6, 2013 Ms. [redacted]'s child attended Blue Sky Before& After Care the entire week and did not pay the tuition for that week. I sent her an invoiceexplaining that she owed $60 ($60 instead of $65 because she'd overpaid by $5 the weekbefore) no later than Friday. December 6,2013 (giving her a 2nd chance). No payment wasreceived. On Tuesday, December 10, 2013, Ms. [redacted] dropped her child off @ 7:OOam andpaid the $60 tuition fee that she owed for the week of December 2-6, 2013. However, byDecember 10, 2013, Ms. [redacted]'s tuition balance was $125 ($60 from week 12/2-6/2013 &$65 for week 12/19-13/2013). When Ms. [redacted] dropped her child off on the morning ofDecember 10, my employee was working & I (the owner) was not present. My employee doesnot deal with client balances. When Ms. [redacted] picked her child up from the establishment onthe evening of Tuesday, December 10, 2013, I stated to her (in person) that she owed $65tuition fee for that week. She stated to me that she knew that, she always pays, and that shewould pay the $65 on Friday, December 13, 2013. No payment was received. I tried calling Ms.[redacted]'s home and cell phone on December 11 & 12, 2013. No answer either time.On December 17,2013, I mailed Ms. [redacted] an invoice for the week of December 9-13, 2013.I received a phone message from her asking why she owed $65 & questioning the tuition fee forthe week of November 25-29, 2013. I mailed Ms. [redacted] a "second notice" invoice on January7,2014. In the invoice I acknowledged her questions & concerns in writing. I called her onJanuary 10, 2013 and left a voice message. I mailed her 2 more invoices regarding heroutstanding balance. I never stated (verbally or in writing) that I was going to withhold her taxstatement.Finally, to address the tuition fee Ms. [redacted] stated in her complaint about how she only paid$10 the week of October 21-25,2013 because her child attended 1 day. Since her child onlyattended Blue Sky for one morning for under an hour, I explained to Ms. [redacted] that she'd onlyhave to pay $10 for that week. If her child attended both the morning & afternoon for one day,the tuition would remain the same at $65 because that is considered one full day.Sincerely,[redacted]
