Company was hired to refurbish front and back porch. I signed a contract for composite material and Company requested 50% up front. I paid the 50% for composite material.
The rails, pickets and post were to be with composite material instead the company put up rough cedar. Company decided to go with the rough cedar instead of what was on the signed contract, composite material. I am highly allergic to cedar but they were just concerned in getting it done. The rough cedar was not sanded prior to priming. Rails can't even be used. The ramp I had built for my mom can't be used. I will have to put up signs advising people not to use rails or risk getting cut. Not only was the sanding not done but the painting was done poorly. I have strikes of paint all over and some area aren't even painted. Company didn't do enough coats because the rough cedar original color is already bleeding thru. Owner indicated that sanding, priming and painting were not part of the contract. I told owner he was correct because I never wanted cedar, I wanted composite so there was no need for sanding, priming or painting. Composite comes in the color ready to be put up. Owner responded with 'cedar can't be sanded and that cedar should be left in its natural color.?
Company was supposed to replace the support blocks and level deck. Deck was not leveled and the support are not supporting anything. They didn't remove the old supports and the old supports are what are holding up my porches. Some of the support blocks are not even touching the concrete blocks.
Nothing is leveled or in line. The posts are not even or placed in correct spot. The company was supposed to add other stairs even with back door but they didn't want to buy additional material so they placed the stair where they wanted. I know that because the son of owner told me that his father didn't want to buy another post and that was why he placed the stairs where they wanted. Again, not even or straight.
Company was supposed to replace all old deck wood instead company flipped the deck wood. They did replace a few but not all. When I voiced my concerns, they responded with it was not on contract but it is on the contract.
All stairs were done incorrectly. The amount of overage was not enough so to cover up the mistake they improvised. The company decided to cut some wood and place between the stair model. Usually there is board that is placed in front of stair model to have a great facial appearance but not one stair case has a great facial appearance.
One main thing I wanted was the porches to be uniformed and nothing is uniformed. I questioned everything and they basically indicate they were the professional and they knew what they were doing.
I have had another company come look at the work to see if they could fix the mess. I was told I lost money because the other company would have to start all over as if the porches were never touched.
I have tried to reach out to the owner and he just starts yelling at me. I have sent emails with all of my concerns and they responded with a certified letter requesting the remaining amount due. Company does not see they did anything wrong. I don't know how they stay in business. If they can to such horrible work on a porch, I am scared to see what they do on commercial contracts.

Desired Outcome

Refund I have already tired to reach out to company to give the company another chance to correct all concerns and issues but owner didn't want to hear it. At this point, I would like all of my money refunded and the remaining amount due to be zero. I just want the money I gave to company to be refunded. I have already reached out to another contractor and that company is billing me as if nothing was done to the porch.

My name is Martin *** owner of BMS services. My company was established in
1999. Serving the metroplex area and a multi-family industry in construction and remodeling.
We been a very dedicated family business serving different areas of DFW and occasionally we
work out of town if owners or management requires. We have been establishing relationships
with the same clients for many years. Also, we get new clients by recommendation from other
clients. Our group of family employees have been honest and responsible of all projects from
start to completion. Our customers have been satisfied with all our projects. I feel that I have
been doing a good job maintaining our reputation without any complaints or concerns. I enjoy
teaching all my 9 children good manners and responsibilities for the future as they will take over
the company.
Recently, I got hired for the first time in Royse City for a deck repair project as the
proposal specified: Removal of deteriorated hand rail and damaged steps. That was built by a
family member of the customer. My job was the removal of existing rails. Installation of
composite deck only on step areas. Removal of existing post on deck and resecure existing deck
under. With 4x4 post laying existing 2x4 support removal not included or leveling the deck 2x6
was only replacement of new boards as it was completed due to deterioration. Also, we found 1
to 2 pieces that were not rotted and we told the customer that we flipped them to have a better
appearance. Originally the proposal said it was to install tap rail with composite material. Prior to
the project BMS brought sample to customer and she agreed on the special material so we
proceeded with the order of all composite material and delivering to the project site. The date we
were ready to start handrails customer changed her mind and decided to go with rough cedar.
After buying the material for the deck and wasting half of the composite material for hand rail.
We proceeded with the cedar hand rail and completing installation of hand rail project without
any complications. Then we informed the customer of the process of priming/painting on the
cedar handrails and was completed without any complications. Customer then informed me that
the cedar was to rough and asked to sand all cedar because she was unhappy. My response to her
was that project was not included in the proposal. That is when the customer started finding
issues with the project. I told her I we were glad to take care of it as long she supplied me with
the deck stain to color match. She refused and argued that I must supply sample and drop it at her
house. So, I got a match from Sherwin Williams and dropped it at her house and I sent her a text
to let her know about the sample being left at her front door. Next day I was surprised by her
arguing that I was not supposed to be on her property for any reason knowing she gave me
permission prior. There was no corporation to get approval of deck staining after the deck had
been power washed. She also mentioned about back staircase not being in the right location after
my son prior installation discussed with Donna. She finally decided to install the stairs in
existing location where she directed us. She became very complicated to accomplish final step of
staining the deck. We were waiting on her to answer for days and no luck. I decided to give her
a final invoice deducting deck staining.
Also, on the project we found rotted stair case located on the main front entrance of the
house. It measures 14 feet wide. That was replace to be able to install composite deck. We
inform customer about it and she agreed to pay for, but refused to pay after completion arguing
that it was part of proposal. We decided to continue with project and finish it.
