I have reviewed the response made by the business in reference to complaint ID 10208229, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
Due to breach of contract, failure to perform, insufficient work, fraudulent terms of agreement, intentional misrepresentation and failulre to provide proper invoices I have retained counsel to resolve this matter in a court of law. The mere fact that this contractor has the audacity to try and collect monies for work/services/materials he did not provide and for a laundry list of mistakes that he made and refused to correct because of carelessness and extremely poor workmanship is simply, outrageous.

Review: After multiple on-site walk-throughs, telephone conferences and emails to resolve issued addressed with the Contractor in regards to numerous mistakes, unapproved and unauthorized changes and modifications to the home and refused to provide invoices for purchases which were requested on numerous occasions. Contractor was provided with Expert Claims documentation for restoration of home prior to the start of the reconstruction and still refused to restore home back to its original condition. Contractor made several poor excuses for his conduct and tried to increase the contractor price even through there was no signed or approved agreement for his changes. I had to contacted the City of San Diego Development Services Department for re-inspection of the property, who then issued an Inspection Correction Notice, had to called in a Plumber to fix an emergency situation and File a Complaint with the California State Contractors License Board.Desired Settlement: Would like a refund for all work not completed per contract and all work that has to be repaired by another contractor as a result of the Contractors mistakes and unauthorized, unapproved changes/modifications. Would like reimbursement of any and all out-of-pocket expenses this may costs me as a result. Would like the Contractor's license suspended/revoked for unethical practices.

Home owner signed a contract for $213,366.00 to date has paid $168,000. There is work to complete project at a cost of about $1,000 to $2,000. Being owed more then $47,000.00 dollars in payments the home owner reuse to pay. I asked they hold back $2,000.00 until all work is completed so show good faith in payment. They refused and that's when all the complaints started by them. During the project I used my money to keep the project moving forward they never once said thank you for me funding the project. To date I haven't seen another contractors bill they would like me to pay for, nor any written summery of the mistake they claim. They choose to file a complaint rather than pay their bills.
